A Regular Meeting of the Mayor and Council of the Borough of
Carteret was called to order by Mayor James A. Failace at 7:30
P.M., Municipal CourtlPolice Facility, 230 Roosevelt Avenue,
Carteret, New Jersey on Thursday, March 16, 2000.
Upon individual roll call, the following were noted present:
Councilmember Patrick Crilley
" Jack Fazekas
" James O'Brien
" Remy Quinones
" Janet Santoro
" Buddy Sohayda
Noted absent was Business Administrator Nick Goldsack.
Also noted present was Borough Attorney Craig Coughlin.
The meeting was opened with a minute of Silent Prayer and the
Pledge of Allegiance led by Mayor James A. Failace.
The Clerk stated that on March 10, 2000 in full compliance with
the Open Public Meetings Act, a notice of tonight's meeting was
sent to The Home News & Tribune, The Star Ledger and posted on
the bulletin board.
Before voting on approving the Minutes of February 3, 2000,
Councilmember Crilley said there was a correction to be made in
those minutes. He said there was a vote where Councilmember
Gutowski was mentioned and he is no longer a Councilmember.
The Clerk said she would review it.
Upon MMS&C by Councilmembers Fazekas and O'Brien and
unanimous affirmative vote of the full Council present the minutes
of February 3, 2000 were amended to change the name of the
Councilmember.
Upon MMS&C by Councilmembers O'Brien and Fazekas and
unanimous affirmative vote of the full Council present the
Minutes of February 3, 2000 were approved as amended,
transcribed and engrossed by the Clerk.

and the Clerk authorized and directed to advertise same for Public

vote Councilmembers Fazekas, O'Brien, Quinones, Santoro and
Sohayda voted in the affirmative. Councilmember Crilley
Abstained.

Councilmember Crilley stated that he was trying to recollect if this
was from the Agenda Meeting.
Mayor Failace said they said they are establishing the position, not
filling it now.
ORDINANCE #00-13 was introduced and adopted on First
Reading and the Clerk authorized and directed to advertise same
for Public Hearing to be held on April 6, 2000, upon MMS&C by
Council members Quinones and O'Brien. Upon individual roll call
vote Councilmembers Crilley, Fazekas, O'Brien, Quinones,
Santoro and Sohayda voted in the affirmative.
Councilmember Crilley then apologized saying he need to Abstain
from voting on Ordinance #00-13 unless it was on the Agenda.

Public Hearing-
The Clerk stated that Ordinance #00-5 was introduced and passed
upon First Reading at a Regular Meeting of the Borough of
Carteret held on March 2, 2000. It was duly published in The
Home News Tribune on March 7, 2000 with notice that it will be
considered for final passage after Public Hearing to be held on
March 16, 2000 at approximately 7:30 P.M. The Ordinance was
posted on the bulletin board and copies were made available to the
general public and according to law, she read the Ordinance by
title.
Upon MMS&C by Councilmembers O'Brien and Crilley and
unanimous affirmative vote of the full Council present the Mayor
declared the Public Hearing to be open.

John Sudia of Cypress Street in Carteret spoke and asked for
clarification for location of the tanks and he mentioned the Bond
Ordinance noting that " Removal and Replacement" and asked if
the replacement would be under or over the ground.
Mayor Failace said right now the one we are replacing will be
above ground and the location is at the Borough Garage.

There being no further comments or objections to the Ordinance,
the Mayor declared the Public Hearing to be closed upon MMS&C
by Councilmembers Crilley and Fazekas and unanimous
affirmative vote of the full Council present.

