ORDINANCE NO. 1044 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SECTION 32-49 OF THE LYNWOOD CITY CODE RELATING TO WATER RATES. 1 THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES ORDAIN AS FOLLOWS: SECTION 1. Section 32-49 of the Lynwood City Code hereby is amended to read as follows: SECTION 32-49. Meter Rates Established. For water served through meters, the monthly charge shall be as follows: (a) Readiness to serve charges There shall be charged and collected a monthly readiness to serve charge from each customer for each meter on the basis of the following schedule: 5/8" and 3/4" .............................$ 2.00 1" ......................................... 3.00 1-1/2" ..................................... 6.00 2" .. ...................................... 9.00 3" ........................................ 17.00 4" ... 6" ........................................ 30.00 ................................... 40.00 8" ........................................ 70.00 A readiness to serve charge shall not be subject to refund or proration if service to any customer is terminated during any monthly period. (b) Quantity Charge. In addition to the readiness to serve charge set forth in this subsection, the rate supplied to consumers through a meter shall be as follows: For any and all consumption in cubic feet per month, forty-five cents ($0.45) per one hundred (100) cubic feet or fraction thereof. SECTION 2. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of com- petent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 3. The City Clerk hereby is authorized and directed to cause a copy of this ordinance to be published in the LYNWOOD PRESS, a newspaper of general circulation in the City, within fifteen (15) days after the adoption hereof. First read at an adjourned regular meeting of the City Council of said City held on the 23'.day of June, 1978, and finally adopted and ordered published at an adjourned regular meeting of said Council held on the 29 of June, 1978, by the following vote: AYES: COUNCILMEN BYORK, MORRIS, ROWE, HIGGINS NOES: COUNCILMEN NONE.
