HomeMy Public PortalAboutOrd. 1055 ~, ORDINANCE IdO. 1055 AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD PROHIBIT- ING CERTAIN USES IN THE R-3 MULTIPLE FAMILY ZOiQE The City Council of the City of Lynwood DOES HEREBY ORDAIN as follows: SECTIOiQ 1. No building shall be erected, construct- ed, established, enlarged, or moved into or within the R-3 multiple Family Zone except a building which is specifically permitted to be erected, constructed, established, enlarged, or moved into or within the R-1 One Family Zone. No land in the R-3 ~4ultiple Family Zone shall be used or occupied, except for a purpose specifically permitted in the R-1 One Family Zone. SEC'T'ION 2. This ordinance is adopted pursuant to Government Code Section 65858 and shall take effect immed- iately as an interim urgency ordinance. With respect there- to, the City Council hereby finds and determines that the Planning Department is studying a new zoning ordinance with particular emphasis being given to multiple family residen- tial development and this ordinance is necessary to prohibit uses which may be incompatible with the provisions of such new zoning ordinance relating to multiple family dwellings. SECTION 3. Unless further extended pursuant to Government Code Section 65858 the ordinance shall expire and be of no further force or effect four months from the date of the adoption hereof. SECTION 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining por- tions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or rnore sections, sub- sections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional SECTION 5. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published and circulated in the City of Lynwood.