Bond Ordinance
in full
BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE
BOROUGH OF CARTERET, IN THE COUNTY OF
MIDDLESEX, NEW JERSEY (not less than two-thirds of all
members thereof affirmatively concurring) AS FOLLOWS:
Section I. The improvement described in Section 3 of this Bond
Ordinance is hereby authorized to be undertaken by the Borough of
Carteret, New Jersey as a general improvement. For the
improvement or purpose described in Section 3, there is hereby
appropriated the sum of $80,000, including the sum of $76,000
expected to be received from the New Jersey Economic
Development Authority and the New Jersey Department of
Environmental Protection as a no interest loan and the sum of
$4,000 as the down payment required by the Local Bond Law. The
down payment is now available by virtue of provision for down

payment or for capital improvement purposes in one or more
previously adopted budgets.
Section 2. In order to finance the cost of the improvement or
purpose not covered by application of the down payment,
negotiable bonds are hereby authorized to be issued in the principal
amount of $76,000 pursuant to the Local Bond Law.
In anticipation of the issuance of bonds, negotiable bond
anticipation notes are hereby authorized to be issued pursuant to
and within the limitations prescribed by the Local Bond Law.
Section 3. (a) The improvement hereby authorized and the purpose
for the financing of which the bonds are to be issued is the removal
and replacement of underground petroleum storage tanks at various
locations throughout the Borough, including all work and material
necessary therefor or incidental thereto.
(b) The estimated maximum amount of bonds or notes to be issued
for the improvement or purpose is as stated in Section 2 hereof.
(c) The estimated cost of the improvement or purpose is equal to
the amount of the appropriation herein made therefor.
Section 4. All bond anticipation notes issued hereunder shall
mature at such times as may be determined by the Chief Financial
Officer; provided that no note shall mature later than one year from
its date. The notes shall bear interest at such rate or rates and be in
such form as may be determined by the Chief Financial Officer.
The Chief Financial Officer shall determine all matters in
connection with notes issued pursuant to this ordinance and the
Chief Financial Officer's signature upon the notes shall be
conclusive evidence as to all such determinations. All notes issued
hereunder may be renewed from time to time subject to the
provisions of NJ.S.A. 40A:2-8(a). The Chief Financial Officer is
hereby authorized to sell part or all of the notes from time to time
at public or private sale and to deliver them to the purchases
thereof upon receipt of payment of the purchase price plus accrued
interest from their dates to the date of deli very thereof. The Chief
Financial Officer is directed to report in writing to the Governing
Body at the meeting next succeeding the date when any sale of
delivery of notes pursuant to this ordinance is made. Such report
must include the amount, the description, the interest rate and the
maturity schedule of the notes sold, the price obtained and the
name ofthe purchaser.
Section 5. The capital budget of the Borough of Carteret is hereby
amended to conform with the provisions of this ordinance to the
extent of any inconsistency herewith. The resolution in the form
promulgated by the Local Finance Board showing full detail of
amended capital budget and capital program as approved by the
Director of the Division of Local Government Services in on file
with the Clerk and is available there for public inspection.

Section 6. The following additional matters are hereby determined,
declared, recited and stated;
(a) The improvement or purpose described in Section 3 of this
Bond Ordinance is not a current expense. It is improvement or
purpose that the Borough may lawfully undertake as a general
improvement and no part of the cost thereof has been or shall be
specially assessed on property specially benefited thereby.
(b) The period of usefulness of the improvement or purpose within
the limitation of the Local Bond Law, according to the reasonable
life thereof computed from the date of the bonds authorized by this
ordinance, is 15 years.
(c) The Supplemental Debt Statement required by the Local Bond
Law has been duly prepared and filed in the office of the Clerk and
a complete executed duplicate thereof has been filed in the office
of the Director of the Division of Local Government Services in
the Department of Community Affairs of the State of New Jersey.
Such statement shows that the gross debt of the Borough as
defined in the Local Bond Law is increased by the authorization of
the bonds and notes provided in this Bond Ordinance by $76,000
and the obligations authorized herein will be within all debt
limitations prescribed by Law.
(d) An aggregate amount not exceeding $16,000.00 for items of
expense listed in and permitted under N.J.S.A. 40A:2-20 is
included in the estimated cost indicated herein for the purpose or
improvement.
Section 7. Any grant moneys received for the purpose described in
Section 3 hereof shall be applied either to direct payment of the
cost of the improvement or to payment of the obligations issued
pursuant to this ordinance. The amount of obligations authorized
but not issued hereunder shall be reduced to the extent that such
funds are so used.
Section 8. The full faith and credit of the Borough are hereby
pledged to the punctual payment of the principal of and the interest
on the obligations authorized by this Bond Ordinance. The
obligations shall be direct, unlimited obligations of the Borough
and the Borough shall be obligated to levy ad velorem taxes upon
all the taxable real property within the Borough for the payment of
the obligations and the interest thereon without limitation of rate or
amount.
Section 9. This Bond Ordinance shall take effect 20 days after the
first publication thereof after final adoption, as provided by the
Local Bond Law.

