HomeMy Public PortalAbout2012 0530 MinutesCity of Riverdale Board of Adjustments Minutes Meeting 5/30/12 Members Present: Don Fisher, Harry Pelton, Jenny Staub, Dean Hiles, Joe Kosinski Members Absent: None Guest Present: Don Wright, Barb Lund-Wright, Richard Wells, Byron and Cathy Kime, Tom Mack Presiding: Fisher Recorder of Proceedings: Staub Call to Order: 7:00PM Adjourned: 8:15PM Fisher opened to meeting of the Board of Adjustments at 7:00PM. Order of Business: Approve minutes to March 28, 2012 meeting to correct spelling errors. Motion to approve: Fisher Second: Pelton, votes: all Ayes, motion passed. Motion to approve minutes for May 16, 2012 with corrections. Motion made by: Staub second: Kosinski vote: All Ayes. Motion passed. Review of “Order of Findings” for Marie Randol appeal. Motion to place findings into official record by: Hiles. Second by: Kosinski. Vote: All Ayes. Motion passed. Motion to approve additional minutes to May 16, 2012 meeting recorded by Staub. Motion made by: Pelton Second by: Hiles. Vote: all Ayes. Motion passed. Close of BOA meeting 7:10pm Public Hearing for variance request of Ordinance # 97-153 sub section 43.02 from Barb Lund-Wright opened. Ms. Lund-Wright stated that they didn’t realize there were rules in place that stated where her shed could be placed. She did not realize they were in violation. Neighbors present (Byron and Cathy Kime and Tom Mack) stated they thought the shed looked best where it was currently placed. Discussion of the number of letters received by the BOA objecting to the placement of the shed, including several that were against the current placement of said shed. The ordinance was reviewed. Motion to close the public hearing made by Pelton. Seconded by Hile. Vote: All Ayes, motion passed. BOA meeting re-opened. All Board members were present. Discussion made reference the number of citizens against allowing the shed outside of the guidelines. Other citizens have been denied as well. Motion made by Pelton to deny the request for a variance. Seconded by Hiles. Vote: All Ayes. Motion passed. BOA Meeting closed and Public Hearing for request for variance, Art. 3 Section 35.01 made by Richard Wells. Mr. Wells presented a drawing of the plans for the fence in his yard. Wells, stated that he could take sections of the current 6 foot fence down and repair them but would rather replace it entirely. The 6 foot fence was there prior to the original ordinance. He stated that he had valuable plants that were created by his wife who had been a botanist and he wanted to save these plants from destruction by deer. Pelton suggested that Wells look for other options to prevent damage from deer. Pelton stated he had spoken with someone from the DNR and they did not feel a 6 foot fence would stop deer. Wells stated that he did not agree with that. Wells also stated he was frustrated with the application process for a variance request. Members of the board acknowledged this frustration and stated there is plans to review and revise the current variance application. A motion to close the public hearing for Mr. Wells variance request was made by Pelton. Seconded by Kosinski. Vote: all ayes. Motion passed. BOA Meeting was re-opened. All Board Member were still present. The board reviewed the guidelines for a variance. Kosinski stated that perhaps a request should be made to the council by Mr. Wells or other citizens to ask for similar protective fencing for special gardening/agriculture in the same where there is 6 foot fence protection for swimming pools. Motion made by Hiles to deny the request for Mr. Wells variance. Seconded by Pelton. Vote: All Ayes. Motion passed and the request was denied. Fisher stated that repairing the current fence would not be a violation if that is what Mr. Wells would like to do. Kosinski stated he would look into revising the current application for a variance request. With no further business a motion to close the BOA meeting was made by Hiles. Secoded by Kosinski.
