Absent: Adam Curtis Also Present: Susan Leven, Mark Nelson-HWG, Pat Hughes Recording or Taping Notification The Chair read"As required by the Open Meeting Law we are informing you that the Town will be videotaping this public meeting. They reviewed the motion from June 9, 2014. There was a lengthy discussion from 5:30pm to 7:00pm. The discussion can be viewed online at: http://ec4.cc/fd37c4fd Miller and Skidmore discussed the reason for the meeting, issues that seemed unclear, exemptions, and minimum standards. Skidmore - point of order, procedurally how to modify what we have done? Motion passed unanimously at the 6/9 meeting. Leven - Read the motion from the minutes including the discussion before the vote. After the 6/9/14 meeting, Leven sent an outline to the group and received conflicting comments. Leven recommended another meeting to clarify the motion. Nelson suggested reviewing the information piece by piece. Leven and Nelson presented the following on a flip chart. • Single family (SF) and Two family homes o SF > 5,000 square feet of clearing o *Exempt if, 300'from a pond or outside of drainage area CWPC Minutes 6-18-14 9/9/2014 10:26 AM o Must meet minimum performance standards: • Erosion control measures • Sedimentation control • Roof downspouts to dry wells • Rain gardens • Protection of catch basins • Certified by a professional engineer (PE) • Also applies to Multifamily and non residential projects > 2,500 square feet of clearing? • Single and Two-Family Homes < 5,000 square feet of clearing o Within 300' of a pond o Within a contributing drainage area o Outside 300'feet of a pond o Outside a contributing drainage area Nelson was in favor of keeping it to simple thresholds and town wide. He does not see this becoming a problem in Brewster because of the Conservation Commission and Building regulations. Build on existing regulations. Committee Discussion Topics: • They discussed minimum standards and should they be applied to all lots? • All single family homes down to a certain threshold- Nelson • They discussed thresholds. 500 square feet? Tie it to a building permit? Building code applications could trigger these regulations. Should it be 500 square feet thorough out the town? • Applicability and Thresholds • They discussed what type of projects trigger building permits? They discussed a map with Nelson. • 5,000 square feet is too high, consider 500 square feet... • O'Reilly- 5,000 square feet is too high -Taylor, town wide, 500 square feet- Lem, town wide, not just ponds. • Bennett- minimum standards apply town wide - any single family or multi family home, minimum standards apply. • Nelson- 500 square feet gives you a "de minimis" level for enforcement. • 2 people did not support 500 ft. (informal poll) • *Discussion was between 500 and 2,500 square feet • Bennett- minimum standards apply but an exemption if it does not affect a wetland resources (Ref vote from 6/9/14) • O'Reilly- expressed concern for enforcement if no number applies • Bennett- 500 and 5,000 gets an exemption unless within designated resource area • Nelson - None go into the process. All single family homes are exempt, only meet minimum standards • SFR > 5,000 square feet disturbance, goes through the full process? • O'Reilly was in favor of> 500 square feet. (public hearing) • Miller and Taylor expressed concern that people at town meeting will not understand the by- law. Leven suggested a summary. Nelson will work on it. There will be a sales process at the Town Meeting. A regulatory approach with flexibility is important. • *Nelson summarized, All SFR, 500 sq. ft. minimum thresholds, throughout the Town, meet minimum standards. There could be a variation on the 500 sq. ft. number. Now the debate moves forward to the Planning Board. (Could have full regulation for larger homes if necessary) • O'Reilly made a Motion to rescind the Motion from the 6/9/14 meeting, Taylor Second, All Aye, Vote 5-2-0. (Skidmore and Bennett voted no) • Discussion of the Motion - adopt > 500 sq. feet. Skidmore was against rescinding the previous vote. (Skidmore left the meeting early.) • What is a designated area? It is not a pond. This is guidance and recommendation to the Planning Board • Bennett requested a map. Nelson will include a map in his summary to the Board. The committee agreed. "Sensitive Areas" and drainage areas were discussed. -`f • The group discussed enforcement options and the illicit discharges by-law. (drainage into a town catch basin) • Non residential < 2,500 square feet. Commercial- subject to minimum standards? Nelson will work on this. There needs to be a "de minimis" level. Noted for the Planning Board. They discussed numbers. Bennett suggested the same framework with different dimensions. • Town roads exempt? Currently there is a waiver process. (O'Reilly left the meeting.) • Schell- road profile categories. MA Highway and Country profile. Does the proposal distinguish? (No) • Taylor questioned the Town coming to the Planning Board regarding roads. Currently they don't • Bennett-Town roads should not be exempt. The Town needs to lead by example. • Taylor questioned the funding sources. She discussed further with Nelson. • Miller suggested an article to sponsor road improvements by the Town- future discussion. • Nelson will respond in a week. • No meeting next Monday 6/23/14. • Ryan made a Motion to adjourn, Taylor Second, All Aye, Vote 7-0-0. I am providing below a proposed summary which I believe reflects the outcome and is consistent with the threads of discussion carried in the earlier portion of the minutes. I would propose this be added to the minutes or carried as an addendum to the minutes, attributed to me as chairman. Respectfully, Paula Miller Chairman's summary: There was agreement that a de minmus threshold of 500 feet be applied town wide to all residential single family projects and that minimum standards apply to these projects. The applicant would go through a simplified process, not a full permit application, tied wherever possible to other permitting being done relative to the project. Some members felt that single family residential projects disturbing greater than 5000 sq ft, or occurring within 100 or 300 feet of a pond, or within a pond watershed area should come under the full permit application. No consensus was reached on that. HWG was asked to present these issues in a discussion section in the draft prepared for the Planning Board. Non-residential and multi-family projects greater than 2500 ft disturbance would be required to obtain a full permit. The question of whether the minimum standards would apply to non- residential projects greater than 500 sq ft but less than 2500 sq ft was referred to HWG for consideration as was the question of whether the proximity to ponds and their recharge areas would trigger full permits in this range. Discussion of these issues is to be included in the draft for the Planning Board. Sent from my iPad '<z 1
