Mayor Briggs called the regular meeting of the City Council to 2. order at 7:35 P. M. Pastor A. Russell Hagen, of the Seventh -day IIAdventist Church, 9664 E. Broadway, gave the Invocation, following 3. which Mayor Briggs led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen- Harker, Merritt, Tyrell, Briggs ABSENT: Councilman- Beckley ALSO PRESENT: City Manager Koski, City Attorney Martin, Recreation Director Kobett, Planning Director Dragicevich, Public Works Director Pizzorno Councilman Merritt moved to excuse the absence of Councilman Beckley due to illness, Councilman Harker seconded, and the motion carried unanimously. 5. APPROVAL OF MINUTES: Regular meeting of November 19, 1968 The Deputy City Clerk corrected the minutes on page 6, item 9, the date of opening bids shown as Jan. 15, 1969, should be Jan. 14, 1969. Councilman Merritt corrected the next to the last line of paragraph 1 on page 2 to read immediately to the south instead of the west. Councilman Merritt moved to approve the minutes of November 19, 1968, as corrected, Councilman Tyrell seconded, and the motion was unanimously carried. II PUBLIC HEARING, CONTINUED: 7:30 P. M. - APPEAL FROM PLANNING COMMISSION DECISION, VARIANCE CASE #68 -265, Marie & Harry De Vasher, 6327 N. Primrose Mayor Briggs stated as Councilman Beckley is not in attendance and the previous vote of the four Councilmen present was a 2 to 2 vote, he recommended this be held over until the Dec. 17th regular meet- ing of the City Council. Councilman Merritt so moved, Councilman Tyrell seconded, and stated he felt a determination should be made at that time without any further delay, and the motion was carried unanimously. ARCHITECTS IN ACTION: REPORT OF RECOMMENDATIONS FOR DEVELOPMENT OF ROSEMEAD BLVD. WITHIN TEMPLE CITY: DAVID OAKLEY, CHAIRMAN Mr. Oakley introduced the following who are members of this Committee: William Rowles, Los Angeles; Norman Nichols, Glendora; Glenn E. Cook, Monrovia; Ken J. Bailey, Temple City; Allan M. Chipp, El Monte.; and Jean Driskel, Pasadena. He advised they had offered their services to Temple City to study the Rosemead area for future development, and had spent approximately 300 hrs. in this City which was given to the community. Mr. Oakley presented a detailed diagram of the proposals arrived at by the Committee recommending commercial and high rise areas as well as landscaping and more park areas. Councilman Tyrell moved to receive the report and to refer it to the Planning Commission to consider in conjunction with the General Plan, Councilman Merritt seconded, and the motion carried unanimous - 1 y. Councilman Tyrell moved to commend the Architects in Action, and to express the appreciation of the City to the group, Councilman Harker seconded, and the motion carried unanimously. WEST SIDE OF SULTANA: PENTLAND TO ACASO Mayor Briggs declared the Public Hearing opened. James Giebelhaus, 5017 Sultana, stated they were pleased to see the finished improvement and he wished to make a request relative to the assessment. Due to' the fact that property taxes were in- creased and are now due, and also to the holiday season, he re- quested additional time until Jan. 15, 1969, to pay the assessments before sending them in for recording. No one else came forward to speak. Councilman Tyrell moved to close the Public Nearing, Councilman Harker seconded, and the motion, carried unanimously. Councilman Tyrell moved to confirm the assessments and to direct that the properties be so assessed and to become a lien .against the property as of January 15, 1969, Councilman Harker seconded, and the motion carried unanimously. B. WEST SIDE OF SULTANA: SERENO DR. TO PENTLAND ST. Mayor Briggs declared the Public Hearing opened. No one came forward to speak. Councilman Tyrell moved to close the Public Hearing, Councilman Harker seconded, and the motion carried unanimously. Councilman Merritt moved to confirm the assessments and to direct that the properties be so assessed, and to become a lien against the property as of January 15, 1968, Councilman Harker seconded, and the motion carried unanimously. C. EAST SIDE OF SULTANA: SERENO TO ACASO Mayor Briggs declared the Public Hearing opened. Councilman Harker moved to confirm the assessments, and to direct that the properties be so assessed, and to become a lien against the property as of January 15, 1968, Councilman Tyrell seconded, and the motion carried unanimously. PUBLIC HEARING: 7:30 P. M. ENTERTAINMENT LICENSE: THE CREST, 5921 Temple City Blvd. - Mr. Shemberg Mayor Briggs declared the Public Hearing opened and asked for the report from the