ORDINANCE NO. 97-3
AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA; AMENDING CHAPTER 33 OF THE CODE OF
METROPOLITAN DADE COUNTY AS MADE APPLICABLE TO
THE VILLAGE PURSUANT TO ARTICLE 8 OF THE
VILLAGE CHARTER; ADDING POST -GRADUATE
PROFESSIONAL EDUCATIONAL FACILITIES AS AN
UNUSUAL USE; PROVIDING FOR SEVERABILITY,
INCLUSION IN THE CODE AND AN EFFECTIVE DATE.
WHEREAS, pursuant to Article 8 of the Charter of the Village
of Key Biscayne certain ordinances of Metropolitan Dade County are
made applicable to the Village as municipal ordinances, including
Chapter 33 of the Dade County Code (the "Zoning Code"); and
WHEREAS, the Zoning Code contains a list of certain unusual
uses which are permitted after a public hearing; and
WHEREAS, this Board is of the opinion that Post -Graduate
Professional Educational Facilities should be added to the list of
unusual uses;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. That Section 33-13(e) of the Code of
Metropolitan Dade County as made applicable to the Village is
hereby amended to add "Post -Graduate Professional Educational
Facilities" as an unusual use.
Section 2. Severability. The provisions of this Ordinance
are declared to be severable and if any section, sentence, clause
or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the
validity of the remaining sections, sentences, clauses, and phrases
of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding
the invalidity of any part.
Section 3. Inclusion in the Code. It is the intention of the
Board of Trustees, and it is hereby ordained that the provisions of
this Ordinance shall become and made a part of the Village of Key
Biscayne Code; that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that
the word "Ordinance" shall be changed to "Section" or other
appropriate word.
Section 4. Effective Date. This Ordinance shall be effective
upon adoption on second reading.
