HomeMy Public PortalAboutOrd. 1063ORDINANCE NO. 10(3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD FINDING AND DETERPIINING THAT TIIE PROVISIONS OF GOVERNMENT CODE SECTION 66424.2 WILL NOT BE APPLICABLE TO CERTAIIQ dUBDIVISIONS OF LAND The City Council of the City of Lynwood hereby does ordain as follows: SECTION 1. Section 29-4 hereby is added to the Code of the City of Lynwood to read as follows: Sec. 29-4. Non-merger of Certain Contiguous Parcels. :lotwithstanding the provisions of Government Code Sections 66424 and 66424.2, two or more contiguous parcels or units of land which have been created un- der the provisions of the Subdivision Map Act or any prior law regulating the division of land or a local ordinance enacted pursuant thereto (or which were not subject to such provisions at the time of their creation) shall merge by virtue of the fact that such contiguous parcels or units are held by the same owner if: (i) any one of such contiguous parcels or units held by the same owner does not conform to the standards for minimum parcel size to permit use or development under the provisions of the Zoning Ordin- ance of the City of Lynwood, and (ii) at least one of such contiguous parcels or units is not developed with a building for which a permit has been issued by the City or which was built prior to the time such permits were required by the City; provided, however, that such contiguous parcels of units of land shall not merge if none of them is less than seventy- five percent of the minimum parcel size to permit use or development under the Zoning Ordinance; and, pro- vided further, that in cases involving more than two such contiguous parcels or units the parcels or units shall be deemed to be merged only to the extent necessary to make all of them at least equal in area to seventy-five percent of such minimum parcel size. SECTION 2. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this Ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitu- tional by the decision of any court of competent jurisdic- tion, such decision shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sec- tions, subsections, subdivisions, sentences, clauses, phases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 3. The City Clem: is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published and cir- culated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 20th day ofP7arch, 1979 and finally ordered published at a regular meeting of said Council held on the rd day of April 1979.
