HomeMy Public PortalAboutOrd. 1065/ - ,. e, ORDINANCE tQO. 1065 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYiVWOOD AMENDING SECTION 17-27(d) OF THE CODE OF THE CITY OF LYIQWOOD RELATING TO EXEMPTIONS FROM BUSINESS LICENSE FEES The City Council of the City of Lynwood hereby does ordain as follows: SECTION 1. Section 17-27(cl) of the Code of the City of Lynwood hereby is amended to read as follows: (d) Ckiaritable Organizations. The city council may, upon a finding that a particular organization is a bona fide religious, charitable, fraternal, ed- ucational, military, veteran or municipal organi- zation or association contributions to which would be tax deductible, waive the requirement of a license £or the purpose of conducting or staging any enterprise where the receipts derived from the enterprise are to be used wholly for the benefit of the organization or for charitable purposes and not for the purpose of any private gain of any in- dividual or individuals. In the event any organi- zation of the type referred to herein merely spon- sors such an enterprise and receives only a percent- age of the receipts thereof, then the person con- ducting the enterprise on behalf of such organiza- tion shall pay such percentage of the otherwise applicable license fee prescribed in this article as is equal to the percentage of receipts payable by him for conducting the enterprise. Notwith- standing any of the foregoing, the city council shall not waive the requirements of a license for any organization proposing to engage in solicita- tion for a period of time longer than ~_ days. SECTION 2. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this Ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining por- tions of this Ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, sub- sections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 3. The City Clerk is hereby ordered and directed to certify to the passage of this Ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published and cir- culated in the City of Lynwood. ,- .
