Members present: Mayor, Thomas Anderson; Councilmembers, William Reiser, Thomas Crosby, Nancy Laurent, Sarah Lutz; Clerk- Treasurer, Donna•Roehl; planning and Zoning Administrator, Robert Derus; police Chief, Charles Hoover; Public Works Director, Ron Duran; Engineer, Lyle Swanson; Attorney, Ricbgrd schieffer 1. Minutesof August 7, 1979 Motion by Crosby, seconded by Laurent to accept minutes of August 7, 1979, as presented. Motion declared carried 2. COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM Mark Hendrickson, of Hennepin County, explained the newly drafted joint Powers agreement for 1980 funding. Discussion of limitations fo fund expenditures. Motion by Crosby, seconded by Lutz to adopt Resolution 79-45, authorizing the Mayor and Clerk to enter into the joint powers Agreement with Hennepin County for Community Development Block Grant funds. MoCrossan 40,640.00 26,757.50 32,118.50 99,516.00 Robert Ehlers explained the various ways in which the project could be funded: Temporary 3 year bonds which could be added to the next project the city might undertake. Temporary bonds from own funds charging interest; this would mean a loss of earnings on investments but fees that would be charged would be more than the interest if bonds were purchased. Matter was tabled until later in the meeting. 4. ROUILLARD - STEHLIK PUBLIC HEARING, 8:00 P.M. Robert Derus explained the application for rezoning of Lots 2, 3, 4 of Auditor's subdivision 241, from R-1 to C-1 Zoning. He stated that surrounding property owners had been notified and that the planning Commission had recommended approval of the rezoning. Mayor Anderson stated that he had been approached by the potential buyer of the Rouillard property to prepare a plan for conversion of the house to an office and that he would abstain from the discussion and voting. Rita Stehlik stated that she had no plans for her property at this time. Donna Reohl reported that Dorian Hughes and Dennis Dorweiler, nearby property owners, had no problem with the rezoning. Mike Rouillard stated that Father Ardolph of St. Anne's Church, had no objection to the re- zoning. Motion by Lutz, seconded by Crosby to close the public Hearing. Motion declared carried public Hearing closed at 8:10 P.M. Motion by Lutz, seconded by Laurent to rezone Lots 2, 3, and 4, Aud. Sub. 241 from R-1 to C-1. Motion carried Abstaining, Thomas Anderson 5. POLICE DEPARTMENT power Boat Race Mr. Glafke of the Twin City power Boat Association appeared to request permission to hold races on Lake Independence on September 30, 1979 from 12:30 to 5:00 P.M. He stated that they needed approval from the city as a requirement of Hennepin County Park and the Water Patrol. He explained that they were insured according to Water Patrol regulations, that the spectators would be in the beach area and that the boats would be staying 500 feet from any property. Motion by Reiser, seconded by Crosby to allow power boat races on Lake Independence on ` 4 1 September 30, 1979 from 12:30 until 5:00 p.M. Motion declared carried labor Negotiations Mayor Anderson stated that Karen Olson, negotiator for the city, had contacted him to set up a negotiating session. Thomas Crosby stated that he would not be able to attend a session during the week of August 22nd but he did not want to hold up the negotiations so they should be held without him. Discussion of where the meetings should be held and if officers could attend sessions while on duty. Motion by Crosby, seconded by Laurent to allow police officers to attendbargaining sessions while on duty as long as sessions were held in the city, with the provision that officers be expected to answer calls, such calls not to interrupt the negotiating sessions. Motion declared carried 6. PUBLIC WORKS DEPARTMENT Hackamore Rd., Chippewa Rd, Arrowhead Dr., Improvements Margaret pane explained tha in 1964 they had requested that the city improve Hackamore Rd., some work was done and when her property was subdivided a 66 ft. easement was provided. She now requested improvements to the road as it is difficult to maintain.and is closed during the winter months. Richard Cairns, a resident of Hackamore Rd;, asked that improvements be made as cars are getting stuck and are asking his family for assistance. As he travels a great deal of the time his family is left alone and he expressed concern as to their welfare. Rayburn Roy, property owner on Chippewa Rd., asked that road be made passable for farm pur- poses. Robert Derus reported that Arrowhead Dr. would need some work