AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
APIENDING THE CODE OF THE CITY OF LYNWOOD TO PROVIDE PRO-
CEDURES FOR SITE PLAN REVIEW

The City Council of the City of Lynwood HEREBI' DOES ORDAIN as fol-
SECTION 1. Section 25-29 is added to the Code of the City of Lynwood,
as follows:
Section 25-29 Site Plan Review
Sec. 25-29.1 Purpose and Authority. The purpose of the site
plan review is to grant authority to the Planning Director to take
action on requests for approval of land uses and developrrient
where site plan review is required by the Zoning Ordinance of the
City.
Sec. 25-29.2 Effect Upon Building Permits. Where the pro-
visions of this Chapter require that the site plan review be sub-
mitted for approval, no building permit shall be issued or if
one is issued in error, the same shall be suspended until a site
plan has been approved in the manner set forth in this part.
Sec. 25-29.3 Application: Data and Maps to be Furnished.
Application for site plan review shall be filed with the Plan-
ning Director on a form prescribed by the Planning Director and
shall include the following data and maps:
A. Name and address of the applicant.
B. Statement that the applicant is either (a) the plain-
tiff in any action in eminent domain to acquire the
property or (b) the owner of, or (c) the authorized
agent of the owner of the property on which the use is
proposed to be located.
C. Notarized signature of owner(s) of record of property
for which site plan review is requested. Signature(s)
will be for agreement to and knowledge of the requested
site plan review.
D. Address and legal description of the property.
E. Statement indicating the precise manner of compliance
with each of the applicable provisions of this Chapter,
together with any other data required by the Planning
Division.
F. Plot plans and elevations, fully dimensioned, indicating
the type and location of all buildings and structures,
parking and landscape areas and signs. Elevation plans
shall be of sufficient detail to indicate the type and
color materials to be employed and methods of illumina-
for signs. Screening, landscape and irrigation plans
shall be included in the plans. Twenty-five (25) copies
of all plans shall be provided.

Sec. 25-29.4 Fee. The application shall be accompanied by
a fee established by resolution of the City Council to cover the
cost of handling the application as prescribed in this section.
Sec. 25-29.5 Public ~•1eeting: Action by Planning Director.
The Planning Director shall hold a public meeting on an applica-
tion for site plain-review. At the meeting, the director,
or his representative, shall review the application, statements,
and drawings submitted, and the results of his own investigation
of the property involved and surrounding area and conditions.
At the public meeting, the director shall act on the application
and may approve the application as submitted or in modified form,
or the application may be denied. Site plan approval may be
granted subject to such conditions as the Planning Director may
prescribe.
Sec. "c5-29.6 Public h1eeting: Definition, Time, Place.
"Public meeting" shall mean a conference among proponent, Plan-
ning Director, and other persons concerned with site-plan review
application=. Such meetings shall be held at such time as needed
and shall take place at the public counter of the Planning Divi-
sion.
Sec. 25-29.7 Appeal. The decision of the Planning Director
may be appealed to the Planning Commission within fifteen (15)
days of the decision of the Planniny Director. The procedure
outlined in Sec. 25-26 of this Chapter shall be utilized.
SECTION 2. The concluding paragraph of Section 10.01 of the Lynwood
Zoning Ordinance is hereby amended to read as follows:
Each and ali of the uses permitted by this Section shall be
allowed only after a site plan has been reviewed and approved
in accordance with Section 25-28 of the Code of the City of
Lynwood.
SECTION 3. Severability. If any section, subsection, subdivision,
sentence, clause, phrase, or portion of this ordinance, or the application
thereof to any person or place, is for any reason held to be invalid or uncon-
stitutional by the decision of any court of competent jurisdiction, such de-
cision shall not affect the validity of the remaining portions of this ordin-
ance or its application to other persons or places. The City Council hereby
declares that it would have adopted this ordinance, and each section, subsec-
tion, subdivision, sentence, clause, phrase, or portion thereof, irrespective
of the fact that any one or more sections, subsections, subdivisions, sen-
tences, clauses, phrases, or portions, or the application thereof to any per-
son or place, be declared invalid or unconstitutional.
SECTION 4. The City. Clerk is hereby ordered and directed to certify
to the passage of this ordinance and to cause the same to be published once
in the Lynwood Press, a newspaper of general circulation printed, published
and circulated in the City of Lynwood.
First read at a regular meeting of, the City Council of said City on
the 7th day of JULY 1981, and finally ordered published
at a regular meeting of said Council held on the 21st day of JULY ,
1981.
