HomeMy Public PortalAboutOrd. 1083/. . , ,• ORDIATAI7CE NO. 1083 Ail ORDINANCE OF THE CITY COUNCIL OF THE CIt^Y OF LYN{VOOD ADDING SECTION 8-28 AND AMENDING SECTION 19-73 TO THE CODE OF THE CITY OF LYN{i'OOD RELATING TO OVER{;'EIGHT AND OVERSIZE VEHICLES The City Council of the City of Lynwood hereby does ordain as follows: Section 1. Section 8-28 of the Code of the City of Lynwood hereby is added to read as follows: Sec. 8-28. Building Official Defined Any provisions of this code to the contrary not with- standing the term "Building Official" as used in this Article shall refer to the person or persons designated by the City manager to perform the duties assigned to the Building Official pursuant to this article. Section 2. Section 19-73 of the Code of tt:e City of Lynwood hereby is amended to read as follows: Sec. 19-73. Restrictions on L'se of Streets by Over- weight and Oversize Vehicles (a) {Vhenever any provision of this Code or other ordinance or resolution of the City designates and describes any street or portion thereof as a street the use of which is permitted by any vehicle exceeding a maximum gross weight limit of three (3) tons, the city traffic engineer is hereby authorized to designate such street by appropriate signs as "truck traffic routes" for the movement of vehicles exceeding a maximum gross weight limit of three (3) TOP7S. (b) {9hen any truck traffic route is established pursuant to subsection (a) and designated by appro- priate signs, the operator of any vehicle exceeding a maximum gross weight limit of three (3) tons shall drive, stand or park on such routes and none other; however, nothing in this section shall prohibit the operator of any vehicle exceeding a maximum gross weight of three (3) tons coming from a "truck traffic route" from having ingress and e;;rc_:; by direct route • ~ f • ~' to and from restricted streets when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on such restricted streets or for the purpose of delivering materials to be used in actual and bona fide repair, alteration, remodeling or construction of any building or structure upon such restricted streets for which a building permit has previously been obtained therefor. (f) Liability for Damage to Public Streets - Any person, firm or agency granted a special in Section E hereof, shall be liablemfor allpdamages to any street, highway, bridge, or appurtenances thereto, including but not limited to, guard rails, signs, traffic signals, street lights, street trees and similar faci- lities, resulting from the operation, driving or moving of any vehicle which exceeds any of the limitations imposed by Division 15 of the Vehicle Code, State of California. The permittee shall hold the City harm_ less from any liability occasioned by or resulting from operations under such special permit. (g) Cost of jNork to Insure Safe Passage - If in the judgment of the City Manager or his designate, it is determined necessary to strengthen any structure over which an overload must pass, or to perform any other work in order to insure the safe passage of the load upon City streets, the permittee will be required to pay the full cost of such work in advance. Permittee will also be required to pay the City in advance for any cost necessitated by the temporary relocation of traffic signals, street lights or other appurtenances in order to permit the safe passage of the loaded vehicle, Section 3. Sever_ ability If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any per- son or place, be declared invalid or unconstitutional. ~1 . a t.
