HomeMy Public PortalAboutOrd. 1130ORDINANCE NO. 1130 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDINANCE NO. 570 (ZONING ORDINANCE) PROVIDING FOR THE INSTALLATION OF MOBILE HOMES ON LOTS WHERE SINGLE FAMILY DWELLINGS ARE PERMITTED The City Council of the City of Lynwood HEREBY DOES ORDAIN as follows: SECTION 1. Objective No. 6 is hereby added to Section 4.00 of Ordinance No. 570, the Zoning Ordinance of the City of Lynwood, to read as follows: 6. To ensure architectural compatibility of dwellings with surrounding structures. SECTION 2. Section 4.01 (A) of Ordinance No. 570 is modified to read as follows: The following uses shall be permitted vrhere the symbol "P" appears and shall be permitted subject to a Conditional Use Permit approval where the "C" appears in the colum beneath each zone designation: A. Residential Uses Zones R-1 R-2 R-3 Single-family dwellings, in- P C cludina mobile home units certi- fied under the National Mobile Homes Construction and Safety Standards Act of 1974 that are on a permanent foundation system ap- proved by the City Building_De- partment. Multiple dwellings containing not C more than 2 units, including du- plex mobile homes, certified by the same procedure as single- family dwellings. Multiple dwellings containing more C C than 2 units Residential condominiums C C Boarding or rooming house, dormitory and similar group quarters. C Residential care facilities (6 or P P P less residents including those of occupant) in accordance with Health & Safety Code Section 1567.5. Community residential care C facility, including retirement com- munities. SECTION 3. General requirement No. 15 is hereby added to Section 4.04 (A) of Ordinance No. 570 to read as follows: 15. Dwelling width, minimum R-1, 20 feet; R-2, 20 feet; R-3, 20 feet. SECTION 4. Special requirements Nos. 11, 12, 13, and 14 are hereby added to Section 4.04 (B) of Ordinance No. 570 to read as follows: 11. Residential structures shall have an eave pro- jection of at least two and one-half (2-1/2') feet on at least two opposite sides. 12. Residential structures shall have a roof con- structed with a non-reflective material in- cluding shingles, woodshake, asphalt composi- tion, crushed rock, or other similar roofing material that is not reflective, glossy, or of the polished and/or roll-formed type metal roof- ing. This standard can be modified by the pro- cedure described in Section 4.04 (B)(14) below. 13. Residential structures shall have an exterior siding of brick, stucco, wood, metal, concrete, or other similar material other than the reflec- tive, glossy, polished and/or roll-formed type metal siding. This standard can be modified by the procedure described in Section 4.04 (B)(14) below. The exterior siding material shall ex- tend to the ground, except that when a solid con- crete or masonry perimeter foundation is used, the exterior material need not extend below the top of the foundation. 14. The Planning Director may approve modification to the above standards if any one of the following findings can be made: a. That such modifications would enhance archi- tectural compatibility between a residential structure and existing structures in the sur- rounding area; b. That a proposed alteration or addition to an existing residential structure will be a con- tinuation of the existing architectural style; or c. That such modification is necessary for safety reasons and to comply with other ap- plicable codes, laws, ordinances, rules and regulations. Proposed modifications shall be reviewed under the Site Plan Approval process described in Section 25-29 of the Lynwood Municipal Code. SECTION 5. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordi- nance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivision, sentences, clauses, phrases or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 6. This ordinance shall an urgency ordinance pursuant to Gov. Code pose of protecting the health, safety, and munity. SECTION 7. The City Clerk is hereby ordered and direct- ed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood.
