AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD ADDING SECTION 12-10.1 TO THE CODE OF THE
CITY OF LYNWOOD RELATING TO THE SALE OF GASOLINE.
THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY DOES
ORDAIN AS FOLLOWS:
SECTION 1. SECTION 12-10.1 HEREBY IS ADDED TO THE
CODE OF THE CITY OF LYNWOOD TO READ AS FOLLOWS:
Section 12-10.1. Dispensing of gasoline. No delivery
of gasoline shall be made into a. portable container unless such
container is of material and construction approved pursuant to
the Uniform Fire Code, and has a tie closure with screwed or
spring cover, so designed that the contents can be dispensed
without spilling; and not more than one gallon of gasoline shall
be delivered into a portable container in connection with the
sale of gasoline.
SECTION 2. This ordinance is an urgency ordinance
and shall take effect immediately upon its adoption. The City
Council hereby finds and determines that on the basis of the
following facts, it is necessary that this ordinance take
effect immediately in order to protect the public health, safety,
and welfare. Said facts are as follows: The current shortage
of gasoline has resulted in a substantial increase in the kind
of gasoline sold for delivery into portable containers. Gasoline
carred and/or stored in portable containers which are not
approved pursuant to the Uniform Fire Code present an extreme
hazard of explosion and fire. In addition, the carrying and/or
storage of excessive amounts of gasoline in portable containers
present further danger of fire and explosion as well as
decreases the amount of gasoline available for purchase by
motorists who have immediate need for gasoline.
SECTION 3. Severability. If any section, subsection,
subdivision, sentence, clause, phrase, or portion of this ordin-
ance, or the application thereof to any person or place, is for
any reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions of this ordinance
or its application to other persons or places. The City Council
hereby declares that it would have adopted this ordinance,
and each section, subsection, subdivision, sentence, clause,
phrase or portion thereof, irrespective of the £act that any one
or more sections, subsections, subdivisions, sentences, clauses,
phrases, or portions, or the application thereof to any person
or place, be declared invalid or unconstitutional.
SECTION 4. The City Clepk hereby is authorized and
directed to cause a copy of this ordinance to be published in-
the Lynwood Press, a newspaper of general circulation in the
City, within fifteen (15) days after the adoption hereof.
INTRODUCED AND ADOPTED at a regular meeting of the City
Council of the City of Lynwood on the 15th day of May, 1978.
