Case No. P18024 - 2700 Block of Route CC, Rezoning from RU to C-2 and Comprehensive Plan
Amendment. Request filed by Rick Penno, applicant, and Erman and Dorothy Loesch, property owners,
for the rezoning of 5.95 acres from RU Rural to C-2 General Commercial and an associated amendment to
the Development Plan Map of the Comprehensive Plan. The property is located on the south side of Route
C and the eastern side of Route CC and is described as part of the East Half of the Southeast Quarter of
Section 22, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri (Central

Case No. P18025 - 500 E Miller Street, Special Exception Permit. Request filed by Aaron and Erin

Case No. P18026 - 105 Jaycee Drive, Rezoning from M-2 and RS -3 to C-1 and Comprehensive Plan
Amendment. Request filed by Joe Lopez, applicant and Samson Family LLC, property owner, for the
rezoning of 2.08 acres from M-2 General Industrial and RS -3 Residential to C-1 Neighborhood
Commercial and an associated amendment to the Development Plan Map of the Comprehensive Plan. The

The Chairman, six regular members and two alternates were present. A quorum was present.

7. New Business/Public Hearings
Case No. P18023 - 3410 Sherman's Hollow Preliminary PUD Plan. Request filed by Marketing
Specialists Inc., property owner, for a Preliminary PUD Plan to construct two, one story residential
duplexes. The property is located on the northwest corner of Shermans Hollow and Wildwood
Drive and is described as Lot 54 of Westpoint Estates Section 4, Jefferson City, Cole County,
Missouri (Central Missouri Professional Services, Consultant).
Mr. Zollinger described the proposal and explained that the applicant has acquired .93 acres of
property at the intersection of Wildwood Drive and Shermans Hollow and plans on constructing two,
one story residential duplexes consisting of two units. He stated that the property is zoned PUD and
the property owner has submitted a PUD Plan. Mr. Zollinger explained that the exterior of the
buildings would be brick veneer and siding and the roof finish would be asphalt shingles. He stated
that a 5 foot sidewalk with 3 foot greenspace would be constructed along the frontage of Shermans
Hollow Road. Mr. Zollinger explained that the Preliminary PUD would match the land use of the
adjacent residential neighborhood and the building exterior finish would be similar to the adjacent
townhouse development. He stated that the Development Plan Map of the Comprehensive Plan
shows this area as being planned for medium density attached residential and the Preliminary PUD
complements that plan.
Mr. Patrick Kremer, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request and distributed visuals depicting: (1) the location of the proposed
development; (2) the elevations of the proposed development; (3) the floor plan of the proposed
development; and (4) the preliminary building layout and grading plan. Mr. Kremer explained that
directly to the south and east is offices and to the west is a townhouse development. He stated that
the applicant purchased the subject property to expand their operations. Mr. Kremer explained that
the subject property has sat vacant since 1998. He stated that the proposed plan would construct
two single story duplexes. Mr. Kremer explained that the building elevations will be similar to the
townhouse development to the west. He stated that the proposed duplexes will have brick on the
front side and architectural shingles. Mr. Kremer explained that the duplexes will have a two car
attached garage. He stated that the site sits higher than Shermans Hollow and each unit will be
stair stepped down with the grade of Shermans Hollow. Mr. Kremer explained that this is an attempt
to make the driveways match the existing grades. He stated that on the western portion of the site
Unit 2B will sit lower in comparison to all of the duplexes. Mr. Kremer explained that they will not be
grading past the western property line because the grades on that property line are higher than the
grades of what Unit 2B will be sitting on. He stated that the grades on the rear of the buildings will
be higher than the grades on the front portion of the site. Mr. Kremer explained that this will affect
stormwater flow because all of the stormwater north of the site will flow down across the subject
property and onto Shermans Hollow. He stated that once the stormwater flow is contained by the
street, it will flow into the curb inlets along Shermans Hollow. Mr. Kremer believes that this will

improve the situation for the drainage in the existing townhouse area to the west. He stated that the
stormwater flow will be increased because there is more impervious area on the lot, but will be
directed towards the street and into the existing inlets. He stated that sanitary sewer will be
extended so that each unit has access to sanitary sewer. Mr. Kremer explained that impacts to the
street network will be minimal. He stated that the applicant will keep some of the trees on the site.
Mr. Steve Lightner, 710 Wildwood Drive, spoke regarding this request and explained that he
owns Jefferson West Apartments. He stated that they started with 120 units and currently have 196
units. Mr. Lightner explained that he is interested in the subject property because it provides a
buffer between the properties. He stated that a PUD zoning would allow many types of uses such
as a commercial building, tattoo shop and vapor lounge. Mr. Lightner explained that he did not want
that next to us and wanted to control what is being built there. He stated that he has managed
apartment complexes since 1978 and has owned Jefferson West Apartments since the 1980's. Mr.
Lightner explained that there is a need for additional rental units in Jefferson City. He stated that the
proposed development will be rental units. Mr. Lightner explained that the proposed development
will not be Section 8 Housing.
The following individuals spoke in opposition to this request:

