I disagree with your contention that a photograph needs to be dated in order to disprove a roof over the deck structure. Any photograph dated or not which would disclose the deck without a roof would show that the permit was not issued for the deck and roof as originally stated. What the photograph actually shows is that there is an existing deck on the property without a roof extending over the deck. I believe what the City Marshal is referring to is the roof overhang as disclosed in the photograph that I forwarded to you. The photograph discloses the eave overhang from the roof onto the deck area, but does not disclose a roof over the entire deck area as is now existing. There is verification from many persons in the neighborhood, as well as, former tenants that the roof structure over the deck did not exist and was recently added on. Please advise. Upon reading your letter, there needs to be more information provided regarding the building permit that was issued at 24 Pulaski and the procedure of such. The issue with this property came about as we received complaints that there was work taking place at this location without a building permit. This was confirmed by the building inspector and myself, at which point the referenced stop work order was placed at the property location. As the work was not large scale with replacement of rotten wood as the crux of the project, most of the work was completed by the time that we received the complaints and placed the subsequent stop work order. Once our office received the necessary permit application materials and doubled the permit fee for working without a permit, the stop work order was removed from the property, not rescinded as stated in your letter, the project was then a properly permitted job on Tybee. There was only one permit issued for this deck project, although you mention in your letter that there were two (2)permits issued, one (1) for the deck and one (1) for the roof The other seemingly outstanding issue from your letter deals with the fact that there was a picture provided to the office from "December 10, 2007" showing that there was no roof at that time. The picture that was provided to this office from Mr. Carter, which is the same one that is included in your letter, is one from Google Maps and does not have a specific date, or at least not one that I have found, for this property. I concur that this picture does not show a roof over the deck but without a confirmed date of the picture, there is no basis for this office to say when the roof was built. Box 2749 Tybee Island, GA 31328 RE: Roof over deck on adjacent property located at 24 Pulaski Road,Tybee Island, GA My Clients: Jack&Debbie Carter, 13 Dogwood Avenue, Tybee Island, GA Gentlemen: Please be advised that this office represents Jack and Debbie Carter who are adjacent property owners to the 24 Pulaski Road, Tybee Island, Georgia property. All of the letters and photographs forwarded to your office depict that the adjacent structure had a deck with no roof. Your response, as I understand it,was that the permit for the roof was issued at the same time that the permit for the deck was issued. This is obviously incorrect as all of the pictures show a deck with no roof. I have enclosed a photograph dated December 10, 2007, which shows the deck behind the palm tree with no roof. The setback regulations on Tybee Island would prohibit the building of a roof over the deck. In addition, it is my understanding that the owners of the property never secured a building permit prior to construction of the roof. You issued a stop work order which you later rescinded, stating that the roof had been authorized when the deck was originally built. All my clients want is for you to do your job and make the adjacent property owner comply with city ordinances and regulations as do all other residents of Tybee Island, Georgia. Some time ago there was some type of cover or shed type roof that was over it. I do not remember any dimensions of the roof. On Thursday or Friday of last week I saw the repair/replacing work I informed them of the permit needing to be in place and contacted Mr.Skaggs of this and gave him the number to contact and talk with Ray Hord.
