TOWN Date Approved:8-25-14 Vote: 8-0-0 TOWN OF BREWSTER MINUTES r.-- COMPREHENSIVE WATER PLANNING COMMITTEE (CWPC) `'rte "` -' Regular Meeting Monday,July 28, 2014 at 4:30 pm Brewster Town Office Building Chairman Miller convened the CWPC meeting at 4:30 pm in the Brewster Town Office Building with members, Adam Curtis, Russell Schell, Bruce Evans, Dave Bennett, Dan Ryan, John O'Reilly, and Elizabeth Taylor present. Absent: Lem Skidmore Also Present: Susan Leven, James Gallagher, Chris Miller, Robert Bersin Recording or Taping Notification The Chair read"As required by the Open Meeting Law we are informing you that the Town will be videotaping this public meeting. Citizen Forum None 2. Discussion of Direct Discharges This discussion was a follow up of the direct discharges and storm water projects from Bob Bersin. They have a list from Bersin and 20 discharges on the maps just received from Mark Nelson. Miller asked the committee for recommendations to proceed. Bennett noted the lists and questioned if this includes all. Bennett is an advocate for keeping this topic in front of the committee. Leven suggested comparing the lists. Miller asked about additional funding, recommendations, and process. Should the committee push this forward? Should it be an article at town meeting? O'Reilly abstained from further discussion. He left the room. Leven stated she would talk to Sumner regarding the approach. Leven referenced the new maps and the catch basins, in particular for Black Pond, figure #4, Mill Pond #21. (Catch basin and outfall) CWPC Minutes 7-28-14 8/26/2014 9:40 AM DRAFT Bennett suggested a letter to the Board of Selectmen Liaison, Pat Hughes and the Board of Selectmen that an issue has been identified and could be easily corrected. Outfalls should be on the maps. List the 20 outfalls. Leven stated that she would follow up on Wednesday. Bennett wanted an official letter. Schell questioned the 20 outfalls. Bennett suggested they should identify, distribute, and fund a response. Bob Bersin joined the meeting at 4:39 pm. Bersin noted that he has several lists. He shared a letter sent to the Board of Selectmen in 2013 regarding discharges. Miller suggested Leven combine the lists. Bersin stated he is low on funding and they are focusing on pavement repairs. The committee asked Bersin about the road repairs in particular Alden Road which discharges to Schoolhouse. Miller stated that the Consodine Ditch should not be listed as an illegal discharge. It should be in another category. She asked Leven to work with Bersin and combine the lists so the committee can support an updated list of priorities. The committee discussed fixing drainage when fixing the roads. 3, Discussion of Orleans Water Panel Meeting, July 16, 2014 O'Reilly rejoined the meeting. Leven gave the committee an update. • Interesting meeting • Large group of people including stakeholders and liaisons The discussion changed to storm water upgrades being included in the road betterment process. Leven explained that it is done through the Selectmen and is in the town code. The Planning Board comments on road betterment applications. Schell asked if the engineering plans for road betterments include sloping sides and catch basins. Leven had no comment. They discussed betterments and noted that correction of illegal discharges is not required yet. This is not addressed in the storm water by-law draft. Taylor expressed concern that the road betterments are not included. Leven will follow up with Mark Nelson of HWG. Bennett referenced the 10/30/13 letter from the committee to the Selectmen. What is the status of the review? Is there anything that this committee can do? Leven noted that of the 42 discharges on the Bersin list, 11 are in some stage of work. Leven will review further and follow up with Bersin. Important work is happening now. Miller asked if the committee can help prioritize or provide input. Taylor expressed concern that the ID # on the list may not match. She discussed further with Leven. Schell suggested adding outfalls. Leven will add to list, plus and one from Gallagher. The committee will discuss the list at the next meeting. 8/11/14. The committee continued their initial discussion about the Orleans Water Panel Meeting, 7/16/14. • There were many questions-next meeting 9/10/14 CWPC Minutes 7-28-14 8/26/2014 9:40 AM DRAFT • Orleans is talking to different consultants • Leven read the stakeholders and liaisons list • Schell noted liaisons don't make decisions and Miller added they are responsible for updating their groups • Leven will forward the list to the committee. • Mostly a procedural meeting 4. Discuss Memo from Paula Miller regarding Planning Board Meeting Miller watched the Planning Board meeting when they discussed the storm water draft by-law. She was concerned that they had some amount of pushback. The Board was interested in how much would be required under MS4 and pitching the by-law as pond protection. They seemed to be in support of minimum regulations in place that would be lower in cost and more acceptable. Leven stated that Miller was giving too much weight to the Board discussion. Their comments were based on an initial review. Mark Nelson will come and discuss further with the Board on 8/13/14. Miller commented on the new watershed maps and Nelson's reluctance to use with the storm water by- law. Can these maps be used to move forward with storm water recommendations? Leven noted the maps were being used with the Board of Health regulations. Miller is interested in hearing from HWG how else to use the maps information. Nelson is coming to the CWPC meeting 8/11/14. He will address MS4 and the pond water shed maps. Schell was in support of Miller's comments and made the following observations: (From email, 7/28/14) Schell read his email. Leaching Field Separation Distance From Wetlands. Rationalization of Observations associated with the subject topic include: 1. All HWG Pond Watershed Delineation Figures include definition of surface watershed (green line) and a septic system buffer (blue line). Some Figures also include a groundwater capture area (orange crosshatching). 2. The surface watershed tributary to the Breakwater Beach NPDES Small MS4 outfall includes Cobbs Pond (Figure 9), Myricks Pond (Figure 4), and Considine Ditch. 3. The surface watershed area tributary to the culvert under Lower Road near its junction with Lantern Lane, a NPDES Small MS4 outfall, includes Freemans Pond (Figure 13) and Schoolhouse Pond (Figure 30). 4. The surface watershed area tributary to Upper Mill Pond and Walkers Pond includes the Mill Ponds Complex (Figure 22), Canoe Pond (Figure 8), Slough Pond (Figure 33), and Elbow Pond (Figure 12) 5. All three area delineations are included in Long Pond (Figure 20), which includes Girl Scout Pond (Figure 14), but the ground water capture area is omitted from Figure 14. Schell stated that these maps are part of a larger picture that has so far not been addressed. Storm water outfalls at Breakwater, Lower Road, and Lantern Lane. Leven sent Schell's comments to Nelson. Miller asked for the committee to discuss the maps at the next meeting. Bennett stated that the maps are not consistent. He summarized his comments in an email. From Bennett: My only comments for the next meeting in review of the maps by the committee is to advise our consultant of a concern that all the maps do not show an area of groundwater contribution up gradient of the ponds nor provide information that is available on the quality of the water body for ponds with testing information. I would also suggest that the Brewster Assessor Map # corresponding to the GIS mapping be in the header and any outfalls that Sue comes across that were not part of the MS4 study be included, or were remedied, removed. Gallagher had the same comment. He sent his comment to Leven. Bennett and Miller continued to discuss further. CWPC Minutes 7-28-14 8/26/2014 9:40 AM DRAFT Taylor noted that the 300 foot buffer around ponds be consistent on all sides. Leven stated up gradient, 100 feet down gradient. Miller had a question for Nelson. Ponds the same as wells? They discussed the 300 feet buffer. Taylor and Miller discussed further. Members were encouraged to send comments to Leven. Maps will be available on a laptop in the Planning Office. 5. Topics the Chair did not reasonably anticipate None. The next meeting is Monday 8/11/14. Ryan made a Motion to adjourn, Curtis Second, All Aye, Vote 8-0-0. The meeting ended at 5:30 pm.