Councilmember Santoro asked about Killam, not to exceed
$60,000.00, she questioned that on the Agenda the amount was
$65,469.00. She mentioned it was great we were getting a

reduction but she questioned why there was a change In the
amount since the Agenda.
Mayor Failace said he hasn't spoken to Al Beninato about it but he
stated it has to be done and we received a grant for it so there is no
problem especially since it is less money.
Councilmember Santoro questioned if the five (5) thousand dollars
would be going to another area of the grant.
Council member Santoro asked about the second item, number one
on one, she said she had a meeting today with the Business
Administrator and she asked him if they were going to move
forward and hire because the name was mentioned at the Agenda
and everybody was in accordance to do this.
Mayor Failace said the name was given at the Agenda in Closed
Session so it would not be discussed in Open Session. They were
debating if we should wait a little before doing it.
Councilmember Santoro said she has no problem with Mr. Nix but
her question is for the Business Administrator to give her the
courtesy of running this by her because she is the Chairman of
Buildings and Grounds.
Mayor Failace said he didn't understand what was the courtesy
because it was discussed at the Agenda Meeting. He brought the
name up and in unison they agreed to it that night.
Councilmember Santoro asked why they didn't review the
application with her, as being part of Buildings and Grounds,
before it was put on.
John Sudia asked if the money in Resolution #00-94, $60,000.00
given to Killam Associates, was from the Grant Money.
Mayor Failace said it was.

Councilmember O'Brien then mentioned that in the body of the
Resolution it may be just a typing error but it says $3600.00
instead of $3660.00.
The Clerk said the correct amount is $3660.00.

BUILDINGS & GROUNDS: Committee Chairperson Santoro said
she wants to go and see some of the situations in the Buildings and
Grounds and after that she has some great news she will be
reporting. She said they had the Grand Opening of the Library and
the Community Center should be opening by the end of the month.
She said she is requesting a Buildings & Grounds Meeting next
Thursday at 6:00 p.m. to review what is going on in those
buildings so they could sit and possibly make arrangements to have
the groups moved into them. At that meeting the estimates from
the architects that looked at Borough Hall should also be ready.
She said there was a resolution tonight about the air quality testing
because of Borough Hall and the situation in the basement where
the testing was done last April and mold and fungi was reported
and we will be periodically keep doing testing because of this
because it can be a cause for concern. She said Borough Hall has to
be repaired. She said they have been looking at the estimates, but
the problem being, is how they have to pay for it. She has read in
the newspaper about some towns received grants to do this. She
spoke on this for a while. She said today she got a call from our
Assemblywoman Arlene Friscia, who will introduce the bill for
us. She went on to say as soon as she gets the cost estimates she
would like the Governing Body's support.
FINANCE & ADMINISTRATION: Committee Chairperson
O'Brien said they applied for Discretionary Aid but they have not
heard back from the state. He asked everyone send out their
Census Form. He reported Progress.
FIRE - Committee Chairperson Fazekas said he wanted to thank
GATX because they hosted a large diameter tank fire fighting.

