A moment of silence was observed in her honor. The Chairman, seven regular members and two alternates were present. A quorum was present. Designation of Voting Alternates The Chairman announced that all regular members and alternates Mr. Markus and Ms. Mahoney were eligible to vote. Mr. Nunn stated he will abstain from voting and discussion on Case No. P17023. 2. Procedural Matters and Procedures Explained Mr. Rotenberry explained the procedures for the meeting. New Business Case No. P17023 — 3328 Bennett Lane, Rezoning from RU to PUD, Preliminary & Final PUD Plan, and Final Subdivision Plat. Request filed by F&F Development LLC, property owner, and Jesse and Melissa Steck, applicants, for the following: A. Rezoning of 3.77 acres addressed as 3328 Bennett Lane from RU Rural to PUD Planned Unit Development. B. Preliminary and Final PUD Plan to use the existing building as a daycare/Montessori school. C. Final Subdivision Plat for Woodland Montessori School Subdivision, consisting of 1 lot and 3.77 acres. The property is located on the northwest corner of the intersection of Bennett Lane and Rickman Lane and is described as Part of the Northeast Quarter of the Southeast Quarter of Section 26, Township 44 North, Range 12 West, Jefferson City, Missouri (Central Missouri Professional Services, consultant). Mr. Rotenberry described the proposal and explained that the property owner intends to split the former church building from the surrounding property and transfer it to the new owner who would convert it to a daycare/Montessori school. He stated that the subject property is part of a larger piece of the former Rickman Center property. Mr. Rotenberry explained that in order to meet the zoning regulations for the new use, the owner is proposing rezoning of property from RU Rural to PUD Planned Unit Development and a PUD Plan outlining the daycare use. He stated that a Final Subdivision Plat for a one lot subdivision is also proposed to accomplish the property transfer. Mr. Paul Samson, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding this request. Mr. Samson distributed visuals depicting the subject property. He stated that in order to meet the City's subdivision code, one of the requirements is that all new subdivided lots have frontage on a publicly dedicated street. Mr. Samson explained that the only publicly dedicated street is on Southwood Hills and Christy Drive since Bennett Lane and Rickman Lane are private roads. He stated that in order to meet the subdivision code and maintain the publicly dedicated frontage the flag lot was created. Mr. Samson explained that there are no additional plans for the property other than the proposed daycare/Montessori School. He stated that the main access will be from Bennett Lane and Christy Drive. Mr. Samson explained that staff recommended the PUD zoning to dedicate the use as a daycare/Montessori School to protect the interests of the adjacent neighborhood. Minutes/Jefferson City Planning & Zoning Commission Page 3 December 14, 2017 Ms. Melissa Steck, 19688 Factory Creek Road, Jamestown, MO spoke regarding this request and explained that she is the future owner of this property. She stated that the subject property will be used as a daycare/Montessori School. Ms. Steck explained that the proposed daycare/Montessori School is a not for profit and will be named Woodland Montessori School. She stated that the daycare/Montessori School will open at 7:30 a.m. and close at 5:30 p.m. Ms. Steck explained that 24 children will attend the daycare/Montessori School. No one spoke in opposition to this request and no correspondence was received. Mr. Rotenberry gave the Planning Division staff report. Mr. Wade gave the Engineering Division staff report. Mr. Barron explained that an underlying zoning district of C -O Office Commercial will be assigned within the PUD Plan for the purpose of determining uses, signage and outdoor lighting. Ms. Cotten moved and Mr. Lester seconded to recommend approval to rezone 3.77 acres from RU Rural to PUD Planned Unit Development, to the City Council. Due to the lack of surrounding commercial property or zoning the applicant is requesting a rezoning to PUD and a PUD Plan to accommodate the planned office construction. Parking: Two parking lots will be constructed to complement the proposed building. The east parking lot will be visitor parking and the west parking lot will be employee parking. 52160 spaces are proposed for the visitor parking and 32 spaces are proposed for the employee parking lot. The proposed parking meets the requirement for office buildings. Signs: Signage details are not finalized at this time, however, preliminary discussions have indicated that a monument type sign with a possible message banner will be erected at the eastern most entrance to the site and logo and lettering will be mounted to the front facade with accent lighting. Staff recommends that the site adhere to the signage allowances of the C -O district. Traffic: The proposal does not exceed 100 peak hour vehicle trips and therefore does not trigger the requirement for a site specific traffic study. There was no error at the time of adoption. The original zoning for a portion of this property was RS -1. b) There has been a change in character in the area due to installation of public utilities, other zone changes, new growth trends, neighborhood deterioration, or development transitions. The area has remained relatively unchanged for a long period of time with sporadic Planned Unit Developments in the area. This site in particular would be considered an infill development which has been used for some commercial purposes in the past. c) There is a community need for the proposed zoning. The floor area ratio for this development will be 0.08. The current plan anticipates that an approximately 60 space visitor parking lot and 32 space employee parking lot will complement the development. A private patio area will be located at the rear of the building. The development will provide educational information, displays and possibly outdoor exhibit area for the public to become more educated with soybeans and their benefits. There will also be a community room available for private and public use. Elements of sustainable design will be considered throughout the project, such as solar outdoor lighting and a grey water collection system. A potential walking trail may be incorporated into the site, which will be designed concurrently with site storm water and water quality features. Sidewalks are required to be constructed along South Country Club Drive per the City of Jefferson Sidewalk Master Plan. The site is also located along a proposed Jefferson City Greenway Trail system. The final site/PUD plan will accommodated the Greenway Trail system and coordination with the City of Jefferson Parks Department will allow for possible construction of the trail system in this area. b. A Preliminary PUD plan is attached with this submittal. c. A preliminary plat is not needed for this submittal. d. There are no home owners or association by laws. e. A site specific traffic impact study is not required per usage of the development. f. Signage details are not finalized at this time; however preliminary discussions have indicated that a monument type sign will be erected at the eastern most entrance to the site and logo and lettering will be mounted to the front facade of the building with accent lighting. All signage will follow City of Jefferson code requirements and will be further detailed with final plans.
