HomeMy Public PortalAboutOrd. 119783002 ORDINANCE N0. 1197 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD hIUNICIPAL CODE BY ADDING PROVISIONS PERTAINING TO CHILD CARE IN COMMERCIAL ZONES. THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 25-2.1 of the Lynwood Zoning Ordinance is hereby amended by adding thereto the following definition: Child care center shall mean any establishment providing day or hourly care for children less than four years and nine months of age. If day care is also provided for children greater than four years and nine months of age, but does not include a course of training similar to that given in any elementary or secondary school, the establish- ment shall also be considered as a child care center for the purposes of this ordinance. Sect_i_on 2. Section 25-8.1a of the Zoning Ordinance is hereby amended by adding thereto a new subdivision: Child care center, with a Conditional Use Permit. Section_3. Section 25-11.3a3 of the Zoning Ordinance is hereby deleted and another subdivision is added to read as follows: "3. Any retail or personal service permitted or con- ditionally permitted in any commercial zone within the City." Section 4. Severability. If any section, subsection, sub- division, sentence, clause, phrase or portion of this ordinance, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity or the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespec- tive of the fact that any or more sections, subsections, subdivisions, sentences, clauses, .phrases, or portions, or the application .thereof to any person or place, be declared invalid or unconstituional. Section 5. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the dsame to be published once in the Lynwood Press, a newspaper of general circula- tion, printed, published, and circulated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 1st day of March 1983, and finally ordered published at a regular meeting of said Council held on the 15th day of March 1983.