Both Career and Volunteers attended this. They have provided
services and helped the Fire Department throughout the year. He
said we received a Holmatro Tool that is used for extricating
victims out of crashes. He said they will be conducting training on
this for both Fire Departments and he went on to say that he is
trying to set up April, May and June for Safety Awareness, to hold
First Aid and CPR Classes and they will distribute the dates. He
will disburse more information when he has it.
PARKS & RECREATION: Committee Chairperson Crilley said
the Three out of Three Basketball Tournament for 5th Grade
through High School ages will be held March 22, 23 and 24th at the
High School. He then mentioned the Dugouts at Sullivan Field.
This was through the efforts of GATX and Daphne Miles. He
thanked her. The fields are being worked on and the Little League
Parade will be April 15th. The trees on the corner of Union and
Edwin Streets have been removed. At the next Agenda Meeting on
the 30th, there will be presentation by a company who
computerizes your park. They will make a presentation here for
our Cornell Estates Park in West Carteret. He said the equipment is
in for Chrome Park and they will try and do as much as that park
as possible along with doing West Carteret Park.
POLICE: Committee Chairperson Quinones said before giving her
report Councilmember O'Brien would like to speak.
Councilmember O'Brien said if he leaves this meeting it is
because he is supposed to be helping his students this evening. He
has someone standing in for him for a while.
Committee Chairperson Quinones said she had a short meeting
with the Mayor today about the Stop Sign over by the school, by
Plaza 12. She will be calling a meeting to address that because it
has been quite a while since the sign has been repaired and she
would like to get that moving. She went on to say that she has
asked the Council to consider hiring several Special Police
Officers on as part-time for intervals of up to one (I) year. They are
trained like any other Police Officer and the Councilor Police
Department has the ability to assign these individuals to a
particular area if we desire. She mentioned Woodbridge has
twenty-two (22). She went on to say that there had been some
discussion with the S.O.A. and the P.B.A. and she has been
informed by our Labor Attorney that there has been some open
communications discussing an alternative to the scheduling issue.
She is hoping to come to an agreement. Lastly she would like to
address the issues surrounding the controversy involving Sergeant
Zubenko and statements that were made at a Council Meeting
recently. The matter was referred by the Governing Body to the
Internal Affairs Department. That was investigated and then sent to
the County Prosecutor's Office and to the best of her knowledge
they are still reviewing the matter. She then expressed her
disapproval to the comments that were made and more importantly
her disappointment in Sergeant Zubenko in the manner in which he
handled the situation. She then read what Sergeant Zubenko had

been quoted saying from an article in the newspaper, "Daphne
Miles put words in his mouth. Daphne Miles and her Political
Group are putting words in his mouth and infringing on his First
Amendment Rights. He said the issue at hand is dealing with the
youth who need parental guidance from lack of a father figure, but
these people don't want to deal with that issue, they would rather
deal with me as an issue for bringing it to their attention." She said
the problem according to Sergeant Zubenko does not
demographically stop in Chrome, she obviously took concern in
what he said. In her opinion Sergeant Zubenko took an unfortunate
position and compounded it by attacking Daphne Miles. She
applauds her for taking this position and bringing it to light. She
said she wanted everyone to understand that the discussion was
about Graffiti and Chrome, nothing else, the tape speaks for itself.
She also said what Sergeant Zubenko did should not reflect on the
rest of the Police Department, that it does not stand for these type
of statements.
PUBLIC WORKS: Committee Chairperson Sohayda said Mr.
Crilley is right, that trees were taken down but they were done (in
house). He also mentioned street paving and they are trimming
trees.
BOARD OF EDUCATION: Committee Chairperson Santoro said
had a meeting with the Board of Education. She said the
Superintendent would like to meet with the Mayor to discuss the
budget. The school bids on the sewer project on the school should
be back. If it could be voted on this month the work would begin
on Easter and hopefully that situation would be corrected with the
DEP. Also they are possibly looking to go out for bids for the
Nathan Hale and High School Project by June. The next meeting
would be June 5th at 10:00 A.M. and she asked if any other
Councilmembers would like to attend. She said on Monday
morning she will be attending a seminar about teenagers with the
High School Principal and another teacher down in Jamesburg. She
apologized for when she was asked a question at last month's
meeting about something that happened in the High School and at
the time she did not know the information. She did find out
afterwards that there had been an incident with a locker fire. They
were concerned in whether the High School was safe and she
inquired with School Officials and found we do have fire detectors
but we don't have sprinklers, they weren't required. The cameras
in the school caught the person responsible and they have also
caught vandals and a robbery. She thinks that is a great situation at
the High School.

