HomeMy Public PortalAbout20140127 - Conservation Commission - Meeting Minutes Conservation Commission Meeting 27 January 2014 Page 1 of 3 27 January 2014 Called to Order: 7:30 PM Town Hall, Room 216 Adjourned: 9:10 PM Present: Jeffrey Barnes, Andre Griben, Craig Nation, Melissa Recos, Marcus Waldron, Don MacAdam: Conservation Administrator, Bob Ingram: Conservation Scientist, Anna Rogers: Inspections Administrative Assistant Absent: Frank D’Urso, Kerry Reed 7:30 PM Commission Business • The Commission reviewed the following documents which they previously signed a signature page for: - Chamberlain Street Realty, 20 Chamberlain St – Order of Conditions (188-1536) • Mr. Nation made a motion to approve the Minutes of 04 November 2013. The motion was seconded by Mr. Griben and it passed unanimously. • The Commission reviewed the request for comments from the Planning Board regarding the Major Site Plan Review Application by MNR Realty, LLC and MNR Realty Trust, LLC for 42 Main Street. Mr. Griben made a motion to have the Conservation Scientist review the application and comment on the Commission’s behalf. The motion was seconded by Mr. Nation and it passed unanimously. • Mr. MacAdam provided an overview of the violation to the Order of Conditions by PRC Builders, 44 South Mill Street (188-1526). He noted the well had been installed and overtopped the erosion control barrier (ECB) prior to the required inspection of the ECB. He stated the wetlands have been restored and the ECB is back in place. • Mr. MacAdam provided an overview of the site maintenance work at 0 Twin Island Road. He noted the property owner informed him that they brought in some gravel to meet the Town’s new pavement height along the roadway. He noted they also were receptive to removing the grass clippings which were dumped by others within the buffer zone. • Mr. MacAdam provided an update regarding the violation at 0 Twin Island Road. He stated that Mr. Glassman, a neighbor, informed him that he has parked his boat in the area for many years and didn’t realize the installation of driveway/parking pad would require a filing with the Commission. The Commission determined they could review the project under an after-the-fact Request for Determination of Applicability. Conservation Commission Meeting 27 January 2014 Page 2 of 3 7:45 PM Lenity Architecture & Legacy Farms, LLC DEP File No. 188-1534 0 East Main Street Notice of Intent – continuation Dave Pickart, VHB Mr. Pickart provided an overview of the revised site plans dated 12 December 2013 with a latest issue date of 24 January 2014. He stated they are proposing to bring water, sewer and gas utility lines in from the rear of the property as accessed from Clinton Street. He stated there is an existing 18” pipe that is proposed to be replaced by Pulte Homes. Ms. Recos arrived at this time. Mr. Pickart stated the site will consist of the main residential building along with 3 detached garage buildings. He stated they are proposing to install 50 trees as screening towards Clinton Street. Mr. MacAdam requested the applicant account for the amount of existing disturbance area within the calculated total proposed buffer zone disturbance area. The BETA engineering peer review memo dated 24 January 2014 was reviewed and suggested special conditions were discussed. Mr. Waldron made a motion to close the hearing and approve issuing an Order of Conditions subject to the submittal of the requested information and the standard and noted special conditions. The motion was seconded by Mr. Nation and it passed unanimously. 8:10 PM Mazza, 32 Wilson Street DEP File No. 188-1535 Notice of Intent – continuation Joseph P. Marquedant, JD Marquedant & Associates Mr. Marquedant provided an overview of the revised site plans dated 15 October 2013 with a final revision date of 13 January 2014. He stated the plans have been revised to move the pool, deck and pool fence outside the 125’ vernal pool buffer zone. Mr. Barnes inquired about the proposed restoration for the unpermitted site clearing which was performed beyond the permanent immovable barrier. Mr. Marquedant stated the owners are proposing the planting of 60 shrubs and 15 trees to replace what was disturbed. The Commission noted that any pool water shall be discharged outside the buffer zones. Mr. Waldron made a motion to close the hearing and approve an Order of Conditions subject to the standard and noted special conditions. The motion was seconded by Mr. Nation and it passed unanimously. 8:15 PM Lussier, 0 Valentine Circle DEP File No. 188-1530 Notice of Intent – continuation Scott Goddard, Goddard Consulting, LLC Mr. Goddard provided an overview of the cumulative review of the proposed buffer zone disturbance and the existing buffer zone disturbance from the previous 3-lot subdivision filing (DEP File No. 188-485) as identified on the plan dated 14 January 2014. He stated the applicant will have to file an application with MESA. He stated NHESP feels the conservation restriction will be sufficient to allow NHESP to issue a CMP. Mr. Ingram asked if the applicant had reviewed reorienting the house in order to reduce buffer zone impacts under an alternatives analysis. A discussion was held regarding the slope adjacent to the driveway within the 50’ buffer zone and installing native plantings on the slope. Conservation Commission Meeting 27 January 2014 Page 3 of 3 Mr. Nation made a motion to close the hearing and approve an Order of Conditions subject to the submittal of revised plans showing the re-vegetation area adjacent to the driveway, a copy of the CMP and subject to the standard and noted special conditions. The motion was seconded by Mr. Waldron and it passed unanimously. 8:35 PM Landano Bros. Trust, 0 Cedar Street (Extension) RDA 2013-10 Request for Determination of Applicability – continuation The application was withdrawn. 8:35 PM South Mill Street, LLC, 20 Hunters Ridge Way (Lot 1) DEP File No. 188-1537 Notice of Intent Scott Goddard, Goddard Consulting, LLC; Christopher Nation, South Mill Street, LLC Mr. Craig Nation recused himself at this time. Mr. Goddard provided an overview of the Notice of Intent application and site plans dated 31 December 2014. He noted they are proposing lawn to the 50’ buffer zone with a continuous stone wall to demarcate the permanent immovable barrier (PIB). Mr. Barnes stated he would like to see medallions along with the stone wall or fencing. Mr. Griben made a motion to close the hearing and issue an Order of Conditions subject to the standard and noted special conditions. Mr. Waldron seconded the motion and it was passed by everyone except Mr. Barnes who opposed. Mr. Barnes made a motion to reconsider the previous vote. Mr. Waldron seconded the motion and it passed unanimously. The Commission held a brief discussion regarding whether a quorum constituted a majority of the Commission or a majority of the members actually voting. Mr. Griben made a motion to close the hearing and issue an Order of Conditions subject to the standard and noted special conditions. Mr. Waldron seconded the motion and it was passed by everyone except Mr. Barnes who opposed. Minutes Approved: 23 June 2014
