AN INTERIM URGENCY ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF LYNWOOD PROHIBITING
SECOND-HAND DEALERS IN THE COMMERCIAL ZONES
OF SAID CITY.
THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY DOES ORDAIN
AS FOLLOWS:
SECTION 1. Any provision of Ordinance No. 570, the Zoning
Ordinance of the City of Lynwood; to the contrary notwith-
standing, no second-hand dealer shall be permitted in any of
the commercially zoned areas of said City. For the purposes
of this ordinance, a second-hand dealer is any person, the
major portion of whose business constitutes the buying, selling,
or otherwise dealing in second-hand goods, wares or merchandise.
SECTION 2. This ordinance is an interim urgency ordinance
adopted pursuant to the provisions of Government Code Section
65858, to protect the public safety, health and welfare and,
in accordance with said provisions, it shall take effect imme-
diately upon adoption. The City Council hereby declares that
it intends to study a zoning proposal regulating the use of
commercially zoned property for use as a second-hand store and
that the permitting of such uses during the pendency of said
study may result in a conflict with a contemplated zoning pro-
posal.
SECTION 3. If any section, subsection, subdivision, sentence,
clause, phrase, or portion of this ordinance, or the application
thereof to any person or place, is for any reason held to be
invalid or unconstitutional by the decision of any court of com-
petent jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance or its application
to other persons or places. The City Council hereby declares
that it would have adopted this ordinance, and each section,
subsection, subdivision, sentence, clause, phrase or portion
thereof, irrespective of the fact that any one or more sections,
subsections, subdivisions, sentences, clauses, phrases, or
portions or the application thereof to any person or place,
be declared invalid or unconstitutional.
SECTION 4. The City Clerk hereby is authorized and directed
to cause a copy of this ordinance to be published in the LYNWOOD
PRESS, a newspaper of general circulation in the City, within
fifteen (15) days after the adoption hereof.
Introduced and adopted at a regular meeting of the City
Council of said City held on the 18th day of July, 1978, and
finally adopted and ordered published at a regular meeting of
said Council held on the 18th day of July, 1978 by the following
vote:
AYES: COUNCILMEN BYORK, GREEN, MORRIS, ROWE, HIGGINS.
