1. Roll Call.
Bill Briesch, Acting Chairman, called the regular meeting to order at 7:00 p.m.. Present at roll
call were Planning and Zoning Commission members Gloria Gierke, Maggie Iverson and Wendy
Syverud. Member Kevin Adams was absent. Also present were City Administrator Tim Long,
City Engineer Chris Cooper, City Zoning Inspector Lou Wren, Council member Doug Littrel,
Civil Engineer Bryce Johnson, J & M Civil Design (for Woods Estates) and various members of
the community (see sign-in sheet, attached).
Chairman Briesch led the attendees in reciting the Pledge of Allegiance to our Nation.
2. Review and Approval of the Agenda.
Motion by Syverud, second by Iverson to approve the Agenda as presented. Voice vote, all ayes.
Motion carried.
3. Public Hearing, Final Plat and Plans, Woods Estates Subdivision.
Briesch opened the public hearing at 7:05 p.m. and invited members of the public to comment or
ask questions about the proposed final plat and plans. Upon request from audience member Jim
Beran, Long retrieved and provided copies of the final plat to audience members.
Responding to constituent Steve Townsend, Woods’ engineer Bryce Johnson stated that she
anticipated that the major grading of the phase would be complete this fall. Johnson, responding
to Commission member Syverud, stated that the developer hoped to put down some of the
paving yet this construction season. Long, clarifying Syverud’s question in part, stated that
irregardless of paving being put down or not; that the lots drawn by this plat would not be legally
created until the plat had been signed by the Mayor and recorded with the County; that the
Mayor would not sign the plat until all the public improvements had been completed, inspected,
recommended by the City Engineer, and accepted by the City Council. Long discussed the
alternative path to recording the plat prior to completion of the improvements, which involved
the posting of a bond or other financial guarantee that the improvements would be completed;
and, that in any case, the City would issue no building permits until all the public improvements
were complete and homes were accessible via the new streets. Upon request by constituent
Linda Hupp, Long reiterated the Subdivision Ordinance requirements for recording the final plat.
Johnson, responding to Commission member Gierke, confirmed her understanding of the same
matter. Responding to constituent Beran, Johnson stated that the streets were all designed to be
built at a width of 31’. Responding to Commissioner Gierke, City Engineer Chris Cooper stated
that the outflow from detention pond “A” would be at a controlled rate, discharging to a tributary
flowing past her property to Duck Creek. Johnson, responding to Commission member Iverson,
corrected Long, stating that detention pond “C” would be permanent, and is in operation as
currently designed for sediment control for runoff from the new street. Responding to
constituent Teri Stickler, Johnson stated that any future development on the unplanned vacant

ground adjacent to US Route 67 / State Street would be required to address its own stormwater
management, dependant upon the type of development proposed, which Long confirmed. City
Engineer Cooper, responding to Chairman Briesch, stated that in addition, the Iowa Department
of Transportation would need to approve of any stormwater plan, since the area drained to the
swale on state right-of-way. Responding to Chairman Briesch, Johnson stated that in the process
of connecting the sanitary sewer to the sewer main along US Route 67, the bike trail would be
excavated for an interim period of time, ultimately being replaced by the developer after
construction was complete. Commission member Iverson requested that Long assure that
warning signs be placed for bicyclists for the duration of the period of construction (amended
Nov 8, 2018); Johnson stated that the developer’s contractor was responsible for that task.
Cooper, responding to constituent Beran, stated that stormwater would cross the bike path before
flowing in a westerly direction, ultimately to Duck Creek. Beran shared that he thought there
was some existing stormwater pipe running to Duck Creek.
Briesch, following a lull in discussion, asked if there were further questions, comments or
concerns. Hearing none, he called for a close to the hearing.
Motion by Iverson, second by Gierke to close the hearing at 7:37 p.m. Voice vote, all ayes.
Motion carried.
4. Consideration of Woods Estates Subdivision meeting zoning and subdivision
regulations.
Cooper, responding to Commission member Wendy Syverud, confirmed that the required soil
erosion plan has been provided; Woods’ engineer Bryce Johnson confirmed that the NPDES plan
has also been filed. Syverud noted that there had been a great number of trees removed as part of
the grading, and likely exceeded the 15% threshold in the Subdivision Ordinance requiring a
plan to protect and restore tree cover. Syverud further inquired what measures were being taken
to preserve large-caliper trees: Johnson stated that she was aware that Woods had plans for
replacement of trees, but did not have the plan, and there was no answer to the question on
preservation of large caliper trees (amended Nov 8, 2018). Long stated that he would request
Woods tree plan from him directly. Syverud also noted that the Subdivision Ordinance called for
the Developer to provide bonding to cover the cost of the City’s engineering review costs and to
insure the construction of the public improvements for the subdivision. Long stated that Woods
had not posted those bonds. Chairman Briesch, hearing no further discussion from the
Commission, advised that the Commission could approve, reject, or pass approval with
contingencies for Woods to provide the required bonds in order for the Council to approve.
Motion by Gierke to approve the plat and plans as presented, with contingencies for Woods to
provide bonds to cover the cost of the City’s review and provision of the required public
improvements. Hearing no second of Gierke’s motion, Briesch considered the motion to have
died for lack of second.

Motion by Iverson, second by Briesch that the Commission finds that the plat and plans for Woods
Estates Subdivision, Phase 1 conform to the City’s Subdivision and Code requirements, but opt to table
final consideration pending receipt of the final bond or financial instruments sufficient to meet the
requirements of Sections 40 and 64 of the Subdivision Ordinance, with the matter to be revisited at a
meeting of the Planning & Zoning to be scheduled for November 8, 2018, at 7:00 p.m. at City Hall.
Voice vote, all ayes. Motion carried.
5. Adjournment.
Hearing no further discussion, the meeting was adjourned by Briesch at 8:18 p.m.
