If there is ever a reason that the City needs to utilize the ROW for any reason,the shrubbery would be removed at the owner's expense,which you said would not be a problem. "SPUD" WOODWARD COMMISSIONER DIRECTOR May 3, 2010 Michael Foran litto Bar Pilots, Inc. - 146 Grays Creek Drive Savannah, Georgia 31410 RE: Letter of Acknowledgement, Michael Foran, SPA Permit#360 Landscape Plan, #1 Van Horne Street, Oceanview Subdivision,Fort Screven Ward, Tybee Island, Chatham, Georgia Dear Mr. Foran: This Letter of Acknowledgement (LOA) is in response to your recent submittal of landscape plans for#1 van Horne Street. SPA#360 authorized the construction and maintenance of deck and screened porch and landscaping in the Shore Protection Act Jurisdiction Area. The permit was conditioned by both Standard Conditions and the following Special Conditions: 1. No additional heated or cooled space is authorized. 2. Access to the beach will be via an existing private dune crosswalk and path. No extension seaward of the existing crosswalk is permitted. 3. All new driveways and parking areas must be constructed of pervious materials. 4. The applicant must restore the dunes on the southeast portion of the lot, and the area covered by the portion of the deck to be removed, with natural dune features and native vegetation. The dune area on the eastern side of the house will remain in its naturally vegetated and topographical condition except for hand pruning for views from the house to the ocean. The landscape plans, including pruning, must be approved by the Department prior to commencement of landscaping activities. 5. No new construction is permitted in the dune areas. Stairs to the southern porch must be located landward of the toe of the most landward dune. Staff must review and approve plans prior to construction. 6. Existing stairs associated with the bulkhead and the existing stairs accessing the eastern deck from the south side of the deck must be removed. 7. No mowing is permitted in the dune areas. 8. Should the dunes shift landwards, which is considered a natural function of the sand sharing system, every effort must be made to protect the dynamic dune area. Only the existing retaining wall may be reinforced. No new retaining walls or other structures may be placed or built within the dynamic dune field. 9. No less than 34% of the state's jurisdictional area will be retained in its naturally vegetated and topographic condition. To protect marine turtle hatchlings, placement and use of exterior lighting must be consistent with the Department of Natural Resources' Wildlife Resources Divisions sea turtle nesting guidelines as well as the lighting ordinance of the City of Tybee. 12. Landscaped trees will not change the Shore Protection Area jurisdiction and must be noted as landscaped on the post construction survey. 13. Permittee must provide a post-construction survey to the Department of Natural Resources within 30 days of project completion. The survey must be performed by a surveyor registered in the State of Georgia and must comply with appropriate professional industry standards. The landward toe of the dune runs along the original bulkhead. A portion of the lot(34%) seaward of the bulkhead has been designated as dunes and is to be restored with natural dune features and native vegetation as per Special Conditions #4 and#9. Staff has reviewed your proposed landscape plans. The landscape plan includes both native and non-native plants. Plants proposed in the dune area include: Juniperous virginiana, (Easterm Red Cedar); Gaillardia pulchella (Blanket Flower); Gelsernium sempervirens (Carolina Jasmine);Muhlenbergia campillaris, (Pink Muhly Grass); Sabal palmetto, (Sabal Palm); Spartina patens, (Salt Meadow Cord Grass); Prunis maritime, (Beach Plum); Uniola Paniculata, (Sea Oats) and Myrica cerifera, (Wax Myrtle). These plants are considered native dune vegetation and are permitted. Also included in the plan is Quercus germinate, (Live Oak). Live Oak is not considered native dune vegetation but a maritime forest species and may not be planted in the dune area. As an alternative, additional red cedar or wax myrtle may be substituted for the Live Oaks in the dune area. Other non-native plants included in the plan are:Lagerstroemia indica (Crepe Myrtle);Nerium oleander(Oleander);Hemericollis hybrida (Daylily) and Agopanthus orientalis (Agopanthus). These plants are proposed outside of the dune area and the 34% of the lot that is to be retained in its natural vegetated and topographic state. Seeds for these non-native plants can migrate into the natural areas and have detrimental effects by out competing natural species. Staff does not recommend these plants in this fragile coastal environment but your permit does not prohibit their use. Staff would be happy to meet with you and discuss alternative native plants in these areas with similar characteristics as the ones you've chosen, such as Georgia's native lilies; Turks-Cap Lily, Southern Red Lily and Carolina Lily. The proposed landscape plan also includes placing lattice along the 12' x 60' porch and around the deck and requests a temporary access point for the placement of landscaping. Special condition#5 does not allow for any additional structures in the dune area. The 12' x 60' porch is landward of the bulkhead and landward of the dune line. Therefore, lattice may only be installed along the 12' x 60' eastern porch. Since Special condition#5 does not allow for additional construction in the dunes, temporary pedestrian access to the dune area is allowed for the placement of landscaping, no motorized SPA#360 Foran Landscape LC'' May 3,2010 Page 3 of 3 vehicles are allowed. Access is available from the north side of the house via the driveway and side dunes. Dunes to the south and east of the residence can be accessed along Van Horne Street. During construction and installation of landscaping, no materials or equipment can be stored in the dune area; silt fence must be placed to clearly delineate the dune area where no impacts are permitted. No vegetation is to be disturbed beyond the limits of the project during construction. Any incidental impacts to the dunes or vegetation must be restored to pre-project vegetated and topographic conditions. All construction must comply with Department of Natural Resources Sea Turtle Guidelines and the Tybee Island Beach Management Plan. In addition, a portion of the landscape plan is located on City of Tybee property. Proper authorization from the City of Tybee may be required for this portion of the plan. Please contact the City of Tybee prior to installation in order to obtain any authorization that maybe required. This Letter of Acknowledgement is not meant to exempt the above referenced activity from future environmental laws.
