HomeMy Public PortalAboutOrd. 1145 ,, ORDINANCE N0. 1145 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING THE ZONING ORDINANCE, ORDINANCE N0. 570, TO PROVIDE FOR EFFICIENCY DWELLING UNITS AND TO CHANGE THE REQUIRED MINIMUM DWELLING UNIT SIZES AND OFF-STREET PARKING REQUIRE- MENTS. The City Council of the City of Lynwood HEREBY DOES ORDAIN as follows: SECTION 1. The definitions of "Apartment" and "dwelling unit" as found within Section 2.00 of the Zoning ordinance are amended to read as follows: Apartment is a dwelling unit within a multiple dwelling which includes a single kitchen, and is occupied or suitable for occupancy as a residence for one family. Dwelling unit is one or more rooms in a dwelling or apart- ment hotel designed for occupancy by one family for living and sleeping purposes and having only one (1) kitchen. SECTION 2. Section 2.00 of the Zoning Ordinance is further amended to include definitions for "efficiency dwelling unit" and "habitable room", as follows: Efficiency Dwelling Unit is a dwelling unit containing only one (1) habitable room. Habitable Room is a space in a building for living, sleeping, eating, and/or cooking. Bathrooms, toilets compartments, closets, halls, storage or utility rooms, and similar areas, are not considered habitable rooms. SECTION 3. Section 4.04 (A) (11) and 4.04 (A) (12) of the Zoning Ordinance are amended to read as follows: 4.04 (A) (11) Minimum floor area in square feet No dwelling unit shall have less total floor area than is specified in this section. The total floor area shall be determined by the outside dimensions of the structure, ex- cluding porches, garages, and similar areas. Minimum area in square feet R-1 R=2 R_3 1,000 One bedroom 800 Efficiency 500 Two bedrooms 900 One bedroom 600 Three bedrooms 1000 Two bedrooms 750 Three bedrooms 900 For the purpose of this Section and Section 4.04 (A) (12), any habitable room other than a primary living room, dining room, or kitchen shall be classified as a bedroom. Section 4.04 (A) (12): Required parking spaces per unit with- in a garage or within a carport in the R-3 zone R_1 R_2 RR=3 Z 2 Efficiency dwelling - 1 One bedroom units -li Units with two or more bedrooms - 2 ' u D ~.t s Developments of three or more dwelling units in the R-3 zone shall include one-half (~) spaces per unit for guests and/or recreational vehicle parking. -These spaces shall be access- ible to visitors without the use of a key. An intercom system with remote control from individual apartments must be provided for security parking lots. SECTION 4. Severability. If any section, subsection, sub- division, sentence, clause, phrase or portion of this ordinance, or the application thereof to any persons or place, is for any reason held to be invalid or unconstitutional by the decision of any court of com- petent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any per- son or place, be declared invalid or unconstitutional. SECTION 5. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circula- tion, printed, published, and circulated in the City of Lynwood.
