Minutes from the December 09, 2014 meeting were approved with two spelling corrections. A corrected copy is attached. The commission is required to elect new officers at the first meeting of each year. Gauss was elected to serve as Chairman and Stolk was elected to serve as Vice Chairman. Both selections were unanimous. The commission discussed the rear setback of commercial property at Mayor Paddock's request. The current Riverdale requirements are 20 feet for a C1 property and none required for a C2 property, unless the C2 property abuts a residential area. In that case, the C2 property must have the same setback as the residential lot is required to have. Currently, that would be 30 feet. Mayor Paddock feels that the zero set back might cause problems and at the very least a survey should be completed prior to building. Commissioner Wren was kind enough to research Davenport and Bettendorf's requirements for rear setbacks of commercial property. Wren reported that Bettendorf 's requirements were identical to Riverdale's and that Davenport's requirements were the same except that when abutting a residential area a 25 foot setback was required. After discussion of the pros and cons of change, the commission concluded that without further mitigating inform ation, we would not recommend a change to current Riverdale code. No action was taken but the commission is open to further direction from the council or mayor. The commission reviewed suggested changes to the zoning ordinance from previous meetings. Board of Adjustment is a separate entity of city government although city ordinance includes board of adjustment in zoning ordinance. Another ordinance separates the two. Iowa code defines duties. This item was presented by resident Jim Beran. Gauss reported that he had discussed this matter with Mr. Beran and he had clarified further that it seemed that the Board of Adjustment was defined in two different ways by Riverdale ordinance. Gauss discussed this with Mayor Paddock. She reported that she had been unable to find any conflicting definitions and would discuss directly with Mr. Beran. Referred to Mayor and Council. Riverdale Planning and Zoning Commission Minutes from January 27, 2015 Page 2 Page 11, Section 31 - District Map - Over the years the district maps were seldom accurate. Suggest proposed map include all R1 subdivisions as well as municipal properties (parks, city hall, fire station). Where conflicts arose, Board of Adjustment had very little to support city position. Proposed map show Van Gundy and Havens Acre Park as Residential. Parks will remain parks forever. This item was suggested by resident Jim Beran. Commission agrees that the current maps are difficult to interpret and requests that the mayor and council authorize the preparation of zoning maps with plat detail for use by the city, commission, and citizens. Perhaps this detail is available through MSA currently or perhaps the Bi State Regional Council could assist. Referred to Mayor and Council. Page 34 - 61A.4 - Temporary Permit Uses Permitted - Shouldn't the term "building commissioner" be replaced with "zoning inspecto r". This was suggested by Wren. Commission agrees. Page 80 - 91.10 - Should include satellite towers and wind power turbines. Add Electric - Gas - Water - Telephone. Examples - Electric Substations and relay station, gas pressure regulators above ground and underground, water towers and underground pump stations, telephone underground controls and relays. This was suggested by resident Jim Beran. After discussion, the commission does not recommend a change. This may be councils approval. Travel trailer parking on residential property. Parking in street for extended periods without permit. Non -working, non-licensed vehicles on property for extended periods. Could be part of zoning. This was suggested by resident Jim Beran. Commission feels that current nuisance ordinances adequately address concerns . The next four items are from Messrs Welch and Strawhawker's. Section 61.A7 - The maximum height is listed as two stories, should it be four stories. Commission feels that two stories is a good maximum for commercial business. Section 61.A8 - 4 - This states that all goods produced on the premises must be sold on the premises, they feel that is too restrictive. Commission likes the current wording that prevents manufacturing. If manufacturing is needed a request for a zoning change should be pursued. Section 62.A2 - 6 - This states that apartments with more than two bedrooms are not permitted, they feel that more should be permitted. Commission feels that two bedrooms above a commercial establishment per apartment is sufficient. Section 62.A6 - This section prohibits automobile agencies, they feel that they should be allowed. Commission discussed and disagrees due to the light pollution. Wren asked a general question of enforcement of the zoning ordinance and Gauss agreed to contact Mayor Paddock for a response. The Bi-State Regional Commission is hosting a training session in Rock Island, March 12, 2015 from 3-4:30 PM. It is entitled "Using Subdivision Regulations in the 21st Century". Mayor Paddock has asked if the commission would be interested in attending. All commissioners were grateful for the opportunity from Mayor Paddock but were not all able to Riverdale Planning and Zoning Commission Minutes from January 27, 2015 Page 3 attend on that date. Gauss will report to Mayor Paddock that: Wren is a yes, Stolk and Gauss are possible, and Ulrich and Clark are no at this point. The commission set April 14, 2015, 2015 at 6:30 PM as the date of our next meeting.