The Mayor read the following Proclamation:
"CENSUS 2000 AWARENESS WEEK"
WHEREAS, the Census is vital to our community in that it
determines the apportionment of seats in the U.S. House of
Representatives and the State Legislature and is the basis for the

allocation of billions of dollars of federal, state, county and local
funds for social and other programs; and
WHEREAS, the Census is also used to help determine where to
locate schools, day care centers, hospitals and other facilities and is
used to make decisions concerning business growth and jobs; and
WHEREAS, Census information is confidential and Federal Law
prohibits any public or private agency from gaining access to
individual Census data; and
WHEREAS, in the Borough of Carteret we are committed to a full
and accurate Census 2000 count and are placing special emphasis
on enumerating members of population groups traditionally
undercounted;
NOW, THEREFORE, DO I JAMES A. FAILACE, hereby
proclaim the week of April I, 2000 as
"CENSUS 2000 AWARENESS WEEK"
in Carteret. We urge all of our residents to fill out their CENSUS
2000 forms and return them to the Census Bureau.
Mayor Failace then urged the people of Carteret to please fill out
their Census Forms. He said it means money to us.
Mayor Failace then said he would like to add to Councilmember
Quinone's statement about Sergeant Zubenko. He said he was
sorry he did not stop him the night of the Council Meeting. He said
personally his statements were personally offensive to him and he
was appauled at the comfort at which the statements were made.
They were talking about Chrome and he applauded Daphne Miles.
He commented that she did what she had to do. He said it had gone
to the Prosecutors and it may come back to us and then he will ask
for a Hearing Officer for this.
Upon MMS&C by Councilmembers Crilley and Fazekas and
unanimous affirmative vote of the full Council present the meeting
was declared open for Public Discussion.
John Sudia said he was looking at the Bill List and he saw that we
were still spending money on Stowell.
Mayor Failace said we are because there are some cases that are
still going on and they have to be finished and it would be
ridiculous to go with another lawyer.
John said he heard Stowell might be leaving the legal profession
and going into the ministry.

Ron Simon, Coordinator for Emergency Management then spoke.
He handed over two (2) checks to the Mayor and Council from the
Federal Government for reimbursement for overtime spent by the
Borough during Hurricane Floyd at the Sewer Department. He
commented that they had filed up to $101,000.00 and hopefully we
will get all the money.
Mayor Failace complimented Emergency Management, the Police
and Fire Departments and everyone else that helped during
Hurricane Floyd.

Benjamin Giordino then spoke. He questioned why the traffic light
at Pershing Avenue was removed. It is not safe. He spoke about
Chrome Park being totally neglected. He then made reference to
the officer that made that comment that they spoke about earlier in
the meeting and he said he may have made a mistake but he is
still wrong. He suggested having a Youth Building set up there.
Mayor Failace agreed with him and he said that this and last year's
Council have certainly committed themselves to spending some
money down there and doing what they can.
Councilmember Crilley suggested our Council Meetings be put on
television so everyone can see what is going on. He said they are
having a complete renovation of Chrome Park.
A resident of Chrome complained that every year they are
promised the same thing and nothing is being done.
Councilmember Crilley continued to speak saying that they have
purchased the equipment for the park but they had to wait for the
spring weather to start putting it up. He said the funding for the
Basketball Court is already here. He spoke on how they are going
to start to clean up Roosevelt A venue.

