HomeMy Public PortalAboutOrd. 119983004 ORDINANCE N0. 1199 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING CHAPTER 25 OF THE LYNWOOD MUNICIPAL CODE, THE ZONING ORDINANCE, t4ITH RESPECT TO AUTOMOTIVE PARTS STORES AND AUTOMOTIVE BODY/ FENDER REPAIR BUSINESSES. The City Council of the City of Lynwood DOES HEREBY ORDAIN as follows: Section 1. Section 25-8.1a of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance, is hereby deleted in its entirety. Section 2. Section 25-8.1a of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance, is added to read as follows: 25-8.1 Use. a. No building or land shall be used or occupied for, or no building shall be erected, constructed, established, altered, enlarged, moved into, or within a Zone C-2 which is to be used or occupied for any other purposes than as follows: 1. Any use permitted in P-1 Automobile Parking Zone, and when so used subJect to all the provisions contained in the section defining said zone. 2. Retail stores or businesses not involving any kind of manufacture, processing, or treatment of products other than that which is clearly incidental to the retail business conducted on the premises and provided that not mere than five (5) persons are employed in the manufacture, processing or treatment of products, and that such operations or products are not objec- tionable due to noise, odor, dust, smoke, vibration or other similar causes. 3. Advertising sign boards or structures. 4. Antique store. S. Arcade (provided that the requirements of Section 25=8a are met)., 6. Automobile service station (provided the requirements,- of Section 25-16.16 are met) 7. Automotive parts store in which business is conducted entirely within a building and parts are not installed on the premises. 8. Automotive repair business, except body and fender works and painting (provided that the requirements of Section 25-16.15 are met). 9. Bakery, retail 10. Bank 11. Barber shop or beauty parlor. 12. Baths, turkish, and the like. 83004 13. Billiard or pool hall. 14. Blueprinting and photostating. 15. Bird store or pet shop. 16. Book or stationery store. 17. Car- Wash (provided the requirements of Section 25-16.15 are met). 18. Child care center, day nursery or pre-school 19. Christmas tree sales at retail, on a lot or parcel of land subject to Chapter 17, Sections 17-68 through 17-75 of the Lynwood City Code. 20. Church, temporary, revival. 20a. Electric appliance stores and repairs. 29. Electric distributing substation (when enclosed with a solid masonry wall). 30. Fireevorks sales at retail subject to Chapter 12, Sections 12-11 through 12-18 of the Lynwood City Code. 31. Florist shop. 32. Funeral parlor. 33. Furniture store. 34. Furniture warehouses for storing personal househ old goods, provided ground floor front is devoted to stores. 35. Grocery or fruit store. 36. Hardware store. 37. Interior decorating store. 38. 3ewelry store. 39. Ice storage house of not more than five (5) ton capacity. 40. Laundry or clothes cleaning agency. 41. Meat market or delicatessen store. 42. f4edical laboratory. 83004 43. Motels. 44. Music or vocal instruction 45. Music store. 46. News stand 47. Nursery, flower or plants 48. Offices, business or professional. 49. Radio store. 50. Restaurant, tearoom, cafe, cocktail bar (provided that the requirements of subsection 25-8.8 are met). 51. Shoe store or shoe repair shop. 52. Storage garage (including repairing and servicing). 53. Studios (except motion picture). 54. Tai.l.or, clothing or wearing apparel shop. 55. Taxidermist. 56. Telephone exchange. 57. Trade school (not obJectionable due to noise, odor, vibration, etc.). 58. Tinsmith (not sheet metal; see subsection 25-10.if.2.). 59. Used car sales area, provided (a) that no repair or reconditioning or automobiles shall be permitted, ex- cept when enclosed in a building; and (b) that such area is located and developed as required in section 25-14.4. 60. Wedding chapel. 61. Accessory buildings and uses customarily incident to any of the above uses when located on the same lot. Section 3. Section 25-16.15a of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance, is hereby deleted in its entirety. Section 4. Section 25-16.15a of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance is hereby added to read as follows: A. Purpose The City Council hereby finds that the erection, construc- tion or maintenance of automotive uses, unless subject to review and control provided in this section, can adversely affect the development of the surrounding areas for resi- dential, business, industrial or other purposes. It is also the purpose of this section to prevent those and other harmful effects and to promote the public con- venience and welfare, conserve the value of property, and encourage the most appropriate use of land within the City of Lynwood by requiring review and/or control as set forth herein. Section 5. Section 25-16.15b of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance, is hereby deleted in its entirety. 83004 Section 6. Section 25-16.15b of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance, is hereby added to read as follows: b. Definitions. 1. Automotive use shall mean sales, repairs, . servicing, reconditioning, painting, upholstering, body work, washing, and shall apply to new and used vehicles. 2. Vehicle shall mean automobiles, trucks, tractors, wheeled heavy equipment, motorcycles, motor- bicycles, mopeds, recreational vehicles, and off-road vehicles. 3. Automotive repair dealer shall mean a person, who, for compensation, engages in the business of repairing or diagnosing malfunctions of motor vehicles. 4. Repair of motor vehicles shall mean all mainte- nance of and repairs of motor vehicles performed by an automotive repair dealer but excluding repairing tires, changing tires, lubricating vehicles, installing light bulbs, batteries, windshield wiper blades, and other minor acces- sories, cleaning, adjusting, and replacing sparking plugs, replacing fan belts, oil, and air filters, and other minor services. Section 7. Section 25-11.2a4 of Chapter 25 of the Lynwood Municipal Code, the Zoning Ordinance, is hereby amended to read as follows: 4. Automobile assembly, body and fender works, painting, dismantling and used parts storage, when operated or maintained wholly within a building. Section 8. Section 25-16.15f of the Lynwood Municipal Code, the Zoning Ordinance, is hereby deleted in its entirety. Section 9. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its appli- cation to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section thereof, irrespective of the fact that any one or more section, subsection, sentence, clause, phrase, or portion, or the application thereof to any person or place, be declared invalid or unconstitutional. Section 10. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood.
