HomeMy Public PortalAboutOrd. 119883003 G ORDINANCE NO. 1198 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING THE ZONING ORDINANCE WITH RESPECT TO COMMUNITY CARE FACILITIES The City Council o£ the City of Lynwood DOES HEREBY ORDAIN as follows: SECTION 1. Section 25-2 of the City Code is amended to include the following definitions: "Community care facility shall mean any facility, place or building which is maintained and operated to provide non-medical residential care, day care or homefinding agency services for 7 to 12 persons (children, adults or children and adults) including, but not limited to, the physically handicapped, mentally impaired, or incompetent persons. "Residential facility shall mean any family home, group home, or social rehabilitation facility pro- viding twenty-four hour non-medical care to persons in need of personal services, protection, supervision, assistance, guidance or training essential for sus- taining the activities of daily living or for the protection of the individual. "Residential care facility shall mean any State- authorized, certified or licensed family care home, foster home, or group home for six or fewer persons, exclusive of members of the licensee's family, in accordance with Sections 5115 and 5116 of the Welfare and Institutions Code. "Social rehabilitation facility shall mean a facility of any capacity that provides services in a group setting to persons who are currently or potentially capable of meeting their life support needs indepen- dently, but who temporarily need assistance, guidance, or counseling." SECTION 2. Sections 25-3.4 and 25-3.5 of the City Code are deleted in their entirety. SECTION 3. Section 25-4.2a of the City Code is amended to read as follows: a. Residential Uses Zones R-1 R-2 R-3 Single-family dwellings, P C including mobile home units certified under the National Mobile Homes Con- struction and Safety Stan- dards Act of 1974 that are on a permanent foundation system approved by the City Building Department. -1- Zones R_1 RR=2 RR=3 Multiple dwellings C containing not more than two (2) units, including duplex mobile homes, cer- tified by the same procedure as single-family dwellings. Multiple dwellings containing C C more than two (2) units. Residential condominiums. C C Boarding or rooming house, C dormitory and similar group quarters. Residential facility. C Family home, group home or social rehabilitation faci- lity as defined herein. Residential care facility P P P (not closer than 300 feet to another such facility). Community care facility C SECTION 4. Section 25-4.8b of the City Code is amended to read as follows: b. Permitted Uses 1. The following uses shall be permitted in the P-R-D Zone: Residential care facility (not closer than 300 feet to another such facility). Home occupations as subject to the provisions of Chapter 17, Section 17-92 of the Lynwood City Code. Accessory uses including garages and carports, storage sheds, covered patios, cabanas and swimming pools. 2. The following uses may be permitted in the P-R-D Zone if a Conditional Use Permit has been granted in accordance with the provisions of Section 25-25: Single family dwellings, including mobile home units certified under the National Mobile Homes Construction and Safety Standards Act of 1974, that are on a permanent foundation system ap- proved by the City Building Department. Multiple dwellings containing not more than two (2) units, including duplex mobile homes, certified by the same procedure as single family dwellings. Multiple dwellings containing more than two (2) units. -2- Nonresidential uses including: Child day care and nursery schools. Public elementary or secondary schools. Private elementary or secondary schools. Church, temple or other places of worship. Public utility and public service substations, reservoirs, pumping plants, and similar instal- lations, not including public utility offices. Recreational facilities such as country clubs, tennis and swim clubs, golf courses, with incidental, limited commercial uses which are commonly associated and directly related to the primary use. Convenience sales and personal services establishments which are engaged in the pro- vision of frequently or recurrently needed small personal items or services for residents or tenants within reasonable walking distance and are clearly incidental and auxiliary to the residential development. Residential facility including family home, group home or social rehabilitation facility as defined herein. Community care facility. Accessory uses including laundry buildings, tennis courts and recreational buildings. SECTION 5. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section thereof, irrespective of the fact that any one or more section, subsection, sentence, clause, phrase, or portion, or the applica- tion thereof to any person or place, be declared invalid or unconstitutional. SECTION 6. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 1st day of March 1983, and finally ordered published at a regular meeting of said Council held on the 15th day of March 1983.
