HomeMy Public PortalAboutOrd. 1138ORDINANCE NO. 113A AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SECTION 19-69 OF THE CODE OF THE CITY OF LYNWOOD RELATING TO DRIVING ON SIDE- WALKS WHEREAS, the adoption of Ordinance No. 700 of the City Council of the City of Lynwood previously restricted the driving on any sidewalks except at a permanent or temporary driveway; and WHEREAS, upon the adoption of the Code of the City of Lynwood, the words "sidewalk" were deleted from Section 19-60; and WHEREAS, conditions exist within the City wherein individuals are driving across sidewalks at other than approved driveways causing damage to the sidewalks thereby creating serious hazard and injury to pedestrians. THEREFORE, the City Council of the City of Lynwood does hereby ordain as follows: SECTION 1: Section 19-16 of the Code of the City of Lynwood is hereby amended to read as follows: "A driver of a vehicle shall not drive upon any sidewalk or within any parkway except at a permanent or temporary driveway." SECTION 2: This ordinance shall take effect immediately in accordance with the provisions of Government Code Section 36937 for the immediate preservation of public peace, health or safety. The City Council hereby declares that a safety hazard exists which has been created by individuals driving upon public sidewalks while entering property at other than approved, permanent or temporary driveways. That this condition has resulted in the destruction of portions of the City's sidewalks which represents danger to pedestrians utilizing such sidewalks and that unless this condition is remedied, it will continue increasing risks to the safety of citizens of the City of Lynwood. SECTION 3: Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivision, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 4: The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published and circulated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 6th day of October 1981, and finally ordered published at a regular meeting of said Council held on the 20th day of October 1981.
