HomeMy Public PortalAbout2000/04/06 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Council President Remy Quinones at 7:30 P.M., Municipal Court!Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Monday, April 24, 2000. Upon individual roll call vote, the following were noted present: Council President Remy Quinones Councilmember Patrick Crilley " Jack Fazekas " James O'Brien " Janet Santoro " Alexander Sohayda Noted absent was Mayor James A. Failace Also noted present was Borough Attorney Craig Coughlin " Business Administrator Nick Goldsack The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Council President Remy Quinones. The Clerk stated that in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to the Home News Tribune, The Star Ledger and posted on the bulletin board on April 19, 2000. Upon MMS&C, by Councilmembers O'Brien and Fazekas and unanimous affirmative vote of the full members present, the minutes of March 2, 2000 were approved as transcribed and engrossed by the Clerk. The Clerk stated that Ordinance #00-16 was introduced and adopted on the First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held on May 4, 2000, upon MMS&C by Councilmembers Crilley and O'Brien. Upon individual roll call vote, Councilmembers Crilley, Fazekas, O'Brien, Quinones and Sohayda voted in the affirmative. Councilmember Santoro voted no. ORDINANCE # 00-16 "AN ORDINANCE TO AMEND ORDINANCE #71-9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PAYMENT OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" 1. The Clerk stated that Ordinance #00-17 was introduced and tabled on First Reading. Upon MMS&C, by Councilmembers Quinones and Santoro. Upon individual roll call vote, Councilmembers Crilley, Fazekas, O'Brien, Quinones, Santoro and Sohayda voted in the affirmative to table. ORDINANCE #00-17 "BOND ORDINANCE PROVIDING FOR VARIOUS CAPITAL IMPROVEMENTS OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY APPROPRIATING THE AGGREGATE AMOUNT OF $1,211,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $1,153,000 BONDS OR NOTES OF THE BOROUGH TO FINANCE PART OF THE COST THEREOF" Council President Remy Quinones said that a few of the Councilmembers wanted to table this Ordinance. We would prefer to discuss this at the next Agenda meeting. BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS: BOND ORDINANCE (Continued) Section 1. The several improvements described in Section 3 of this bond ordinance are hereby respectively authorized to be undertaken by the Borough of Carteret, New Jersey as general improvements. For the several improvements or purpose described in Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriation made for each improvement or purpose such sums amounting in the aggregate to $1,211,000, including the aggregate sum of $58,000 as the several down payments for the improvements or purposes required by the Local Bond Law. The down payments have been made available by virtue of provision for down payment or for capital improvement purposes in one or more previously adopted budgets. Section 2. In order to finance the cost of several improvements or purposes not covered by application of the several down payments, negotiable bonds are hereby authorized to be issued in the principal amount of $1, 153,000 pursuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law. Section 3. The several improvements hereby authorized and the several purposes for which the bonds are to be issued, the estimated cost of each improvement and the appropriation therefor, the estimated maximum amount of bonds or notes to be issued for each improvement and the period of usefulness of each improvement are as follows 2. Failace Councilmember Patrick Crilley " Jack Fazekas " James O'Brien " Remy Quinones Noted Absent was Councilmembers Janet Santoro and Buddy Sohayda, Borough Attorney Craig Coughlin and the Business Administrator Nicholas Goldsack. Also noted present was D. Walsh, Patrick De Blasio and Gary Higgins. The meeting was opened with a minute of silent prayer and the Pledge of Allegiance by Mayor James Failace. The Clerk stated that on March 31, 2000, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News Tribune, The Star Ledger and posted on the Bulletin Board. Upon MMS&C by Councilmembers O'Brien and Fazekas and unanimous affirmative vote of the four (4) Councilmembers present the Minutes of February 17,23 & 24, 2000 were approved and transcribed and engrossed by the Clerk. RESOLUTION #00-103 was introduced by the Mayor and referred to the Council for action. Councilmembers Santoro and Sohayda were noted absent. pUBliC HEARING Local ~cipal Budget Upon MMS&C by Councilmembers Fazekas and O'Brien and unanimous affirmative vote of the four (4) Councilmembers present the Mayor declared the Public Hearing on the 2000 Municipal Budget to be open. John Sudia said he granted that the Mayor had done everything to cut the budget. He asked if it was showing any tax rate increase in the Borough of Carteret. Mayor Failace said yes there is 9 cents. He explained that there are some major items in the budget that they have no control over like a $400,000.00 increase in hospitalization. There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing on the Budget to be closed upon MMS&C by Councilmembers Quinones and Fazekas and unanimous affirmative vote of the four (4) Councilmembers present. ORDINANCE 100-14 Amending (\ode, Chaoter lPO "Re: Land Developnent Re: Required Permits and Approvals ORDINANCE #00-14 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held