RICHMOND SANITARY DISTRICT
THIS RESOLUTION passed by the Board of Sanitary Commissioners for the Richmond Sanitary District (hereinafter referred to as “RSD”) this __25th ____ day of _May____________, 2010.
WHEREAS, pursuant to prior action and agreements, RSD has previously installed new sewer facilities to service approximately fifty-six property owners in the area of Airport Road and
Samuel Drive in Wayne County, Indiana, and which new facilities were requested by the property owners due to health problems with their prior septic systems; and
WHEREAS, a portion of the affected property parcels were then located within the boundaries of the Richmond Sanitary District and the balance of the parcels were located outside the
boundaries of the District; and
WHEREAS, such parcels and property outside the District were capable of being connected into the sanitary system of RSD and the majority were connected to the system because of the
new sewer facilities; and
WHEREAS, the vast majority of all affected property owners within the new service area have previously executed “Contribution Agreements” and/or “Amended Contribution Agreements”, in
which they have agreed not to object to any annexation of their property by RSD into the District, and were annexed to the Richmond Sanitary District by resolution of its Board in 1999;
WHEREAS, one property owner in the area of the Airport Road and Samuel Drive in Wayne County, not currently located within the Richmond Sanitary District but abutting its boundaries,
has also now executed such a Contribution Agreement to connect to the new sewer facilities, and has also agreed to not object to any annexation of their property by RSD into the District;
and
WHEREAS, based upon the requested connection of the affected property owners, RSD believes it is in everyone’s best interest to incorporate any territory being connected into the RSD
system as part of the new sewer facilities into the District pursuant to I.C. 36-9-25-15;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the Board of RSD hereby incorporates the following described property containing approximately 1.15 acres into the Richmond Sanitary District, to-wit:
“See Exhibit A incorporated by reference herein and attached hereto.”
which property is also shown cross-hatched in red on Exhibit B (1943 Airport Road), also incorporated by reference herein and attached hereto.
2. That upon passage of this Resolution, RSD shall set a time and place for public hearing upon the Resolution, prior to which time any affected person may file at the office of the
RSD a written remonstrance regarding the inclusion of his or her land. Notice of such hearing shall be published in accordance with I.C. 5-3-1, which will require one published notice
at least ten (10) days prior to the hearing. Following such hearing, the Board shall either confirm, modify or rescind this Resolution which action shall be deemed the final action
of the Board.
3. That the territory to be incorporated into the Richmond Sanitary District shall be subject to all taxes and fees assessed by the RSD.
4. That following the public hearing and final action by the Board, and the expiration of any time to appeal thereafter, a certified copy of this Resolution, including the exhibit/map
showing the boundaries of the newly incorporated area, shall be delivered to the Wayne County Recorder.
IN WITNESS WHEREOF, the Board of Commissioners for the Richmond Sanitary District adopts and approves this Resolution as of date set forth above.