Sheriff's Dept. Deputy Gilmann advised investigation showed both inside and outside lighting was adequate, there were sufficient parking spaces, no incidents had been reported from Temple City Sheriff's Station, A.B.0 -E1 Monte Office, Vice Patrol, or license detail. The enter- tainment request is for a three piece band on Thursday, Friday, and Saturday nights from 9 P. M. to 1:45 A. M. They already have a dance license for juke box music. Waitresses will wear mini skirts and blouses and street clothing for band numbers. The License Detail recommends the entertainment license be granted subject to the following conditions: 1. Any person assuming managerial control in the absence of the licensee must first be identified to the Sheriff's License Detail, and subject to the approval of the City of Temple City. 2. That there shall be no dancing or entertainment between the hours of 2 A. M. and 6 A. M. 3. That licensee cooperate with all police and city officials. Mayor Briggs asked if anyone wished to speak for or against the license application. Mr. Joseph Shemberg, applicant, stated they wanted entertainment to improve business and that they run a nice bar. He also agreed to the above conditions. Following discussion Mr. Shemberg was asked if he would also agree to have the doors closed at all times, and if necessary to have a uniformed officer on the premises. These things were also agree- able to Mr. Shemberg. No one else came forward to speak. . Councilman Tyrell moved to close the Public Hearing, Councilman Harker seconded, and the motion carried unanimously. Councilman Tyrell moved to grant the license subject to the three conditions above outlined plus (4) that the doors be closed at all times, and (5) to reserve jurisdiction for requirement of a uniform- ed officer during entertainment, Councilman Harker seconded, and the motion was carried unanimously. Council Minutes, December 3, 1968, page 4 UNFINISHED BUSINESS: 6. RE FORMATION OF UNDERGROUND PUBLIC UTILITIES DISTRICT: - AREA LYING ON EITHER SIDE OF TEMPLE CITY BLVD. BETWEEN GARIBALDI & LEMON AVE. City Manager Koski advised that at the last Council meeting on November 19th a Public Hearing was held concerning the formation of an Underground Public Utility District in the above area. The Public Hearing was conducted and it was closed, and it now is before the City Council to determine whether the Underground Utility District should be established. Councilman Tyrell moved to re -open the Public Hearing for anyone who wished to be heard, Councilman Merritt seconded, and the motion carried unanimously. Robert Miller, 6154 N. Temple City Blvd., stated he was opposed to the District and presented a protest with 12 signatures. Christian Leder, 6161 Temple City Blvd., stated he was in favor of the underground and asked for information re connections to the meter. No one else came forward to speak. Councilman Harker moved to close the Public Hearing, Councilman Merritt seconded, and the motion carried unanimously. Considerable discussion followed regarding connections and pay- ments by the property owners. It was determined that the cost of an assessment district would be approximately 35% additional, and as no such small district had been formed it was very questionable if a bond issue of about $20,000. would be saleable. It also was brought out there were some sixty properties involved and only a small percentage were opposed. The City Manager also advised that in going to assessment it would not be on. the .tax ': bill until November, 1970, which would give considerable time before any payments were due. Also it was agreed that possibly the City could be the agent for those property owners who so desired to contract for the connection services. However those who so desired could contract individually or do the work them- selves. Councilman Harker on the basis of the over -all benefit moved to approve the formation of the District„ Councilman Tyrell se- conded and the motion carried unanimouslyeby the following roll call vote: AYES: Councilmen - Harker, Merritt, Tyrell, Briggs NOES: Councilmen -None ABSENT: Councilman- Beckley City Attorney Martin presented Resolution No. 68 -875 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISH- ING UNDERGROUND UTILITY DISTRICT NO. 1. Councilman Tyrell moved to adopt Resolution No. 68 -875, Councilman Harker seconded, and the motion was carried by the following roll call vote: AYES: Councilmen- Harker, Merritt, Tyrell, Briggs NOES: Councilmen -None ABSENT: Councilman- Beckley NEW BUSINESS: 7. PARKS & RECREATION COMMISSION RECOMMENDATIONS: MEETING