Date Approved:9/8/14 Vote: 8-0-0 TOWN OF BREWSTER MINUTES - - COMPREHENSIVE WAT ER PLANNING COMMITTEE (CWPC) Regular Meeting Monday, August 11, 2014 at 4:30 pm Brewster Town Office Building Chairman Miller convened the CWPC meeting at 4:35 pm in the Brewster Town Office Building with members Russell Schell, Dave Bennett, Dan Ryan, John O'Reilly, Lem Skidmore, and Elizabeth Taylor present. Absent: Bruce Evans, Adam Curtis Also Present: Susan Leven, James Gallagher, Nancy Ellis Ice, Pat Hughes, Robert Bersin, Mark Nelson(HWG) Recording or Taping Notification The Chair read"As required by the Open Meeting Law we are informing you that the Town will be videotaping this public meeting. Citizen Forum None 2. Continued Discussion of Direct Discharges Review list Leven distributed two lists. 1) From Kleinfelder and 2) From DPW Bersin is still commenting on the list. The list will be carried over to the next meeting, 8/25/14. Shaded items reflect progress on items mentioned in the letter of 10/30/13 to the Board of Selectmen. Schell referenced the last page (Bersin's List in Addition to Items on Kleinfelder List) He expressed concern regarding the Kleinfelder Maps. The maps show the relationships to NPDES/MS4 storm watersheds and wetlands which are being addressed by the Conservation Commission until mS4 implementation. Taylor asked if the committee will be looking at runoff from lawns. Can they be picked up off GIS maps? Bennett mentioned a 208 program which has a map of lawn sheds that may be helpful for the discussion. (Adaptive management tool from the Cape Cod Commission) Miller noted they need to follow up on discharges and how to address. Should the committee make a recommendation? CWPC 08-11-14 KCM 3. Mark Nelson from Horsley Witten Group — Pond Watershed Maps and related Topics Nelson provided a PowerPoint presentation to the committee. The committee discussed the Kleinfelder maps and any suggested changes. • Leven will work with Lambert to get them added to the GIS system-the maps were sent to the committee as a PDF 7/29/14 • 40-43 pond maps were sent to the group • The maps-can see buffers and parcels etc. There will be an atlas of all maps in the office. • The pond maps show contributing areas to the ponds. This is a great town wide analysis • Pond maps will be added to the project web site-accessible from town web site Schell added that the surface connection to Cobbs Pond should be shown on the Myricks Pond map. Consodine feeds into Breakwater Beach outfall. Nelson noted that he is not sure how to handle the Consodine Ditch. Schell encouraged Nelson to look at it as he is concerned about the proposed 40B project and its culvert capacity. The Consodine Ditch was discussed. It drains areas inside and outside of the MS4 areas. Nelson was asked if he could include in the atlas the overall watershed to the ditch. Nelson agreed to look at available data. Nelson explained that it is important for the Town to get a better understanding of this drainage system but that the review is a separate analysis from the review of the individual ponds. Schell stated that this is an integral part of the storm water by-law, regulations and IDDE. Gallagher informed the committee that the Conservation Commission asked for more information from Coastal Engineering regarding the proposed 40B project. They identified the water shed and ditch. The data is available in the Conservation office. Connections between ponds were discussed, including surface overflows and pipes that interconnect ponds, for example Elbow Pond flows into Walkers, Slough Pond flows into a wetland then by culvert into Walker's Pond. Nelson was asked whether these connections could be added to the maps. Schell wants to see surface water flow to ponds mapped, including intermittent storm water overflows from Slough Pond and Elbow Pond to Walkers Pond. He was concerned about the bog and being able to see water leaving Elbow Pond. Schell: • Pipes that connect ponds • Identifying buffers around the ponds and looking at septic systems • Sources of pollutants to the ponds-what can we manage? • Septic regulations-don't address connections • Storm water by-law is Town wide and will improve water quality to the pond or ground water. It is not resource sensitive Nelson explained that the purpose of the map is to identify sources of Phosphorus to ponds on a day-to day basis, and that the inter-connections would not be germane to septic system regulations. Nelson was asked to show streams more clearly as well as wetlands. Nelson was asked how to resolve up gradient/down gradient issues. A hydro geologist could determine what side of the line a property was on. The use of the maps for storm water management was discussed. Nelson stated that the surface watersheds on the maps could be used to prioritize storm drain outlets for correction, originally 19 were identified for conceptual designs in Phase II work. The committee reviewed the Sheep Pond and Long Pond Maps. All maps noted include surface water shed, groundwater capture area, catch basins, and septic system buffers. The committee reviewed the Myricks Pond Map. Schell noted that this map is similar to Elbow Pond. He asked for Nelson to include the downstream connection area at Breakwater. Schell noted the surface water shed line should be tentative until you look at the Consodine Ditch. Nelson