HomeMy Public PortalAboutOrd. 1124ORDINANCE N0. 1124 follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SECTION 4.04 OF THE ZONING ORDINANCE OF THE CITY OF LYNWOOD REGARDING MAXIMUM DENSITY OF DWELLING UNITS The City Council of the City of Lynwood hereby does ordain as SECTION 1. Section 4.04 (B)(7a)is hereby added to Ordinance No. 570, the Zoning Ordinance of the City of Lynwood, to read as follows: Notwithstanding the maximum number of dwelling units permitted per acre LSec. 4.04 (A)(1)ladditional dwelling units may be per- mitted in the R-2 and R-3 zones at the discretion of the Planning Commission whereby, through the use of creative design techniques, the application meets or exceeds all requirements of the Zoning Ordinance for off-street parking facilities, front, side, and rear yards, site area, landscaping, lot coverage, open space, height of structures, and distance between structures. The num- ber of additional units permitted, including those permitted as bonus units as incentives toward providing low and moderate income housing, shall not exceed thirty percent (30%) of the number per- mitted by Secs. 4.04 (A)(1) and 4.04 (B)(7). SECTION 2. Severability. If any section, subsection, subdivision, sentence, c auT se, phrase or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions ,sentences, clauses, phrases, or portions, or the applica- tion thereof to any person or place, be declared finvaltd or unconstitutional. SECTION 3. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published and circulated in the City of Lynwood.