Mayor Failace said they have promised to start this work this year
and they have and he told Mr. Giordano he would look into the
light.
Bill Nix, 37 Mercer Street, then spoke. He said he was concerned
about the remarks made at the last two (2) meetings. He said it is
sad to sit and listen to degrade the wrong people and he said they
will not accept any excuses. This man was a leader in our
community (Zubenko) who stated he was off duty but he wasn't
and if he carries himself that way and he expects kids to respect
him he will not get it that way. He said Mr. Gruhin made a
statement blaming the community for his downfall. He said it is
not the community. Urban renewals and the shopping malls put
him out of business. He said it is the responsibility of the store
owners to keep Roosevelt Avenue clean. He asked that the Health
Department close them down if they don't. He said most of the
people of Chrome are originally from Carteret and it has the most
historic areas. Most towns revitalize those areas not tear them
down. He then went on to say that there is a rumor that on Edwin
Street a Taxi Cab Company is coming in there. He said it is there
but they will not get a title. He commented that area is residential
and they don't want or need that in that area. He also said that all
our police needs sensitivity training.
Greg Denton, PBA Local 47 asked Councilmember Quinones
where she got her information about us getting closer now than we
were as far as our work hours are concerned.
Councilmember Quinones said she got that information from her
attorney who spoke to their representative.
Greg Denton said that it wasn't correct. They hadn't even had a
meeting since January 29th.
Councilmember Quinones said they hadn't changed their schedule.
Mayor Failace agreed saying because in discussions with our
attorney we felt there was a possibility that there would be some
changes in the Police Department that the PBA would agree to. He
admits that you came to the last meeting and told them that even
though they tried to go to a four, four, twelve and it would have
given them the police on the streets that they took it off the table.
He commented that he wants the public to know they are really
trying to put officers on the street.
Councilmember Quinones told him he only speaks for one (I)
organization and her opinion only is that he speaks for a small
number of people and other officers have spoken to her and told
her different things.

Councilmember Quinones said she would not do that. She is
surprised that he is raising the issue now because it is like he does
not want that to happen.
Greg said he only said that because he and any other PBA
members present will tell her that they are no closer to working out
their hours.
Mayor Failace said he did not want to bring this up, but since he
said that we are lying, the fact of the matter is that they offered
another schedule which would keep the four and four for the police
officers, that would put more police officers out on the street. They
weren't thrilled with that schedule but we thought maybe we could
get this done. They told us no way and it was taken off the table.
He said that we are really trying to negotiate and if he needs be and
they fall as flat as Officer Denton says they are, he will ask the
Council to change the schedule and he will take the chance in
court.
Blanche Robinson, I 3 Mercer Street then spoke concerning a
muddy, garbage filled hole by their houses that the Housing
Authority doesn't own. The town owns that land. She feels the
hole poses danger to the children and it draws mosquitoes. She had
spoken to Daphne Miles who had spoken to Ted Surick and he told
Daphne that he was going to see that it was filled in.
Mayor Failace told her he would speak to Ted Surick about it the
next day.
Seisha Caldwell spoke for the children of Chrome. She said there
is nothing for these children to do and she said there is drugs in the
area. She complained that there is no transportation for after school
activities for the children and she said Chrome Park is always full
of debris and is not cleaned often enough. She has been a victim of
the Carteret Police Department and commented that there is no
minorities in the Department to relate to the minority people and
there should be.
Councilmember Quinones then commented that in the most part
they do have a Police Department that treats people appropriately
and she cannot comment on people being victims because they are
in litigation.
Seisha said the whole department is white.
Councilmember Quinones said last year they hired the first woman
and first minority Police Officer. She said they have to go by the
list and if minority people are not taking the exam then they can't
do anything.
Seisha said she knew of a black woman that has been trying to get
a date for the exam.

Councilmember Quinones said if she contacted her or Director Elg
they would have given her that information.
Seisha said she took the test for Correction's Officer to give her a
push. She questioned if someone could come out and recruit to the
community.
Councilmember Quinones agreed with the suggestion.
Seisha said not to fault the children of the community.
Mayor Failace said they wouldn't.
Leonard Kinch spoke about not having decent equipment In
Chrome Park.
Mayor Failace told him they were tearing the existing swings down
and putting up new ones.
Pastor Collins from the AME Zion Church commended the Mayor,
who had reached out to him and the community. He said that the
people here tonight agreed with him, wanting to see a change in
Chrome and spoke about the vacant buildings there and said he
also owns a small one and he is willing to provide it for their use.
If there is repairs they can rebuild. He would like to see Chrome
referred to an asset to the Community not a Liability from this day
on.
Tom Lang, Colgan Avenue then spoke. He questioned how the
Recreation Building was insured.
Mayor Failace said we have insurance.
Councilmember Santoro said the groups have their own.
Councilmember Crilley said they have their own and the Borough
also has a Blanket Insurance to help them out an example being
when the Pitching Machine was stolen.
Tom Lang asked if that was going to be replaced.
Councilmember Crilley said the requisition has already been
signed.
Tom Lang spoke about the Sports Building having an alarm
system.
Councilmember Santoro said she met with the three (3) groups
over at the Recreation Building and they are looking to change the
keys and getting more coordination of the activities within the
group.

