1. Call to Order and Introduction of Members, Ex -officio Members and Staff
The Chairman, seven regular members and two alternates were present. A quorum was present.
Designation of Voting Alternates
The Chairman announced that all regular members were and Alternate Hank Vogt is eligible to
vote.
2. Procedural Matters and Procedures Explained
Mr. Zollinger explained the procedures for the meeting. The following documents were entered
as exhibits. Mr. Zollinger advised that copies of the exhibits are available through the City Clerk or
the Department of Planning and Protective Services:
The City Code of the City of Jefferson, as amended
Comprehensive Plan and Land Use Map
Copies of applications under consideration
A list of property owners to whom notices were sent
Affidavit of publication of the public notice in the newspaper

Mr. Zollinger submitted the following items for the record:

3. Adoption of Agenda
Mr. Yarnell moved and Mr. Dutoi seconded to adopt the agenda as printed. The motion passed 8-
0 with the following votes:

4. Approval of the Regular Meeting Minutes of September 13, 2018
Mr. Dutoi moved and Ms. Mahoney seconded to approve the Regular Meeting Minutes of
September 13, 2018. The motion passed 8-0 with the following votes:

5. Communications Received
Correspondence was received for Case Nos. P18024, P18025 and P18026.
6. New Business/Public Hearings
Case No. P18024 - 2700 Block of Route CC, Rezoning from RU to C-2 and Comprehensive
Plan Amendment. Request filed by Rick Penno, applicant, and Erman and Dorothy Loesch,
property owners, for the rezoning of 5.95 acres from RU Rural to C-2 General Commercial and an
associated amendment to the Development Plan Map of the Comprehensive Plan. The property
is located on the south side of Route C and the eastern side of Route CC and is described as part
of the East Half of the Southeast Quarter of Section 22, Township 44 North, Range 12 West, in
the City of Jefferson, Cole County, Missouri (Central Missouri Professional Services, consultant).
Mr. Zollinger explained that the property owner was not able to be present and has requested a
continuance so that he can address any concerns and issues that have arised regarding the
proposed rezoning. He stated that this matter will be continued to the November 8, 2018 Planning
and Zoning Commission meeting. Mr. Zollinger explained that adjacent property owners will be re -
notified.
Chairman Jordan, at the advice of Counsel, accepted the contiunance for Case No. P18024.
Correspondence was received from Central Missouri Professional Services on behalf of the
Applicant requesting a continuance.
Correspondence on the proposed rezoning was received from the following individuals:

Case No. P18025 - 500 E Miller Street, Special Exception Permit. Request filed by Aaron and
Erin Clark, property owners, for a Special Exception Permit to operate a Short Term Rental. The
property is located on the southeast corner of the intersection of East Miller Street and Jackson
Street and is described as the West 78 feet of InLot 736, City of Jefferson, Missouri.
Mr. Zollinger described the proposal and explained that this request is to operate a short term
rental in a RA -2 High Density Residential zoning district. He stated that the applicants are
requesting a special exception permit for a Short Term rental of an existing single family residence.
Mr. Zollinger explained that the applicants have addressed the criteria for a short term rental.
Ms. Kim Bryant, 33085 Shooters Club Road, California, MO spoke on behalf of the applicants and
explained that the applicants do not live at the subject property and will rent the entire house. She
stated that they will not serve food which allows them to promote local restaurants and businesses.
Ms. Bryant explained that she will manage the property and has a maintenance person to take care
of the upkeep.
No one spoke in opposition to this request.

