OF THE CITY OF LYNWOOD AMENDING CHAPTER 25 OF THE LYNWOOD MUNICIPAL CODE TO PROHIBIT THE ESTABLISHMENT OF SECOND UNITS IN SINGLE-FAMILY AND MULTI-FAMILY RESIDENTIAL ZONES The City Council of the City of Lynwood DOES HEREBY ORDAIN as follows: Section 1. The City. Council finds and determines that SB 1534 permits a city to adopt an ordinance which totally precludes second units within single-family and multi-family zoned areas pro- vided that the ordinance acknowledges that such action may limit housing opportunities of the region and further contains findings that specific adverse impacts on the public health, safety and welfare that would result from allowing second units justify adopt- ing such an ordinance. Section 2. The City Council finds and determines that second units should not be permitted in any residential zone in order to protect the public health, safety and welfare. Section 3. The City Council further finds and determines that allowing second units in residential areas of the city would cause adverse impacts on the public health and welfare in that the percentage of absentee landlords would be increased. The addition- al housing units would exceed the density limits established by the Lynwood Municipal Code and General Plan and would intensify the overcrowding already experienced in the City's residential areas. Section 4. The City Council hereby finds, determines and declares that the immediate preservation of the public health, safety and welfare necessitates the enactment of this ordinance. A declaration of facts constituting the reasons second units should be prohibited in the City are as follows: 1. The existing housing units in Lynwood are not under- utilized as evidenced by the fact that the 1980 Census indicated the average number of persons per housing unit was 4.2; the 1980 Census also indicated that 22 percent of the City's housing units are overcrowded., 2. The City of Lynwood has forty-nine (49r) percent of its housing stock occupied by renters; the creation of second units would thus increase the number of absentee landlords and non-owner-occupied units, contrary to the goals and policies of the Housing Element of the Lynwood General Plan. 3. In 1981 the City adopted an ordinance which permit- ted lot coverage in the single-family zone to be increased from. 40 to 50 percent the multi-family ,_~ __..,.~,.no ..,aG ;ncreased from 50 to 60 percent, r 5. Second units in existing single-family and multi-family zoned areas would further aggravate the overcrowding currently experienced in local schools. The Lynwood Unified School District reports an enrollment of 12,057 students (as of May, 7.983). Available classroom space can only acconunodate 10,757. 6. Second units in existing single-family and multi-family zoned areas would further exacerbate increased demands on already deficient public recreational facilities, as disclosed by the Lynwood Park & Recreation Element. Section 5. The adoption of this ordinance may limit housing opportunities within the region; however, the specific adverse impacts on public health, safety and welfare, as set forth herein, necessitate and justify its adoption. Section 6. Section 25-4.2a of the City Code is amended to include the following: a. Residential Uses: Single family or movidedleinaSectione6585gslsetlsegoofliheude second units as P _ . California Government Code. Section 7. Severability. If any section, subsection, sub- division, sentence, clause, phrase or portion of this ordinance or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court or com- petent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other per- sons or places. The City Council hereby declares that it would have adopted this ordinance, and each section thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. Section 8. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circu- lation, printed, published, and circulated in the City of Lynwood. First read at a regular meeting of the City Council of 5th da of JULY 1983, and said City held on the y finally ordered published at a regular meeting of said Council held on the 19th day of JULY 1983.
