AN ORDRVANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
AM7~NDING ORDINANCE 570 BY ADDING THERETO SECTION 4. 04. B.8
WITH RESPECT TO SIDE AND REAR YARD REQUIREMENTS, SECTIONS
4. 04. B.9 and 10 WITH RESPECT TO DISTANCE BETWEEN BUILDINGS,
AND SECTION 14. 13 WITH RESPECT TO _9UTOMt)TIVE USES AS
DEFINED.
The City Council of the City of Lynwood does ordain as follows:
Section 1. Section 4. 04. B Ordinance 570, the Zoning Ordinance, is
hereby amended by adding a new subparagraph thereto to read as follows:
Section 4. 04. B. 8. Additions to or expansions of residential struc-
tures may maintain the existing side and rear yard requirements pro-
vided the structure was in existence on January 4, 1980, if the existing
setbacks were in conformance with previous applicable codes or
ordinances, and if the additions are not separate structures for human
habitation in R-1 zones.
Section 2. Section 4. 04. B of Ordinance 570 is hereby further amended
by adding a new subparagraph thereto to read as follows:
Section 4. 04. B. 9. Additions to or expansions of residential struc-
tures may maintain the distance between buildings (i. e., distance between
structures and garages) which was in existence on January 4, 1980, pro-
vided that conditions of the City of Lynwood Fire Department with regard
to combustibility of materials and type of construction must be fulfilled.
Section 3. Section 4. 04. B of Ordinance 570 is further amended by
adding a new subparagraph thereto to read as follows:
Section 4. 04. B. 10. The provisions of Section 4. 04. B. 9 of this Ordi-
Hance shall also apply to replacement of garages in residential areas.
Section 4. Chapter XIV of Ordinance 570 is hereby amended by adding
a new Section 14. 13 thereto to read as follows:
Section 14.13 -Notwithstanding any other provision of this
Ordinance, Conditional Use Permit shall be required for the construction, re-
construction, or operation of an automotive use on appropriately zone proper-
ties in the City of Lynwood.
"Automotive use" shall mean: sales, repairs, servicing, reconditioning, paint-
ing, upholstering, body work, washing, and shall include new and used vehicles
or parts for vehicles. "Vehicle" shall mean automobiles, trucks, tractors,
wheeled heavy equipment, motorcycles, motorbicycles, mopeds, recreational
vehicles, and off-road vehicles.
Section 5. Severability. If any section, subsection, subdivision,
sentence, clause, phrase or portion of this Ordinance, or the application there-
of to any person or place, is for any reason held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions of this Ordinance or its application
to other persons or places. The City Council hereby declares that it would have
adopted this Ordinance, and each section, subsection, subdivision, sentence,
clause, phrase or portion thereof, irrespective of the fact that any one or more
sections, subsections, subdivisions, sentences, clauses, phrases, or portions,
or the application thereof to any person or place be declared invalid or uncon-
stitutional .
Section 6. The City Clerk is hereby ordered and directed to certify to
the passage of this Ordinance and to cause the same to be published once in the
Lynwood Press, a newspaper of general circulation, printed, published and
circulated in the City of Lynwood.
First read at a regular meeting of the City Council of said City held on
the 17th day of June, 1980, and finally ordered published at a regular meeting of
said Council held on the first day of July, 1980.