April 24, 2000, upon MMS&C by Councilmembers O'Brien and Fazekas. Upon individual roll call vote Councilmembers Crilley, Fazekas, O'Brien and Quinones voted in the affirmative. Councilmembers Santoro and Sohayda were noted absent. First Reading "AN ORDINANCE AMENDING CHAPTER 160 LAND DEVELOPMENT OF THE BOROUGH CODE OF THE BOROUGH OF CARTERET" ORDINANCE 100-15 Capital Improvanent Appropriating $25,000 Re: Underground Storage Tank Removal ORDINANCE #00-15 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held April 24, 2000, upon MMS&C by Councilmembers Fazekas and O'Brien. Upon individual roll call vote Councilmembers Crilley, Fazekas, O'Brien and Quinones voted in the affirmative. Councilmembers Santoro and Sohayda were noted absent. It was duly published in The Home News Tribune on March 21, 2000 with notice that it will be considered for final passage after Public Hearing to be held on April 6, 2000 at approximately 7:30 P.M. The Ordinance was posted on the Bulletin Board and copies were made available to the general public and according to law she read the Ordinance by title. Upon MMS&C by Councilmembers Fazekas and O'Brien and unanimous affirmative vote of the four (4) Councilmembers present the Mayor declared the Public Hearing opened. There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C by Councilmembers Quinones and Fazekas and unanimous affirmative vote of the four (4) Councilmembers present. BUILDINGS & GROUNDS: In the absence of Committee Chairperson Santoro, Committee Member O'Brien reported for her stating on the 24th she will be in a meeting in Trenton with Jane Kennedy and the Department of Community Affairs to review Assembly Bill A2295, which is the (inaudible) of Borough Hall. We are waiting for the test results of the Microbile Testing. We are also waiting for the Structural Report on the Firehouse. He reported Progress. FINANCE AND ADMINISTRATION: Committee Chairperson O'Brien reported that they had a Public Hearing on the Budget. It was a tight budget with a nine point increase including some things we had no control over. We have been applying for the $600,000.00 from the state and we are still waiting to hear from them. He also asked anyone who had not sent in their Census Form to please do so. FIRE: Committee Chairperson Fazekas reported that in the month of March the Fire Department responded to sixty-five (65) calls. On April 15 there will be training on the holmatro tool. April, May and June will be Safety Awareness Months and Carteret Fire Department will be sponsoring CPR Classes and First Aid. On April 25th at 7:00 P.M., the Carteret Fire Department will be offering a free CPR Class It will be first come, first serve. If the response is good we will probably be offering more. He then moved along. PARKS & RECREATION/SHADE TREE Committee Chairperson Crilley reported that at the Agenda Meeting last week they brought in Game Time which is a company from South Jersey that sells Recreation Equipment throughout the state. He said the Cornell Park in West Carteret will be the first park to be done. The program they are showing would cost $43,000.00 for the program. He explained that we are mandated by the State of New Jersey to not only make our parks ADA compliant but also by 2005 we have to have all the Safety Requirements that they suggest in all our parks. He said it will cost us approximately another $15,000.00 to $17,000.00. He said along with that they will also do Chrome Park. They received funds from Community Development. By the end of next year three (3) parks, West Carteret, Chrome and Grant Ave., will be done. He urged the people that live in those neighborhoods to form some kind of Neighborhood Watch Groups to protect their park. In five (5) years we will probably spend close to a million dollars. He mentioned that they will do the Basketball Courts in Chrome and the Basketball and Tennis Courts in Carteret Park. The Little League Parade is a week from Saturday, April 15th at 11:00 a.m. at the park. The Easter Egg Hunt is April 16th, 2:00 p.m., at Carteret Park at the Monument. He thanked the Recreation Committee, they were put on the Three (3) and Three (3) Tournament at the High School for Middle School and High School kids and it was a great success. POLICE: Committee Chairperson Quinones reported a tragic incident and an almost tragic incident. In West Carteret there was a traffic accident in which Robert Buss died and at St. Demetrius, seventy five (75) to one hundred (100) young adults were attending a Birthday Party there and some other kids from Elizabeth, who were members of a gang, showed up and had a fight. The police showed up and did what they could. Officer Csimbok was injured. She asked Director Elg to look into the party and see if there was alcohol served. There was another incident in which a young boy who obtained a gun from his uncle, who was his guardian. The child became missing along with the gun and it was reported to the police Department and officers heard about it through the scanner and found the young man and reported it to Lieutenant Talalai and they were able to stop him before there was a tragic incident. She thanked the Police Department, who she thinks did a great job. There has been some further arrests which stem from the Special Investigations Unit and some drug arrests. This unit is continuing to work very well and she would like the program to continue. She went on to say the resolution of the determination made by the Prosecutor's Office in reference to Officer Zubenko