Absent: Elizabeth Taylor Also Present: Susan Leven, James Gallagher Recording or Taping Notification The Chair read"As required by the Open Meeting Law we are informing you that the Town will be videotaping this public meeting. Citizen Forum None 2. 208 Plan Comments (M. Nelson Draft) Leven provided a brief summary • Meeting 9/24 - Doubt they would see watershed based recommendations anytime soon (CCC) • Timeframes and deadlines were discussed • Miller- Fertilizer credit, 25% of the load from fertilizer, according to CCC • Orleans Discussion- Rep? Orleans moving head. He felt Brewster and Harwich need to move forward. How will Brewster work with Orleans? Leven mentioned this at the last panel meeting • Brewster has little to do with Orleans compared to Eastham • Leven noted this topic comes up at every panel meeting • Higher load in PB basin? Miller questioned (see attachment #1 from P. Miller ) • Leven - panel is talking about many types of solutions and DEP acceptance or not? • Orleans BOS has decided not to comment on the 208 plan CWPC 10-14-14 KCM/SML 1 • Miller asked about whether they should comment or not • The committee reviewed the letter to Paul Niedzwiecki dated 9/24/14. Schell sent Leven comments • Comments from Mark Nelson were discussed. o Page #2 of letter- Use of a Waste Management Authority- Recommendation R5.6 was discussed, Miller asked for clarification o Bennett was concerned about Orleans having an approved program they have already set the fate for Brewster. They have determined the loads already. *Critical point, to be noted. o Bennett will submit additional comments. Apportionment of number of houses. o Looking for opportunity to engage the neighbors (perhaps in the last section of letter) o 11/20/14 deadline for the letter o Letter- Page #2, Water Pollution Abatement Districts- Recommendation R5.7 - reviewed • Opportunities to engage neighbors and name? • The committee discussed the Orleans plan and coordination between Brewster and Orleans. • The committee discussed Status of Brewster's Integrated Water Resource Management Plan- Page 6-2 (Page #3 in the letter) o Work with neighboring communities- sharing money with other towns? Alternatives? • Talk with Mark Nelson next week- cooperate with Orleans on #4, #5? • Cash payment to Orleans for sewer connection? (4 or 5 alternatives?) • Meet levels without cash payment? Is it needed? • Shellfish propagation in PB - depends on approval from Orleans. Fertilizer by-law, Review Comments Discussion Summary: • Miller asked Leven what she wants from the committee. Leven wants comments from committee members. The Town is looking for the best way to do this. Nelson sent questions marked in gray. Who would implement? This new by-law is different than the one discussed last year. BOH? • Skidmore explained it is a general by-law not a BOH regulation. • Leven stated that the warrant goes to the printer on 10/23/14. Comments are needed ASAP. • Leven has received comments from Jillian Douglass. • BOH does not have staffing to be the implementer • Does the article have to name an agency? It could be designated by the BOS. • The committee discussed the Mashpee by-law • There was concern about enforcement • The discussed registered landscapers-List? • Page 5, Item B - certification process outside of the town? Needs to be discussed • Information needs to be shared with the landscaping professionals • Minimize certification in the draft • County training? Town receives a list of people who attended training • Bennett was in favor of registering landscape professionals CWPC 10-14-14 KCM/SML 2 • Leven received comments from Miller only • They reviewed the draft from Mark Nelson o Page #2 119-4 Applicability- Miller read. Gray box. Miller agreed. Most agreed. o Page #3, Gray box. BMP? It is brought up somewhere else o Page #3 2nd box- Miller read. They agreed. o Miller had problem with heavy rain applications. No numerical definitions needed. o Dates- no fertilizer after 11/12 or before 4/14 - (12/1) was suggested. (5/1) was suggested. o What is the enforcement? On or before end of growing season, on or after end of frost?- BMP? o Bob Bersin- Compost on lawn in the winter? It has a lot of nitrogen in it. o Not exceed a pound - It can be tested, mostly chemical fertilizers • Compost piles within 100 feet of ponds- G. Huefelder presentation • Mark and Sue are going to have a meeting with Mr. Huefelder • Page #4 - MDAR Fertilizer Regulations- Miller, this was removed. Not regulating phosphorus in this by-law. • Ban on phosphorus in fertilizer-yes lawns except starter lawns • Page #6 - Formulas were discussed - .8 lbs. suggested • Commercial applicators can apply more than a homeowner • MEP Plan Report, defined fertilizer application for lawns-homeowners • Less than what is allowed • By-law allows for higher application- from Barnstable County • Irrigating systems creating run off, should be addressed o Bennett- statement of purpose should be included. Discourage this use.... o Miller read a purpose from the draft o Encourage minimally managed lawn areas- Section F o Runoff was discussed o Comments to Leven by 10/16/14 4. SMAST, Draft Mill Ponds Report The committee will discuss next week on 10/20/14. Leven and Miller discussed the report briefly. Bennett asked for Schell's comments on the report. The committee will send comments to Leven. *Executive summary and management plan are most important to review. 5. 9/8/14 minutes for approval O'Reilly made a Motion to approve the minutes of 9/8/ 14 as written, Skidmore Second, All Aye, Vote 8-0-0. Topics the Chair did not reasonably anticipate - None Bennett made a Motion to adjourn, Ryan Second, All Aye, Vote 8-0-0. The meeting ended at 6:15 pm. The next meeting is 10/20/14. There will not be a meeting 10/27/14. I have since forwarded to Sue a table by HWG providing the basis for my comment. Can this be shared with the committee and discussed with HWG? I have attached a copy below. The appropriate reduction percentages were then applied to compute the load reductions for each Town contributing to each planning unit (see table below). For the River Group and Little Pleasant Bay, most of the reductions must come from Orleans. For Quanset Pond,the reductions are split between Brewster and Orleans. For the main part of Pleasant Bay, all towns are responsible, with Brewster having the largest reductions. Potential Solutions for Brewster Using the required reductions for Brewster,the table below provides an estimate of the number of single-family homes requiring advanced septic treatment or at a wastewater treatment facility(WWTF). Because the MEP study was based on an effluent concentration for septic system nitrogen of 26.25 mg/L, each treatment option in the table only claims credit for the reduction from 26.25 mg/L to its effluent concentration (say 19 mg/L for advanced septic). This conservative assumption could be relaxed in favor of a strict percent reduction approach, which would give greater reductions and fewer homes treated. Discussions with MassDEP on this issue are ongoing on this approach. 1
