HomeMy Public PortalAboutOrd. 1161O ORDINANCE NO. 1161 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDINANCE NO. 570, THE ZONING ORDINANCE, WITH RESPECT TO AUTOMOTIVE USES IN COMMERCIAL AND MANUFACTURING ZONES The City Council of the City of Lynwood DOES HEREBY ORDAIN as follows: Section ~'. Section 25-16.15 C 10 is amended by adding a sentence to read as follows: This requirement does not apply to businesses engaged in only the sale of auto parts or supplies. Section 2. Section 25-16.15 E is amended by adding a third paragraph to read as follows: A valid registration with the Bureau of Automotive Repair is required for any business that performs, for compensation, repairs to, maintenance of, or diagnosis of malfunction of any of the following automotive or motorcycle components: o Air Conditioner o Transmission o Body & Frame o Steering Gear o Brakes o Exhaust System o Clutch o Fuel System o Drive Train Assembly o Heater System o Electrical System o Glass Components o Engine o Other Automotive or o Suspension Motorcycle Components Auto repair businesses not required to register include: o A business that services only vehicles other than passenger vehicles. o A fleet owner repairing only fleet vehicles. o A business that performs only minor maintenance services to motor vehicles. Minor maintenance includes: o Batteries o Oil & Air Filters o Fan Belts o Tires (Repair & Change) o Light Bulbs o Windshield Wiper Blades o Lubrication o Other Minor Accessories Section 3, That Chapter 25-16 B of the Zoning Ordinance be amended to add the following definitions: "3. Automotive repair dealer shall mean a person who, for compensation, engages in the business of repairing or diagnosing malfunctions of motor vehicles." "4. Repair of motor vehicles shall mean all maintenance of and repairs of motor vehicles performed by an automotive repair dealer but excluding repairing tires, changing tires, lubricating vehicles, in- stalling light bulbs, batteries, windshield wiper blades, and other minor accessories, cleaning, adjusting, and replacing spark plugs, replacing fan belts, oil, and air filters, and other minor services." p Section 4. Section 25-16 C 5 be amended to read as follows: "5. Five percent (5%) of the total area of a site shall be improved with well maintained land- scaping as approved by the Director of Community Development." Section 5. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. Section 6. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 20th day of z,n,-;i 1982, and finally ordered published at a regular meeting of said Council held on the 4th day of r~tav 1982.