Those speaking in opposition voiced the following concerns:

Mr. Lester left at 5:50 p.m.
The following individuals spoke regarding this request:

• Dorothy Ewers, 3414 Shermans Hollow
Those speaking regarding this request voiced the following concerns:
• Not opposed to an apartment development, the adjoining apartment complex have been
good neighbors
• Stormwater runoff
• Removal of trees will contribute to stormwater runoff
• Increase in traffic
No correspondence was received.
Mr. Zollinger gave the Planning Division staff report. Mr. Wade gave the Engineering Division
staff report.
Mr. Patrick Kremer, Central Missouri Professional Services, 2500 E. McCarty Street, addressed
the concerns regarding stormwater drainage. Mr. Kremer explained that he would entertain Mr.
Wade's comments about placing a berm on the western side further to the north. He stated that the
final site plan will address all of these issues.
Mr. Steve Lightner, 710 Wildwood Drive, addressed Mr. Wade's suggestion of a turnaround. Mr.
Lightner explained that in order to construct a turnaround two walnut trees would have to be
removed which would contribute to additional stormwater runoff.
Mr. Vaughan moved and Ms. Mahoney seconded to recommend approval of the Preliminary PUD
Plan subject to staff recommendations regarding minor technical corrections to the City Council.
The motion passed 7-0 with the following votes:

A. Staff updates on prior cases
Mr. Barron reported that the School Street Local Historic District Application was approved by the
City Council on September 4, 2018.
B. Informational Discussion on the Southside Area #2 Rezoning
Ms. Nanoski explained that the existing zoning is RA -2 and a small portion of RD. Staff are
preparing a zoning plan for the neighborhood, with the general plan being to downzone the area to
RS -4 single family. Staff hopes to schedule the zoning plan as a discussion item at the next
meeting.

Amendment. Request filed by Rick Penno, applicant, and Erman and Dorothy Loesch, property owners, for the
rezoning of 5.95 acres from RU Rural to C-2 General Commercial and an associated amendment to the
Development Plan Map of the Comprehensive Plan. The property is located on the south side of Route C and
the eastern side of Route CC and is described as part of the East Half of the Southeast Quarter of Section 22,

Nature of Request
This rezoning and comprehensive plan amendment request is for a portion of a tract of land that consists of 5.95
acres that is currently undeveloped. The purpose of the request is to facilitate the potential future expansion of
the neighboring Garden Center use. The property is currently in the process of being divided via administrative
parcel division.
Zoning History
The property was annexed into the city on November 1, 2008 and was assigned an RU Rural zoning at the time
of annexation. When annexations are processed the area being annexed is automatically designated as RU Rural
unless a plan is submitted for its use with the annexation petition or with the annexation plan of intent. The
Development Plan Map of the Comprehensive Plan currently designates this property for development as Low
Density Residential. The proposed amendment to the Development Plan Map would re -designate the property
as intended for commercial use. Properties adjacent to the North, South and East are currently designated by the
Development Plan Map of the Comprehensive Plan as Commercial.

While the intended use of the property is currently Low Density Residential on the Development Plan Map of

located on the southeast corner of the intersection of East Miller Street and Jackson Street and is
described as the West 78 feet of InLot 736, City of Jefferson, Missouri.
Nature of Request
This request is for the applicants to operate a short term rental in a residential zoning district. The use of a
residence as a short term rental must be approved the Planning and Zoning Commission and the City
Council through a Special Exception Permit and must comply with Section 35-41.B.35 of the Jefferson
City Code.
Staff Analysis
Number of Guests and Rooms:
The applicants are requesting a special exception permit for the Short Term rental of an existing single
family residence. Section 35-41.B.35.b(3)(a) states a maximum of five unrelated persons or any number
of persons related by blood, marriage or adoption shall be permitted as lodging guests.

