APPROVING CHANGE ORDER # 5 AND FINAL
STAR OF THE SEA CONCRETE CORP./2003 ROAD
IMPROVEMENT PROGRAM
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a
contract to Star of the Sea Concrete Corp. in the amount of $414,444.00 for the 2003
Road Improvement Pro,am; and
WHEREAS, the Borough's Consulting Engineer for the project, T & M Associates, has
advised the Governing Body that a modification of the contract is reasonable and
necessary and has recommended that the aforesaid contract be modified in accordance
with Contract Change Order #5 (see attached); and
WHEREAS, Change Order # 5 includes a change in the description of work to reduce
and increase quantities to reflect as-built conditions; and
WHEREAS, Change Order # 5 provides for a net decrease the contract price in the
amount of $33,793.00, inclusive of all previously approved change orders, resulting in a
revised contract price of $380,651.00; and
WHEREAS, the Borough's Consulting Engineer, T & M Associates has advised that the
above described changes and/or modifications to the project were unforeseen at the time
of the award of the original contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
1. That the Contract Change Order #5 attached hereto and made a part hereof,
resulting in a net decrease of $33,793.00, inclusive of all previously approved
change orders, in the overall contract price, resulting in a revised contract price
of $380,651.00 is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to execute Change
Order #5 based upon the recommendation of the Borough Engineer.
3. That the Borough Purchasing Department is hereby authorized to issue payment
pursuant to Payment Certification No.4 (see attached).
4. A copy of this resolution and a fully executed copy of Change Order #5 be
forwarded to T&M Associates for distribution to Star of the Sea Concrete Corp..