beyond the Eokes driveway as the city had applications for 2 building permits onto a private drive constructed at that point. Discussion of the cost of graveling all of the affected roads. Ron Duran stated that it would cost approximately $36,000 for 8 inches of gravel on 1 1/2 miles of road. Thomas Anderson stated that Capital Improvement funds are committed for the purchase of the road grader. Thomas Crosby suggested filling potholes on Hackamore and barricading in the winter. Mayor Anderson stated that ownership of the roads should be determined before work is done. Ron Duran suggested that councilmembero drive the described roads and determine, for them- selves, the severity of the problem. Richard Cairns agains asked that something be done, for safety reasons. Thomas Anderson asked that the matter be tabled pending determination of ownership of ease- ments and estimation of cost. Hamel well Tom Stevens of Stevens Well answered questions regarding the existing wells and the drilling of another well in Hamel. He explained that repair parts are available for the Hamel well but down time is a factor to consider. It was estimated that it would cost $60,000 for pumphouse and proper equipment to utilize the private Rolling Green well. Ron Duran explained that. Rolling Green needs their well in the summer for sprinkling. Mayor Anderson suggested tabling the matter until the budget meetings. 7. JIM CARPENTER, VARIANCE Robert Denis presented a request from Mr. Carpenter for a variance to construct a barn on Lot E of the Berthiazzme land division. Be presented signatures of the subdivision owners within 500 ft. of the property. Members decided that signatures of the 2 abutting farm owners would be needed also. Motion by Crosby, seconded by Laurent to grant a variance to Jim Carpenter to construct a barn on Lot 3 of the Eerthiaume division subject to receipt of approval from Sheldon Coplin and Art Jubert. Motion declared carried 242 8. WATER SUPPLY COMPANY Thomas Crosby stated that after reading the materials from the water company he was not convinced that the suggested selling price they had quoted, for the sale of the system, was equitable. Discussion of the value of the system and what affect the purchase would have on the sewer project planned for the Medina Morningside area. Lyle Swanson stated that it would cost about $200 to apprais the system. Mr. Haugen of Water Supply Co., stated that they would like to sell as they are not mak- ing any money. William Reiser and Thomas crosby stated that they would be willing to discuss the purchase of the system with Mr. Haugen. Motion by Crosby, seconded by Reiser to allow a 25% rate increase to $1.65.per 1000 gallons, for the next billing period, and if no agreement can be arranged for purchase. of the system a review of the rates will be discussed before the January billing. Motion declared carried 9. MIRE ROGERS, TAX FORFEIT LOTS Donna Reohl reported that the appraisal of the 2 lots had come back•as $3300.00, much higher than previous appraisals in the area, but in line with current land values used for assess- ment purposes. Mr. Rogers stated that he would agree to pay the $3300.00, plus aIministration charges and the one unit of sewer and water assessment at the time the deeds were delivered. Motion by Reiser, seconded by Lutz to adopt Resolution 79-46 acquiring land for public pur- poses and to authorize the Mayor and Clerk to enter into a purchase agreement with Michael and Susan Rogers. Motion declared carried 10. SAC CHARGE REFUNDS Donna Reohl reported that the refund checks were ready for mailing, that there were several duplicate applications being handled according to the provisions of the ordinance and there were 3 applications that had been received late. Council members felt that this was money refundable to the property owners andthat they should be paid. Motion by Reiser, seconded by Crosby to pay Robert Hayford and hail Enterprises the amounts due them even though applications were received after the August 6, 1979 deadline. Motion declared carried Councilmembers agreed to withhold Truxton Morrison's check as the Morrison'a owe the. city $695.00 for land division expenses. 