HomeMy Public PortalAboutOrd. 120282116 ORDINANCE N0. 1202 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING CHAPTER 25, THE ZONING ORDINANCE, OF THE MUNICIPAL CODE BY ALLOWING MOTELS/HOTELS IN THE MEDIUM COMMERCIAL (C-2 A) AND HEAVY COMMERCIAL (C-3) ZONES, WITH A CON- DITIONAL USE PERMIT The City Council of the City of Lynwood DOES HEREBY ORDAIN as follows: SECTION 1. Section 25-7.5 is added to the City Code to read as follows: 25-7.5 Uses Prohibited. Motels and hotels shall be prohibited in the CB-1 Zone. SECTION 2. Section 25-8.1 of the City Code is amended to read as follows: 25-8.1 Use. a. No building or land shall be used or occupied for, or no building shall be erected, constructed, established, altered, enlarged, moved into, or within a Zone C-2 which is to be used or occupied for any other purposes than as follows: 1. Any use permitted in P-1 Automobile Parking Zone, and when so used subject to all the pro- visions contained in the section defining said zone. 2. Retail stores or businesses not involving any kind of manufacture, processing, or treatment of products other than that which is clearly incidental to the retail business conducted on the premises and provided that not more than five (5) persons are employed in the manufacture, processing or treatment of products, and that such operations or products are not objection- able due to noise, odor, dust, smoke, vibration or other similar causes. 3. Advertising sign boards or structures. 4. Antique store. 5. Arcade (provided that the requirements of Section 25-8a are met). 6. Automobile service station (provided the re- quirements of Section 25-16.16 are met). 7. Automotive parts store. 8. Automotive repair business, except body and fender works and painting (provided that the requirements of Section 25-16.15 are met). 9. Bakery, retail. 1.0. Bank. 11. Barber shop or beauty parlor. 12. Baths, turkish, and the like. 13. Billiard or pool hall. 14. Blueprinting and photostating. 15. Bird store or pet shop. 16. Book or stationery store. 17. Car Wash (provided the requirements of Section 25-16.15 are met). 18. Child care center, day nursery or pre-school. 19. Christmas tree sales at retail, on a lot or par- cel of land subject to Chapter 17, Sections 17- 68 through 17-75 of the Lynwood City Code. 20. Church, temporary revival. 20a. Cleaning and pressing establishment using non- inflammable and non-explosive cleaning fluid. 21. Confectionery store. 22. Conservatory of music. 23. Dance, tavern, as defined by Chapter 4, Section 4-18 of the Lynwood City Code. 24. Department store. 25. Dressmaking or millinery shop. 26. Drug store. 27. Dry goods or notions store. 28. Electric appliance stores and repairs. 29. Electric distributing substation (when enclosed with a solid masonry wall). 30. Fireworks sales at retail subject to Chapter 12, Sections 12-11 through 12-18 of the Lynwood City Code. 31. Florist shop. 32. Funeral parlor. 33. Furniture store. 34. Furniture warehouses for storing personal house- hold goods, provided ground floor front is de- voted to stores. 35. Grocery or fruit store. 36. Hardware store. 37. Interior decorating store. 38. Jewelry store. 39. Ice storage house of not more than five (5) ton capacity. 2 40. Laundry or clothes cleaning agency. 41. Meat market or delicatessen store. 42. Medical laboratory. 43. Music or vocal. instruction. 44. Music store. 45. News stand. 46. Nursery, flower or plants. 47. Offices, business or professional. 48. Radio store. 49. Restaurant, tearoom, cafe, cocktail bar (pro- vided that the requirements of subsection 25-8.8 are met). 50. Shoe store or shoe repair shop. 51. Storage garage (including repairing and servicing). 52. Studios (except motion picture). 53. Tailor, clothing or wearing apparel shop. 54. Taxidermist. 55. Telephone exchange. 56. Trade school (not objectionable due to noise, odor, vibration, etc.). 57. Tinsmith (not sheet metal; see subsection 25-10. if.2). 58. Used car sales area, provided (a) that no repair or reconditioning or automobiles shall be permitted, except when enclosed in a building; and (b) that such area is located and developed as required in Section 25-14.4. 59. Wedding chapel. 60. Accessory buildings and uses customarily incident to any of the above uses when located on the same lot. SECTION 3. Section 25-9.1c is added to the City Code to read as follows: c. Motels and hotels, provided a Conditional Use Permit has been obtained, and that the folloeving standards have been met: 1. No cooking facilities shall be permitted in any rooms, other than the manager's. 2. One (1) off-street parking space shall be pro- vided for each sleeping unit. 3. Such uses shall only be permitted within fifteen hundred (1500) feet of a freeway as defined in Section 25-33.1 of the Lynwood City Code., or within L500 feet of the proposed I-105, Century Free- way. 3 4. Such uses must solely provide overnight or weekly accom- modations. 5. Any other conditions deemed necessary by the Planning ConUnission to protect the public health, safety and general welfare of the surrounding community. SECTION 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section thereof, irrespective of the fact that any one or more section, subsection, sentence, clause, phrase, or portion, or the applica- tion thereof to any person or place, be declared invalid or unconstitutional. SECTION 5. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 17th day of MAY 1983, and finally ordered published at a regular meeting of said Council held on the 7th day of ,TUNE 1983.
