ORDINANCE NO. 1201
AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE
OF THE CITY OF LYNWOOD TO REQUIRE THE
OBTAINING OF A PERMIT FOR THE CONDUCT OF
COMMERCIAL ACTIVITY IN A PARKING LOT
The City Council of the City of Lynwood HEREBY DOES
ORDAIN as follows:
SECTION 1. The Code o£ the City of Lynwood
(hereinafter "Code") is hereby amended by repealing Section
17-75, subsections (10) and (10.1) and adding the Following:
"(10) PARKING LOT SALE MERCHANTS: For each
licensed owner or operator of a business who
conducts or carries on the offering for sale or
actual selling of merchandise of any kind or type
in the applicant's parking lot.
"(10.1) PAWNBROKERS: For each person
managing, conducting or carrying on any business
as a pawnbroker.
"(10.2) PICTURE ARCADES: For each person
managing, conducting or carrying on the business
of a picture arcade.
SECTION 2. The Code is hereby amended by adding
Division 9, Section 17-100 as follows:
"Division 4. SALES CONDUCTED IN PARKING
LOTS.
"Section 17-100: Contents of Application
for Special Permit; Fee.
"Each applicant for a special permit
required by Section 17-75(10) to manage, conduct
or carry on the offering for sale or actual
selling of merchandise of any kind or type in a
parking lot located within the City shall state
in the application the location(s) where such
sale(s) will occur, the date(s) of such sale(s),
and declare and acknowledge that such sale(s)
shall not occur on any public right of way or
sidewalk or be conducted in such a manner as to
interfere with public fire or police protection
services. A fee in an amount established by
resolution.of the City Council shall accompany
each application.
"Section 17-101. Duration of Special Permit.
"No special permit required by Section
17-75(10) shall be granted for more than three (3)
days for the purpose of conducting the sale(s).
"Section 17-102. Sales Conducted in Parking
Lots; Prohibitions.
"No sale conducted in a parking lot shall
occur in any public right of way or sidewalk or
be conducted in such a manner as to interfere
with public fire or police protection services."
SECTION 3. Severability. If any section,
subsection, subdivision, sentence, clause, phrase or
portion o£ this ordinate, or the application thereof to any
person or place, is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity
of the remaining portions of the ordinance or its
application to other persons or places. The City Council
hereby declares that it would have adopted this ordinate,
and each section, subsection, subdivision, sentence,
clause, phrase or portion thereof, irrespective of the fact
that any one or more sections, subsections, subdivisions,
sentences, clauses, phrases or portions, or the application
thereof to any person or place be declared invalid or
unconstitutional.
SECTION 4. The City Clerk is hereby ordered and
directed to certify to the passage of this ordinance and to
cause the same to be published once in the Lynwood Press, a
newspaper of general circulation, printed, published and
circulated in the City of Lynwood.
First read at a regular meeting of the City Council of
said City held on the 5th day of April 1983 and
finally ordered published at a regular meeting of said Council
held on the 19th day of Npri 1 198 3 .