Mr. Lester moved and Mr. Dutoi seconded to recommend approval of the Special Exception
Permit for a Short Term Rental to the City Council. The motion passed 8-0 with the following votes:

Case No. P18026 - 105 Jaycee Drive, Rezoning from M-2 and RS -3 to C-1 and
Comprehensive Plan Amendment. Request filed by Joe Lopez, applicant and Samson Family
LLC, property owner, for the rezoning of 2.08 acres from M-2 General Industrial and RS -3
Residential to C-1 Neighborhood Commercial and an associated amendment to the Development
Plan Map of the Comprehensive Plan. The property is located near the southeast corner of the
intersection of West Main Street and Jaycee Drive and is described as part of the Northwest
Fractional Quarter of Section 2 Township 44 North, Range 12 West in the City of Jefferson,
Missouri (Central Missouri Professional Services, consultant).
Mr. Zollinger described the proposal and explained that this rezoning and comprehensive plan
amendment request is for a property currently zoned as M-2 and RS -3 and is currently being
divided via administrative parcel division. He stated that the purpose of the request is to facilitate
the future redevelopment of the property as a sports complex/practice facility. Mr. Zollinger
explained that indoor athletic facilities/gymnasiums are a permitted use of the C-1 zoning district.
He stated that the proposed amendment would allow for less intensive uses than the current
industrial designation. Mr. Zollinger explained that the requested commercial zoning would be a
benefit to the area and allow for Tess intensive uses in the area.
Mr. Patrick Kremer, Central Missouri Professional Services, 2500 E McCarty Street, spoke
regarding this request. Mr. Kremer distributed a visual depicting the area to be rezoned and a visual
depicting the preliminary site layout plan. Mr. Kremer explained that the subject property is owned
by the Samson Family and their intention is to sell the property. He stated that the subject property
was previously used as a warehouse and distribution center for roofing materials. Mr. Samson
explained that the existing buildings will be removed with the exception of a small portion on the
southwest corner of the site. He stated that the proposal is to construct a 26,000 square foot
community/activity building with the intention of providing space for a year round sports practice
facility. Mr. Samson explained that the current plans would encompass 8 to 10 batting cages; three
volleyball courts; two junior high basketball courts and one high school basketball court. He stated
that additional amenities will be provided as well. Mr. Samson explained that the proposed zoning is
C-1 Neighborhood Commercial. He stated that the proposed zoning classification and use would be
a good buffer to the residential property to the east and a less intensive use in this area.
Ms. Janet Samson, 9606 Branch Road Lohman, MO, spoke in favor of this request.
No one spoke in opposition to this request.
Mr. Joe Lopez, 4107 Highland Waye also spoke regarding this request.

Mr. Yarnell moved and Mr. Dutoi seconded to approve the comprehensive plan amendment
request to show the 2.08 acres of property as Commercial on the Development Plan Map of the
Comprehensive Plan. The motion passed 8-0 with the following votes:

Mr. Yarnell moved and Mr. Dutoi seconded to recommend approval of the request to rezone 2.08
acres of property from M-2 and RS -3 to C-1 to the City Council. The motion passed 8-0 with the
following votes:

A. Staff updates on prior cases

o Southside Neighborhood Area Rezoning #1. Staff initiated Rezoning 140 properties from
RA -2 Multi -Family to RS -4 Single Family. Approved by City Council.
o 1720 Vieth Drive. Jefferson City Manor Rezoning from SF Res to MF Res to bring zoning
into conformance with use. Approved by City Council.
o 2106 Jefferson. Central Electric Cooperative Rezoning and PUD Plan -new office building
and storage buildings. Approved by City Council.
Southside Neighborhood Rezoning #2 — Informational Presentation
Ms. Nanoski explained that the existing zoning is RA -2 with a small portion of RD and C-2
zoning. Staff have prepared a zoning plan for the neighborhood, with the general plan being
to downzone the area to RS -4 single family. Staff are scheduling a neighborhood meeting on
Tuesday, October 30, 2018. A public hearing on the zoning plan before the Planning and
Zoning Commission is scheduled for Thursday, November 8, 2018.
C. Presentation: 2045 Metropolitan Transportation Plan Development
Mr. Rotenberry explained that the Metropolitan Transportation Plan (MTP) is the long range
transportation plan for the Capital Area Metropolitan Transportation Organization (CAMPO)
region. The MTP is updated every 5 years and covers a planning horizon of at least 25 years.
The MTP sets goals and defines policies, programs, and projects to meet the transportation
needs of the CAMPO region as required by Federal Law.