Amendment. Request filed by Joe Lopez, applicant and Samson Family LLC, property owner, for the rezoning
of 2.08 acres from M-2 General Industrial and RS -3 Residential to C-1 Neighborhood Commercial and an
associated amendment to the Development Plan Map of the Comprehensive Plan. The property is located near
the southeast corner of the intersection of West Main Street and Jaycee Drive and is described as part of the
Northwest Fractional Quarter of Section 2 Township 44 North, Range 12 West in the City of Jefferson,
Missouri (Central Missouri Professional Services, consultant).
Nature of Request
This rezoning and comprehensive plan amendment request is for a property consisting of 2.08 acres currently
being divided via administrative parcel division. The purpose of the request is to facilitate the future
redevelopment of the property as a sports complex/practice facility. Indoor athletic facilities/gymnasiums are a
permitted use of the C-1 zoning district.
Zoning History
The property was annexed into the city on May 16, 1967. At the time the cities industrial businesses were
developing along industrial drive. The 1968 Zoning map designated the area as local commercial and light
industrial and 4 years later in 1972 the Zoning map was changed to the current zoning M-2 General Industrial
and RS -3 Residential zoning. The zoning in this area has not changed for the past 46 years.

Comprehensive Plan Amendment:
While the intended use of the property is currently Industrial, the Development Plan Map of the Comprehensive
plan calls for adjacent property and property along West Main Street and property along Industrial Drive as
intended for commercial use. The proposed amendment to would allow for less intensive uses than the current
industrial designation. The proposed amendment to the Development Plan Map of the Comprehensive Map
would also apply to a portion of the property that is designated as Low Density Residential. Staff recommends
approval of the request to amend the Development Plan Map of the Comprehensive Plan to show the property

ADDENDUM A -REVIEW CRITERIA

A. There does not appear to be an error on the original zoning.
B. The area has experienced some changes in character. The proposed development
will occupy 2.08 acres+/- fronting on Jaycee Drive and West Main Street. The
prior use was warehousing and distribution for roofing materials. In addition,
there was previously a gas/oil distribution facility within the same block at
Industrial Drive. It is believed both facilities date to the 1950's or 1960's. We
believe both have reached the end of their useful life.
C. The proposed use, a community activity building will provide space for year-
round indoor practice for sports activities. The proposed zoning is C-1
Neighborhood Commercial. The zoning classification and the use will be a good
buffer to the residential properties to the east. There are very limited facilities of
this nature in our community, therefore, we believe this project will serve an
unfulfilled need. Any existing similar uses are mostly converted facilities that
were not designed originally for this purpose.
D. The current Comprehensive Plan was adopted in 1996. While it is difficult to
project intent for 20+ years, we believe the goal of orderly redevelopment is met
with this rezoning.
E. The land use along Jaycee Drive from Industrial Drive to West Main Street is a
mix of industrial, commercial and office. Property to the north is occupied by Pic
Supply, a supplier and installer of mechanical/electrical equipment. Property to
the east is a single-family residence. Property to the south is a travel agency and a
handyman contractor operation. Property to the west is occupied by a lumber
yard/hardware store, open yard, contractor storage and contractor office building.
F. All public and community facilities are available and adequate. The existing
facilities will be demolished with the redevelopment constructed to today's
standards.
G. The proposed uses do not require a site specific traffic impact study per the City
Code.
H. The proposed use is a community activity building as an indoor training/practice
facility. While the size of the building is significant, the occupancy is limited.
Vehicular traffic is projected as being limited. The previous use required
significant heavy truck traffic that is being eliminated. Jaycee Drive is a
connector street served by arterial streets; West Main on the north and Industrial
on the south. Traffic impact is projected to be reduced.
I. There will be very limited environmental impact. Activities will be indoors.
J. The design team is concurrently working on a schematic design that the site will
accommodate.
K. The community will receive a level of service that currently does not exist in our
community for indoor training and practice that is available for the public.

A. There was no definable error in the original Comprehensive Plan. The
Comprehensive Plan originally adopted in 1996 is still a working document and
while an update is desirable, the slow growth and subsequent redevelopment of
the City have contributed to its continued success. It would have been impossible
to project trends beyond 20 years.
B. We believe the Comprehensive Plan continues to validate the Commission's
original intent. As previously stated, while an update is desirable, the
Commission has done a good job of evaluating requests on a case by case basis,
providing consistency to development and redevelopment.
C. We believe the general goal of providing an orderly growth and redevelopment is
fundamental to the overall objectives of the Comprehensive Plan and this request
is compatible with that mission.
D. The area has been slow to change over the decade, but with the relocation of
industrial uses, such as distribution/warehousing and oil/gas distribution, the City
has an opportunity to guide the redevelopment with more compatible community
uses.
E. To our knowledge there are not neighborhood plans for this specific
neighborhood, but we believe the proposed use would fit well if there was a plan
update and this would be a logical continuation of orderly change.
F. All services and utilities area available. Public and community facilities are
excellent and the proposed use compliments existing services and is an asset for
quality of life issues within our community.
G. The developer has retained design services concurrently with the submittal. The
proposed redevelopment will demolish the existing facilities and require buffering
and design standards that much improve existing conditions.
H. A redevelopment utilizing today's design standards and expanded services to
community residents will be a definite benefit to our community.
