ORDINANCE N0. 107
AN ORDINANCE OF THE CITY COUNCIL OF THE, CITY
GF LYNWOOD AMENDING SUBSECTIOi'VS (a) AND (b)
Obi SECTION 19-116 OF THE LYNGdOOD CITY CODE
RELATING TO THE SALE OF GOODS FROM xrEHICLES.
THE CITY COUNCIL OF THE CITY OF LYNi~IOCD HEREBY DOES ORDAIN
AS FOLLOWS:
SECTION 1. Subsection (a) of Section 1.9-116 of the L;~nwood City
Code hereby is amended to read as follows:
(aj Except as provided i.n this section, no
person shall stand or park any lunch wagon,
ice cream truck, or other vehicle, wagon, or
pushcart from which goods, wares, merchandise,
food, vegetables or food stuffs are sold, dis-
played, solicited or offered for sale or bartered
or exchanged on any portion of any street within
the City, provided, however, that such lunch
wagons, ice cream 'trucks, vehicles, wagons or
pushcarts may stared or park at the request of
a bonafide purchaser for a period of time not
to exceed ten minutes at any one place except on
any portion of any street within the City which
is located within 1,000 feet of any public or
private school during the period from 7:00 a.m.
to 5:00 p.m. on an,y day during which school is
in session. During the period from 7:00 a.m.
until 5:00 p.m, of any day during which school
is in sessiori no person shall stand or park any
lunch wagon, ice cream truck, vehicle, wap~on or
pushcart on any portion of any street within the
City which is within 1,000 feet of an,y public or
private school even at the request of a bonafide
purchaser. The provisions of this section shall
not apply to persons delivering such articles
upon the order, or by agreement with, a customer
from a store or other fixed place business or
distribution.
SECTION 2. Subsection (b) of Section 19-116 of the Lynwood Cit~r
Code hereby is amended to read as follows:
(b) No person shall stand or park on any portion
of any street within the City any lunch wagon,
ice cream truck, or other vehicle, wagon, or
pushcart from which goods, wares, merchandise,
Fruits, vegetables or food stuffs are sold, dis-
played, solicited or offered for sale or bartered
or exchanged without first obtaining a written
permit therefor from the chief' of police, which
permit shall designate the specified time and _
location at which the cart shall stand or nark.
The chief of police shall grant such permits if
he shall find that the standing or parking of
such vehicle at the time and place requested will.
not adversely affect the flow of pedestrian and
vehicular traffic at the location requested or
adversely affect traffic safety thereat.
SECTION 3a If any section, subsection, subdivision, sentence,
clause, phrase, or portion of this ordinance, or the application
thereof to any person or place, is for any reason held. to be
invalid or unconstitutional by the decision of a.ny court of com-
petent jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance or its application
to other persons or places. 'The Citv Council hereby declares
that i.t would have adopted this ordinance, and each section,
subsection, subdivision, sentence, clause, phrase or portion
thereof, irrespective of the fact that a.n,y one or more sections,
subsections, subdivisions, sentences, clauses, :phrases or
portions or the application thereof to any person or p:Lace,
be declared invalid or unconstitutional.
SEC'PION 4. The City Clerk hereby is authorized and. directed
to cause a copy of this ordinance to be published in the Lynwood
Dress, a newspaper of general circulation in the City, within
fifteen (15) days a.ft,er the adoption Hereof.
Introduced and adopted at a regular meeting of the City
Council of said City held on the 7th day of August , 1~7g
and f.'inally adopted and ordered published at a regular meeting of
said Council held on the 2lstday of August , lq'T9 by the