commended the Police Department. He saw today numerous police
in marked and unmarked cars, patrolling the area, looking for what
may of happened in the last few days. Then he went on to speak
about the Turnpike traffic saying that he had asked the Council to
inquire about some scheduling from the Turnpike Authority and
his answer was they got no response. He said this answer was
unacceptable to him and he suggested asking the people that work
for the Turnpike from Carteret about this . He wants to know when
the third booth opens up, how much traffic is required. He also said
the U-Turn sign was taken down and commented on how the State
Police, when pulling over a truck, tell them to go into McDonald's
parking lot and he doesn't feel that is right.
Councilmember Quinones said they will look into the State Police
matter and get back to him.
Tom Lang also said he is reserving his judgment for the Rent-A-
Cop (Specials). He doesn't feel they receive adequate training.
Mayor Failace said they go to the academy just like a regular
police officer.
Councilmember Quinones said she wants to look into having them.
Tom Lang asked if he could have an update on the stop sign at the
next Council Meeting.
Judy Leshko, 53 Atlantic Street, spoke. She asked Councilmember
Crilley if they could get someone over at the Grant Avenue Field
to clean it up, it is a mess and there is big holes in the field.
Councilmember Crilley said they would have it repaired by next
week.
Police Director Chris Elg spoke on behalf of the Police Department
saying that the officers provide good service to the people of
Carteret. They are very dedicated and they will continue to take
steps to make the service better.
Mrs. Nichols, 64 Dorothy Street spoke. She said she realizes that
the statement made by the police officer may not have been
intentional and that all the officers may not use that form of
semantics. She asked the Mayor that he and Daphne Miles,
Reverend Collins and herself be on a committee to address such
issues and asked if there is hope for this committee to be vitalized.
Mayor Failace said he had just spoken to the County and within the
next couple of weeks it will move forward and be done.
Stanley Gutowski spoke asking Councilmember Sohayda what he
doesn't like about the budget.

Councilmember Sohayda said he doesn't like the fact that the
Backhoe and the Steamroller and the Salts Shed haven't been
addressed and the issues of what is (inaudible).
Stanley Gutowski asked him if it was strictly the Department of
Public Works.
Councilmember Sohayda said yes.
Mr. Gutowski asked him if he understood if he does not vote to
Amend the Budget and it doesn't pass, then the Borough workers
won't get paid, if the Borough gets shut down.
Councilmember Sohayda said he was aware of that and then
commented that they had enough votes anyway.
Mr. Gutowski said he did not think that was the point and then
asked him if he addressed these concerns with the Finance
Committee.
Councilmember Sohayda said he was never asked by the Finance
Committee about any of these.
Mr. Gutowski asked him what happened at the Budget Hearings
because he knew he had sat in on one for many hours.
Councilmember Sohayda said he was sure he made himself clear in
what he was in need for, for the Department of Public Works.
Mr. Gutowski asked him how much those things would cost.
Councilmember Sohayda said he was not familiar with the cost of
them at this time.
Mr. Gutowski commented that he voted down the whole budget
without knowing what those items cost and that he had at one
time also voted, No, to Introduce the budget, he voted once to
Amend and he also voted to Abstain from it, but yet he voted to
pay the bills.
Councilmember Sohayda he understood the budget would not be
passed anyway, until June or July and he said he does agree the
bills should be paid.
Mr. Gutowski asked him how they would pay the bills without the
budget.
Councilmember Sohayda commented that he guessed in June they
would find out.
Councilmember Crilley said he wanted to address some comments
Mr. Sohayda made. He said first of all he cut nothing, but he made
recommendations to the Council for areas of the budget that he
would cut. He did suggest that $10,000.00 be cut but he doesn't