was that the statements made by him at the Council Meeting were not sufficient or the caliber that would classify them as a bias incident. They did not find that he did anything criminal, however they suggested discipline and she will recommend to director Elg to follow up on that. Without getting into a lot of details of this, before it is resolved she wanted to say that one (I) of the aspects of discipline would be some Sensitivity Training, which she feels would be very appropriate. Then she said in regard to a decision as to hiring any officers, the amount of officers and lor whether we are going to hire Special Officers she would like to report as of early this evening, they are still in negotiations with the Police Department and before she makes any final recommendations she would like to see what the results and progress of these Negotiations Session turns out to be, at least with the Specials, which she supports doing, because it broadens the scope of the applicants that she would consider and would assist the police 1 Department in hiring more women and minorities which she thinks is very important. She reported Progress. PUBLIC WORKS: In the absence of Committee Chairperson Sohayda, Committee Member O'Brien reported Progress. BOARD OF EDUCATION: In the absence of Committee Chairperson Santoro, Committee Member O'Brien said the School Board Election is April 18th and he then reported Progress. Mayor Failace then said he had a few things to speak on. He said we received a Grant from the Transportation Trust Fund for #300,000.00 in reference to the water problem we have on Beverly Street. They are giving us that money to cross the Industrial Road. We have put in for some Federal money for 2.5 million dollars to continue that project so we can eliminate the terrible water problem they have in that area. He commented about the heat they have gotten on what we have spent on our engineers, but since Killam has been our engineers they have gotten us close to a million dollars in free money. This is how we have we have done Hagaman Street, Sycamore Street and Louis Street. He also commented that looking over their bills they are 3% to 5% lower on the State Average that other municipalities pay their engineers. At approximately 8:05 p.m., Councilmember Sohayda was noted present. Mayor Failace then went on to speak. He said last week the CEO of the Middlesex County Opportunities Corporation and some of the citizens came to them in reference to bringing the approximate thirty (30) children we have in the Head Start Program in Perth Amboy back to Carteret. He has committed to him, along with Doctor Vita, that they will bring the children back. He then spoke on creating a Mayor's Advisory Council with members from each section of town and various groups, to become part of this commission. He said the meeting would be on a monthly basis. He spoke shortly on this. He then went on to say that he went to The Girl Scouts Spaghetti Dinner and he spoke with one of their District Leaders and they said they wanted to have two (2) troops in Chrome and he told them that he would do whatever is necessary to help them. Shawn Seymore then spoke. He is the president of the Tenant's Association for Carteret Housing and is also involved in Head Start. He also thanked the mayor. Patricia Rodriquez thanked the mayor for helping with Headstart and she said Chrome is also looking better. She did say the abandoned buildings still need help. Mayor Failace said Councilmember Crilley had requested a list of the abandoned buildings because they do want to move forward on that. Patricia Rodriquez also wrote a Letter to the Editor, which the newspaper said they would publish but they had to edit because it was challenging Cristy Todd Whitman to come down and tour the area because we need funding. A lady, who is a citizen of Carteret, also thanked the mayor about Headstart. A male citizen also thanked the mayor about Headstart and for his sincerity, candor, accessibility and his ability to attract the other dollars to make it work. Pat Tozzi spoke thanking the Mayor and Council for considering abolishing the Board of Education Committee. He feels it is a useless, worthless committee. John Sudia spoke saying we had a great Head Start Program in the 1980's. He then spoke regarding State Mandates, suggesting to reorganize a small city Mayor's Association and then go to the state. Barbara Arena from Hudson Street and she asked about getting a Pre-Kindergarten in Columbus School. Mayor Failace said she would have to go through the Board of Education. Barbara Arena then asked if the city owned vacant lots are going to be cleaned up. Mayor Failace said they would be. Barbara Arena said there is more lighting needed by Chrome Park. Councilmember Crilley said in reference to her Pre-Kindergarten question, the Board of Education put sixty (60) kids into a program this year and by next year it will double. By 2001 they are mandated to do the whole Borough. Barbara Arena commented on how overcrowded the schools are and questioned where the new children would be going. Rose Alice Capp asked about again starting a Human Relations Committee that they had two (2) years ago. Mayor Failace said he has been in contact with the state and hopefully within the next month or so it will move forward, not with him Chairing it but with a citizen Chairing it. Barbara Arena asked if there is any truth that they will be putting down street signs on Chrome Avenue and Warren Avenue, etc. Mayor Failace said they will try.