OF NOV. 20, 1968 A. Recommends an ordinance be written covering all municipally owned parks and recreation facilities with a closing time of 10 P.M. and opening time of 6 A.M. to control disturbances Council Minutes, December 3, 1968, page 5 within these areas during these hours by persons conducting themselves in a manner detrimental to health, peace and safety of the general public and surrounding residential areas. Recreation Director Kobett presented the above recommendation. Following discussion Councilman Merritt moved to approve and to refer the matter to the City Attorney for preparation of an ordinance, Councilman Tyrell seconded, and the motion carried unanimously. B. Recommends. reward signs be drawn up to post in the parks with wording as recommended by the City Attorney. Recreation Director Kobett presented the above recommendation. Councilman Merritt moved to approve, Councilman Harker seconded, and the motion was unanimously carried. 8. PROPOSED PARCEL MAP CHECKING AGREEMENT: BETWEEN CITY AND LOS .ANGELES COUNTY ENGINEER'S DEPT. The City Manager advised that the County is now doing our sub- division map checking, and the new Subdivision Map Act requires an Agreement be executed for these services which is enlarged to cover two, three or four parcels also. In addition an ordinance must be adopted to provide for the payment and collec- tion of fees from the subdivider,for parcel map checking services performed by the County Engineer. Councilman Tyrell moved to approve the Agreement and authorize the Mayor and City Clerk to sign on behalf of the City, and to instruct the City Attorney to prepare the requested ordinance, Councilman Harker seconded, and the motion carried unanimously. 9. REQUEST BY CITY OF EL MONTE TO CONNECT INTO CITY SEWER ON FAIRVIEW AVE. City Manager Koski presented a request by the City of El Monte for a permit to use Temple City sewer facilities on Fairview from Persimmon to the east City limit,, and on Persimmon from Fairview to south City limit for a new :Mobile Home Park to be constructed at 4800 Daleview Ave., El Monte. Following considerable discussion Councilman Tyrell moved to grant subject to the following conditions: 1. to be granted for a period of two years and subject to renewal at the end of that time by action of the City Council; and 2. that the proposed development contain not more than 175 units of R -1 development; and 3. that the area contained within the proposed develop- ment must annex to the existing sewer maintenance district within 120 days; and 4. all connections and related work to new and modifica- tions to existing sewage systems, must be approved by the City Engineer, Councilman Harker seconded, and the motion was unanimously carried. Marshall Henderson, 919 Roxbury Rd., San Marino, stated he was the developer in this case and requested clarification regard- ing the motion. The City Attorney advised the request for the permit had been granted subject to the above conditions. 10. RESOLUTION NO. 68 -874: Warrants & Demands City Manager Koski presented Resolution No. 68 -874 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $56,279.54, DEMAND NOS. 11915 THROUGH 1 1 1 Council Minutes, December 3, 1968, page 6 11955. Councilman Harker moved to adopt Resolution No. 68 -874, Councilman Tyrell seconded, and the motion carried unanimously. 11. COMMUNICATIONS: a. Request from Seventh -day Adventist Church of Temple City for a charitable solicitation permit to solicit donations and to sing Christmas Carols evenings from Dec. 7 to Dec. 24. Councilman Harker moved to grant the request, Councilman Merritt seconded, and the motion carried unanimously. b. Request from Temple City Church of the Nazarene asking for permission to paint numbers on curbs Sat., Dec. 7, to support their Christmas banquet. This is a youth effort under super- vision of adults, they have insurance, and will paint them in accordance with directions from the Director of Public Works. Councilman Tyrell moved to grant, Councilman Merritt seconded, and the motion was unanimously carried. 12. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward at this time. 13. MATTERS FROM CITY OFFICIALS: Councilman Harker reported on his tour of the Glendora Tunnel which is a part of the total plan to provide water needs in the San Gabriel valley until 1990. After tunneling 62 mi. when they broke through the other side they were off target 4" and vertically 1/8 ". Some discussion followed. 14. ADJOURNMENT: Councilman Tyrell moved to adjourn to a study session, and from there to the regular meeting of December 17, 1968, at 7:30 P.
