Call to order: Chairman called the meeting to order at 7:00PM. Others present: Nancy Ellis Ice, MPH, CHO, RS, Health Director and Tammi Mason, Senior Department Assistant. 1. Chairman's announcements Mr. Skidmore spoke about himself and Nancy Ellis Ice being interviewed by the Government Study Committee. 2. J.C. Ellis Design Co.—continued local variance request for 72 Wynn Way Jason Ellis was present. He is requesting the following variance for his client: 1. To allow the proposed SAS to be located 229' from Upper Mill Pond They will be replacing the current 1978 4 bedroom system of a tank and 2 pits. Mr. Skidmore asked why they are replacing the system. Mr. Ellis stated that the owner would like to add a greenhouse and a deck to the property. Mr. Skidmore stated that the 1978 permit says it is a 3 bedroom home. Mr. Ellis stated that it is currently a 4 bedroom home. The lot is 17,964sf. Motion: Approve the variance request, finding that the SAS will be 229' from the pond, the system will be perpendicular to the groundwater flow and it is an improvement over what is currently there. Waive the Deed Restriction regulation. Motion: Joanne Hughes Second: Dr. Mary Chaffee Vote: 5-0-0 Action: Motion carried 3. Coastal Engineering—local variance requests for 840 Harwich Road —Maplewood at Brewster David Michniewicz was present. The applicant is seeking relief from Brewster's "Design, Operation and Maintenance of a Small Wastewater Treatment Facilities" regulation. This property will house 66 assisted living units and 66 memory care units. The design flow is just above 19,000gpd. This requires that a Groundwater Discharge Permit be issued by DEP. Soil testing has been done and monitoring wells were installed in 2011. The GDP was applied for in October and the DEP did issues a draft GPD. The reason for asking for relief is that the Brewster regulation mirrors what the DEP requirements are Mrs. Hughes voiced her concern that if relief was given, the Board would never hear from them again or know if the system was operating as it should be. Mrs. Ice stated that they would still be required to give an annual report. Motion: Approve request for relief from the Design, Operation and Maintenance of a Small Wastewater Treatment Facility with the exception of Section 8.00-Reporting. Motion: Annie Dugan Second: Dr. Scherzo Vote: 5-0-0 Action: Motion carried 4. Oceanside Septic- Title 5 variance request for 26 eagle Wing Cartway Linda Pinto was present. This is an existing 3 bedroom home that the owners want to add a 4th bedroom to They are requesting the following variance: 1. To allow the proposed SAS to be 11 feet from the crawl space Ms. Dugan asked about lining the crawl space. Mrs. Pinto stated that if they put a liner around the crawl space it would be sticking up in the air. Motion: Grant the variance for Oceanside Plan OS 14076, dated 10/20/2014, finding that there would be no detrimental effect on the public health and the system will be 1' below the bottom of the crawl space. Motion: Joanne Hughes Second: Dr. Mary Chaffee Vote: 5-0-0 Action: Motion carried 5. Bass River Engineering- Local variance request for Lot 137 Pine Ridge Road Tom McClellan was present. This is a vacant lot where a 3 bedroom home is being proposed. There is no town water available on this property so it will have a well There is 1 SAS within the zone of contribution and the well will be 180' away from the proposed well It was stated that groundwater is flowing in a northerly direction. Mr. Skidmore believes that annual well water testing should be done. Motion: Approve variance request with the stipulation that the well water be tested annually for 2 years. Motion: Joanne Hughes Second: Annie Dugan Vote: 5-0-0 Action: Motion carried 6. Law Offices of Paul Revere-request to extend variances issued for Hamilton Cartway Attorney Revere stated that variances were previously issued in November of 2013 and due to time delays they are looking to extend the variances for a year Motion: Grant a 6 month extension from the December 13, 2013 date. Motion: Joanne Hughes Second: Dr. Carmen Scherzo Vote: 5-0-0 Action: Motion carried 7. Discuss changes to the Bedroom Definition There was a brief discussion. Dr. Scherzo will do a re-write and get it back to the Board. 8. Discuss changes to the Regulation regarding Variance Requests Mr. Skidmore stated that he would like to see the following two changes: 3.3 A (3) should say "Upgrade of existing residential systems provided no additional design flow is proposed. 3.3 B (2) should say "In addition to meeting the requirements of Section 3.3 (a) above, agree to install water saving devices on all fixtures. If the Brewster Board of Health determines that it is necessary to protect the public health and the environment, it may require a deed restriction limiting the number of bedrooms permitted on the property to a number equal to or less than one bedroom per 10,000 square feet of buildable upland or a number determined by the Board of Health. Such deed restriction must be recorded at the Barnstable County Registry of Deeds to run with the title of the property. Motion: Approve changes with approval of Town Counsel. Bring the regulations with changes back before the Board and have a public hearing. Motion: Joanne Hughes Second: Annie Dugan Vote: 5-0-0 Action: Motion carried 9. Topics the Chairman did not anticipate There was talk about the occupancy issue and what Town Counsel said. This discussion will be continued to a later date. Dr. Scherzo stated that he is opposed to having an occupancy restriction. The Board discussed the meetings for December. It was agreed to only hold one on December 2, 2014. Informational items were noted. Meeting adjourned at 9:10PM