stated they could look at it in more detail. CWPC 08-11-14 KCM There is a draft Board of Health regulation that Leven has received from HWG. Ice and Skidmore are reviewing and the Board of Health will review next. If a property is on the line an engineer can present evidence of which side the property falls on. Some ponds are very small and will only affect one or two parcels. Miller-P and Nelson discussed what would be done inside of the green line. Nelson noted that the storm water by-law applies to either side of the line. The Leven/Bersin list should be retrofitted. Ex. Myricks Pond Source of pollutants, start to understand the issues, and perhaps do a sampling program. Bennett requested that the water quality data and wetlands be added to the pond maps. Schell stated that wetlands, particularly cranberry bogs, are connected to Myricks Pond as well as to Girl Scout Pond, where there is impaired water quality but no obvious septic systems. Nelson pointed out that it is hard to distinguish working bogs from abandoned ones. How to deal with these comments was discussed. Various members felt it was important to add more information to the maps, and some felt that they should be kept simple. Miller-P felt the water quality data would date the maps. Others felt it would be a distraction. It was suggested the pond water quality status could be listed as an item in the legend only. • Nelson stated he would add hydro geologic info on a couple of maps and send them around for comment. • Bennett added that the MA GIS Wetlands Layer exists. • Schell added that it applies to Myricks Pond and Girl Scout Pond. • Miller-P stated no new information or reworking of the maps. Any suggestions or errors should be sent to Leven. • Bennett was concerned about water quality information. Is information on other maps? Schell agreed and stated that information is already available. Miller-P questioned layers being applied to these maps. • Nelson noted they can add in a legend if in 2014 the pond was considered impaired • Gallagher questioned what the maps will be used for. If you add water quality to the maps people may think they don't need to do any improvements. • Hughes noted that there are a lot of uses for the maps. She suggested they keep the maps as simple as possible. These may be helpful to the Pond Coalition and be an important tool when discussing regulations. • Nelson asked the committee if he should add a legend for water quality status 2014. • Bennett thought it was important to include so that people protect water or use it to enforce and imoe d w qy. • Schell pry endorsedpon ater. Surface ualit water hydrology map is important. This is part of the storm water regulations. • Leven suggested they keep the maps simple. No wetlands or connections. It will be confusing to people. The average homeowner is the intended audience. Professionals know where to go for more detailed information. • Skidmore agreed with Leven. The purpose of the maps is to communicate to the people in the Town. Communications are important and simple maps are better. Miller-P asked for a Mill Pond Report update. Nelson stated the report is complete but is going through internal review with SMAST. He will follow up with Ed Eichner. Miller-P asked if road betterments will be addressed. Leven explained that road betterments are tied to Planning Board Road Standards. They could be changed but it does not need to be in the Road Betterment by-law. Drainage could be addressed as part of the process. Nelson added they are changing how the system is designed not constructed. O'Reilly commented on the Road Betterment by-law program. • Design standards are not required • The designer needs to ensure the road lasts a minimum of 15 years CWPC 08-11-14 KCM • It could be tweaked to include some regulations • The question is where does this belong? Schell added there are two types of roads to be addressed. 1) country road and 2) angled berms LID process, available? Leven explained that areas are possible. In a lot of areas the road layout is not wide enough. It is always an option. Upcoming meeting dates: Cape Cod Commission, 208 Plan, 8/15/14 (see recent email) Board of Health, 8/19/14 Planning Board, 8/27/14 - Nelson discussion storm water by-law Pond Coalition, 8/27/14 Bennett asked about the Board of Health review of the new regulations. Is this committee going to comment? Nelson stated the new regulation takes the place of the current regulation. Miller-P noted there is no discussion scheduled. Leven explained that the BOH is not commenting to Nelson before 8/19/14. Skidmore stated that this is the first time the BOH has seen the regulation. This is a preliminary discussion. He will report back to the committee on 8/25/14. Nelson will come to the 8/25/14 meeting. 4. Minutes for approval 7/14/14 The minutes of 7/14/14 were not emailed to the committee. They will be reviewed at the next meeting. 5. Topics the Chair did not reasonably anticipate Leven asked the committee to remember they are on local TV. Please use the microphone when speaking and do not speak in code. Remember you are speaking to the general public. Technical jargon should be kept to a minimum. In the future they will face Town Meeting and it is very important for the general public to understand the topics of discussion. The next meeting is Monday 8/25/14.