11. TOWER•DR., PINTO DR., HAMEL RD. Discussion of ways in which property could be assessed and whether assessments should be levied this fall. Coneenaus of the council was to assess 1/8 of the cost of improving Hamel Rd. and pinto Dr. against the residential•property and defer the assessment until such time as property is sold for industrial purposes. Richard Schieffer explained the resolutions that needed to be adopted to proceed with the project. Motion by crosby, seconded by Laurent to adopt Resolution 79-47 consolidating Tower Dr., pinto Dr., Hamel Rd. project with the Jim Burdick project on Tower Dr. west of Pinto Dr., upon receipt, from Mr. Burdick -of an easement for the street. - Motion carried unanimously Motion by Laurent, seconded by Reiser to adopt Resolution 79-48 accepting bids and awarding bid to C.S. Mocrossan for $99,516.00 and authroize the Mayor and Clerk to enter into contracts with McCrossans. Motion declared carried Motionby crosby, seconded by Lutz to adopt Resolution 79-50, declaring cost of the project to be $120,000 and to order preparation of the assessment roll. Motion declared carried 12. P1BLIC WORKS DEPARTMENT `i Hunter Farms Roads Lyle Swanson presented 2 quotes for work on Hunter Farms roads; Bury and Carlson, $9.00 per sq. yd.for patching and $18.45 per ton for material below patching blacktop; and Hardrives, $17.50 and $25.75 for identical materials. He explained that the $4000.00 being held in escrow is enoubh to do one-fourth to one-half of the work needed. Discussion of the means by which additional work be paid for such as assessing the property owners. Mr. Swanson stated that if the road department could do the base work and a contractor com- plete the blacktop patching it would not cost as much money. Motion by Lutz, seconded by Laurent to use up to $1000.00 of city funds to do the base work necessary in Hunter Farms. Motion declared carried Northern States Power Motion by Laurent, seconded by Crosby to adopt Resolution 79-49, allowing Northern States Power Co. to bury cable to serve 4651 Walnut St. Independence Beach and to ask that they repair the banks from work they completed on Fern St. Motion declared carried 13. MARK ORTH VARIANCE Robert Derus reported that the addition to Mr. Orth's house on I,ot 1, Block 15, Pearson, resident of Lot 2. Motion by Crosby, seconded by Laurent to approve a 16 ft. Orth to construct a porch addition to his house on Lot 1, Motion declared carried is not a greenhouse but a 3 season porch being added Independence Beach. He,presented approval of Mrs. front yard variance to allow Mark Block 15, Independence Beach. 14. MARK PETERSON CABOOSE Richard Schieffer explained that Mr. Rice, attorney for Mr. Peterson had stated that they wish to be in a defensive posistion in reference to the removal of the caboose from the Pet- erson property. Thomas Anderson asked what the procedure would be for removal of the caboose. Mr. Schaeffer explained that the city could go to district court and secure an injunction of removal. Robert Derus presented plans submitted by Mark Peterson for the construction of a building similar in structure to a caboose, only larger. Motion by Reiser, seconded by Crosby to authorize the city attorney to take appropriate act- ion to have the caboose removed from Mr. Peterson's property. Motion declared carried 15. SWIMMING POOL ORDINANCE Discussion of whether or not an above ground wall of a swimming pool is considered a safety fence. Motion by Crosby, seconded by Lutz to add Section 4.06tb) to Ordinance 185, as follows: The wall of any pool constructed above ground level, regardless of the height thereof, shall not qualify as a safety fence. Motion declared carried 16. MCCRACKEN, DIVISION/COMBINATION Robert Derus explained that the McCrackens had sold 3 ft. of property to the Pallum's as the Pallum house was 3 feet over the lot line when the property was surveyed. Motion by Crosby, seconded by Reiser to allow the combination of 3 ft. of Lot 3, Block 28, Independence Beach, to Lot 2, Block 28. Motion declared carried 17. BILLS Motion by Lutz, seconded by Laurent to pay the bills; Payroll # 5448-5454 in the amount of $3146.76 and SAC Charge refunds in the amount of $79,094.61 which amount shall not include $232.75 to Truxton Morrison. Motion declared carried 244 18. EISINGER PERA Discussion of the interest that will need to be paid on former police officer 0rlo Eisinger's PERA account from 1976. Motion by Laurent, seconded by Crosby to pay PERA $ 476.54, interest for 0rlo Eisinger. Motion declared carried 19. PAUL WINTER Motion by Laurent, seconded by Crosby to pay $356.,61, unemployment compensation to Paul Winter. Motion declared carried 20. REVENUE SHARING BUDGET HEARING Motion by Lutz, seconded by Reiser to hold a budget meeting on Tuesday, September 11, 1979 at 7:00 p,M. including proposed uses of Revenue Sharing funds for 1980.
