Call to Order and Introduction of Members, Ex -officio Members and Staff The Chairman, all regular members and two alternates were present. A quorum was present. Designation of Voting Alternates The Chairman announced that all regular members were and Alternate Hank Vogt was eligible to vote. 2. Procedural Matters and Procedures Explained Mr. Zollinger explained the procedures for the meeting. The following documents were entered as exhibits. Mr. Zollinger advised that copies of the exhibits are available through the City Clerk or the Department of Planning and Protective Services: The City Code of the City of Jefferson, as amended Comprehensive Plan and Land Use Map Copies of applications under consideration A list of property owners to whom notices were sent Affidavit of publication of the public notice in the newspaper Rules of Procedure, Planning & Zoning Commission Mr. Zollinger submitted the following items for the record: Staff reports Minutes of proceedings Copies of drawings, plans, and/or renderings under consideration Letters or memoranda from staff Materials submitted by the public or applicants pertaining to the cases under consideration Minutes/Jefferson City Planning & Zoning Commission Page 2 August 28, 2018 3. Adoption of Agenda Mr. Lester moved and Mr. Dutoi seconded to adopt the agenda as printed. The motion passed 8- 0 with the following votes: Aye: Deeken, Dutoi, Lester, Mahoney, Markus, Vaughan, Vogt, Yarnell 4. Communications Received No correspondence was received. Chairman Jordan announced that Ms. Cotten arrived at 5:27 p.m. and is eligible to vote this evening. Mr. Vogt will be able to participate in discussion, but will not be able to vote. 5. New Business/Public Hearings Case No. P18022 — Southside Neighborhood Rezoning, Rezoning from RA -2 to RS -4. Request filed by city staff for the rezoning of approximately 41 acres of land consisting of 139 properties from RA -2 High Density Residential to RS -4 Single Family Residential. The purpose of the request is to implement the recommendations of the Historic Southside Old Munichburg Neighborhood Plan and rezone a predominately single family residential neighborhood from its existing multifamily zoning to single family zoning. The area is generally described as a portion of the area South of Dunklin Street, East of Highway 54 and West of Jefferson Street in Jefferson City, Missouri. Maps of the proposed rezoning area are available on the Planning and Zoning Commission website at: www.jeffersoncitymo.gov and are on file at the Department of Planning and Protective Services and available for review during regular business hours. Mr. Barron described the proposal and explained that Planning Division staff is requesting to rezone the area from RA -2 High Density Residential to RS -4 Single Family Residential to bring the predominately single family neighborhood into a proper zoning district for its existing use. He stated that the rezoning is supporting a recommendation outlined in the Old Munichburg/Historic Southside Neighborhood Plan adopted by the Planning and Zoning Commission on July 13, 2017. Mr. Barron explained that downzoning the area would protect the single family character of the neighborhood and would prevent any further conversions of existing single family homes to multi- family dwellings. He stated that for existing multiple unit buildings, if two units or less are destroyed by natural causes (such as fire) they could be rebuilt to their existing footprint and size. If more than two units are destroyed by natural causes, the replacement structure would be required to be single family. Mr. Barron explained that multi -unit structures voluntarily demolished would lose their grandfathered status and could only be re-established as a single family house. He stated that this rezoning will not affect the continued use of the existing properties that have been converted into multi -family units. Those "grandfathered" structures can continue their existing use, but the rezoning would have conditions on their ability to rebuild. Mr. Barron explained that the current zoning does not match the Southside Area Land Use Plan. He stated that out of all of the single family zoning designations RS -4 is the density level most appropriate for this neighborhood. He stated that this zoning designation is typically found in older neighborhoods throughout the City. Mr. Barron explained that there is a small portion in this area zoned C-2. He stated that an informational neighborhood meeting was held on August 21, 2018. The City Council Public Hearing is scheduled for October 1, 2018. Mr. Mark Borman, 15114 Deer Run Road, Henley, Missouri spoke in opposition to this request on behalf of Eleanor Nentwig, 307 W. Atchison Street. Mr. Borman owns property located at 122 W. Atchison Street. Mr. Borman explained that he grew up in this neighborhood and have seen the neighborhood decline. My Aunt his lived there for 40 years and will have to sell her property within five years. There is very little potential to sell her property to a large family. The property has better potential to be used as an income property converted to a duplex. The proposed rezoning would cause her harm without any type of remedy. There is multi -family residential properties on both sides of her property. The multi -family residential properties are not the problem, it is the property owners not taking care of their properties. Minutes/Jefferson City Planning & Zoning Commission Page 3 August 28, 2018 Ms. Laura Ward, 115 W Atchison Street, spoke regarding this request and explained that she is the City Council representative for this ward. She stated that there are families corning to live in this area, as she did seven years ago. She stated that when she purchased her home it had numerous broken windows, no working electric and plumbing. We lived there during the winter of 2011 and restore the home. Since that time two homes on either side of us in dire need of restoration have been purchased by families. This is an area that is starting to draw interest from families and those outside of our community because there is a desire to live in neighborhoods that have diversity, architectural character and integrity. This is a walkable community and neighborhood. This plan is another step in that direction. My only desire is to include 50 homes north of W. Atchison Street in this proposed area. If those homes were to be demolished and converted to multi -family we would lose the architectural character and integrity of the entire Southside Neighborhood. No correspondence was received. Mr. Barron addressed the concerns of those speaking regarding this request and explained that the zoning is only one piece of a long term plan to improve the Southside Neighborhood. There are other ways to improve a property including infrastructure improvements, Community Development Block Grant programs and neighborhood reinvestment programs offered through the City. Staff have looked at some streets outside of this area that might also benefit from being zoned single family residential, more specifically Broadway Street with some homes that have deep front yards. After studying the neighborhoods and the properties included in the proposed rezoning staff decided to back off from a larger rezoning. With 140 properties to follow the recommendation of this plan it is already one of the largest rezoning projects the city has undertaken. It would be our intent at the staff level to take a harder look at the area to the north of this proposal in the near future. It is complicated because there are a number of buildings built as a multi -family residential. Mr. Dutoi moved and Mr. Lester seconded to recommend approval of the rezoning plan for the area as presented by staff to the City Council. The motion passed 8-0 with the following votes: Aye: Cotten, Deeken, Dutoi, Lester, Mahoney, Markus, Vaughan, Yarnell Mr. Deeken inquired of the procedure for going to City Council with a different recommendation for the sign ordinance that the Planning and Zoning Commission passed. Mr. Barron explained that at the August 9 Planning and Zoning Commission meeting he reported to Commission members that staff went with some recommendations that were different from the Planning and Zoning Commission's recommendation on the sign code bill. Staff did consult with the sponsor of the bill and went to Council with a staff recommendation that was different from the Planning and Zoning Commission's recommendation. It was described to the City Council that staff's recommendation was different from the Planning and Zoning Commission's recommendation. It was a staff recommendation to City Council that there be some sort of limit on residential signs. Mr. Vaughan commented that there was discussion at the last Planning and Zoning Commission meeting about staffs recommendation to Council regarding the sign code amendment. 6. Adjourn.
