AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF LYNWOOD REPEALING VARIOUS SECTIONS
OF THE LYNWOOD CITY CODE RELATING TO ANIMAL CONTROL.
The City Council of the City of Lynwood IiEREBY DOES
ORDAIN as follows:
SECTION 1. Sections 5-19, 5-20 and 5-21(C) of the Lynwood
Municipal Code are hereby repealed.
SECTION 2. Section 5-19 is hereby added to the Lynwood Municipal
Code to read as follows:
Any provision of this Code to the contrary notwithstanding,
dog license fees and penalty fees shall be established by resolution from
time to time adopted by the City Council.
SECTION 3. Animal control is a continuing problem and threat
to the public peace, health and safety in the community. There exists a
substantial problem with animal control particularly in the freeway cor-
ridor. There is a substantial shortfall in revenue with respect to pro-
viding animal control services and it is necessary to increase the license
fees to offset this shortfall and it is necessary that the increase be
effective prior to July 1, 1981
THEREFORE, this in terim u rgency ordinance shall become effective
immediately for the immediate preservation of the public peace, health
and safety of the community.
SECTION 4. Severability. If any section, subsection, subdivi-
sion, sentence, clause, phrase or portion of this ordinance, or the applica-
tion thereof to any person or place, is for any reason held to be invalid
or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions of
this ordinance or its application to other persons or places. The City
Council hereby declares that it would have adopted this ordinance, and each
section, subsection, subdivision, sentence, clause, phrase or portion thereof,
irrespective of the fact that any one or more sections, subsections, subdiv-
isions, sentences, clauses, phrases, or portions, or the application thereof
to any person or place, be declared invalid or unconstitutional.
SECTION 5. The City Clerk is hereby ordered and directed to
certify to the passage of this ordinance and to cause the same to be
published once in the Lynwood Press, a newspaper of general circulation,
printed, published and circulated in the City of Lynwood.
Introduced and adopted at a regular meeting of the City Council
of said City held on the 19th day of May, 1981.