remember off the top of his head what it was for. All of the
suggestions that he made in the different budgets and he addressed
all of them, were in areas that were increased greatly over the
previous years. He spoke of some examples.
Councilmember Quinones said she thinks that everyones budgets
were cut and her budget, the Police Budget, took the biggest hit,
but, she realizes that the bills have to be paid so she voted for the
Amendment to the Temporary Budget.
Mayor Failace said we did discuss appropriating a million dollars
through a bond issue so it doesn't hurt the taxpayer, in order to get
the equipment we need and whether we do get the equipment or
not, we still need to amend the budget in order to run the town.
Daphne Miles, 25 Pulaski A venue, she commented that she and
other people present did not know who Police Director Elg was.
She commented that any building they would be given they would
buy, they don't expect to be given anything. She then went on to
say if she was present at the meeting when Officer Zubenko made
his comments she would have commented then, but she did
purchase the tapes. She also commented that she and all the other
children down Chrome know who their father is. She said no
public official has the right to get up in a public form and make
statements like that and now putting all the children of Carteret in
his statement still makes it racist, because racist and bias is not
black, white, etc., he made a racist remark, the conversation with
graffitti with the youths of Chrome and he went and he agreed to
what was being said about our youths in Chrome. She commented
that he could never change what was on that tape and she said she
doesn't now who Sergeant Zubenko is and she is not out to lynch
him, fire him or have him lose a day's pay, but, she is looking for
him to apologize to their youth because they deserve it.
An unidentified woman present congratulated the Mayor saying
that she did vote for him She said she wanted to set an example
here of the neglect of Chrome. She said she didn't know exactly
where this baseball field is located but she knows it isn't in
Chrome. She went on to speak about Mrs. Robinson who spoke
about the mud hole that should be covered and commented that
she was given no answer.
Mayor Failace said he would call Ted Surick the next morning
about that hole.
Mike Yavorsky then spoke. He said he wanted to make the Mayor
and Council aware that there is a lot of pools in Carteret that have
covers with stagnant water on them and he feels that mosquitoes
will breed on there and he spoke about the problem we will be
having with mosquitoes this year. He asked if the Board of Health
could have the people drain the water from them.

Mayor Failace said he spoke to the Board of Health about this
during the week about what they could do for the problem with the
mosquitoes.
Mike Yavorsky spoke about last year they scraped the ball fields
everyday and he spoke about watering them down everyday. The
dust balls have to be prevented because if you don't and you live in
that area, everything by your home gets filled of dust.
Councilmember Crilley said he can't think of a cost efficient way
to do that.
Mr. Yavorsky said maybe somebody can donate a water tank.
Councilmember Crilley said about fifteen (15) years ago there were
about twenty (20) park employees and now there is seven (7). The
staff if not quite what it should be. To increase it would effect our
taxes. He said he would look at the problem again.
John Sudia said mentioned that Joe Green should be brought back.
He was a highly qualified police officer that was part of a Federal
Program and the fact that the Federal Funds ran out, meant he lost
his job. He also said they had Special Police Department many
years ago but it was disbanded because of insurance reasons. He
would suggest rather than think about six (6) or seven (7) or eight
(8) Specialty Police, that they give Police Director Elg the three (4)
or four (4) policemen he has.
Stanley Gutowski said on behalf of the Special Police, it is a good
idea and they are trained at the Academy and it gives us the
opportunity to do what the Councilmember said she couldn't do,
which is to be selective. You can't be selective off that list. It gives
the Council an opportunity to hire members of the community.
John Sudia said he disagreed and commented that we jumped the
list before.
Mayor Failace said we didn't do that. Civil Service wouldn't allow
us to do that.
There being no further business or discussion, upon MMS&C by
Councilmembers Crilley and Fazekas and unanimous affirmative
vote of the full Council present this meeting was adjourned at
approximately 9:20 P.M.
