Roll Call. ____________________ called the regular meeting to order at 7:00 p.m.. Present at roll call were Board of Adjustment members Dean Hiles; Mike Mangels; Shannon Musal; Athena Smith; Sally Stewart; . Also present were Zoning Administrator Tim Long and 2. Review and Approval of the Agenda Motion by _____________________ to approve the agenda second by ____________________. 3. Public Hearing: Request for Variance, Building Setback, Brenny’s Motorcycles, 4426 State Street. Motion by _____________________ to open public hearing at ________ p.m., second by ____________________. Long stated that Brenny’s contractor had contacted him regarding placing the building at approximately 9’ from the adjoining property line, and long advised him of the required 30’ setback, and that no building permit could be issued. Long stated that he had responded to the petitioner that they could request a variance, and that determination rested with the Board of Adjustment. Long read aloud an email from John Riches, Arconic’s representative, which objected to the request for variance. Consideration of Brenny request for Variance Zoning Administrator Long read through Section 123.04.04 of the Zoning Ordinance, the conditions for consideration of a variance: “… where by reason of an exceptional situation, surroundings, or condition of a specific piece of property, or by reason of exceptional narrowness, shallowness or shape of a specific piece of property of record, or by reason of exceptional topographical conditions that strict application of any provision of this ordinance would result in peculiar and exceptional practical difficulties or particular hardship upon the owner of such property and amounts to a practical confiscation of property, as distinguished from a mere inconvenience to such owner, provided such relief can be granted without substantial detriment to the public good and without substantially impairing the general purpose and intent of the comprehensive plan as established by the regulations and provisions of this ordinance.”; and, 123.05 “In considering all appeals and all proposed variations to this Ordinance, the Board shall, before making any variation from the Ordinance in a specific case, first determine that the proposed variation will not impair an adequate supply of light and air to adjacent property, or unreasonably increase congestion in public streets, or increase the danger of fire or endanger the public safety, or unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Riverdale.
