HomeMy Public PortalAboutOrd. 1195ORDINANCE N0. 1195 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING CHAPTER 25 OF THE LYNWOOD MUNICIPAL CODE, THE ZONING ORDINANCE, PERTAINING TO PROVISIONS GOVERNING CONDITIONAL USE PERMITS. The City Council of the City of Lynwood DOES HEREDY ORDAIN as follows: SECTION 1. Section 25-25.9 of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance, is hereby deleted in its entirety. SECTION 2. Section 25-25.9 of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance, is hereby added to read as follows: "25-25.9 Lapse of Conditional Use Permit. a. A Conditional Use Permit shall lapse and become void ninety (90) days from the date on which the Condi- tional Use Permit was granted, unless all conditions of said permit are met and either a Building Permit or Business License is issued. A longer period of time to meet the conditions of said permit may be granted under special circumstances, such as a conditional use involving new construction or major rehabilitation. b. A Conditional Use Permit subject to lapse may be re~ Hewed for an additional period of ninety (90) days, provided that prior to the expiration date, an appli- cation for renewal is filed with the Planning Division. Said renewals shall be approved by the Planning Divi~ Sion. c. If, in the opinion of the Planning Division, an appli- cation for renewal will require modification of exist- ing conditions of approval and/or the addition of new conditions of approval, the said modification shall be forwarded to Planning Commission for approval or de- nial. d. A Conditional Use Permit shall lapse and become void ninety (90) days after the use permitted has been abandoned or has ceased to be actively exercised." SECTION 3. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance or the application thereof to any person or place, is for any rea- son held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section thereof, irrespective of the fact that any one or more section, sub- section, sentence, clause, phrase, or portion, or the application thereof to any person or place, be declared invalid or unconstitu- tional. SECTION_4. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood.
