Rezoning from RU to C-2 B. Comprehensive Plan Amendment PLANNING STAFF REPORT JEFFERSON CITY PLANNING AND ZONING COMMISSION November 8, 2018 Case No. P18024 - 2700 Block of Route CC, Rezoning from RU to C-2 and Comprehensive Plan Amendment. Request filed by Rick Penno, applicant, and Erman and Dorothy Loesch, property owners, for the rezoning of 5.95 acres from RU Rural to C-2 General Commercial and an associated amendment to the Development Plan Map of the Comprehensive Plan. The property is located on the south side of Route C and the eastern side of Route CC and is described as part of the East Half of the Southeast Quarter of Section 22, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri (Central Missouri Professional Services, consultant). Nature of Request This rezoning and comprehensive plan amendment request is for a portion of a tract of land that is currently undeveloped. The purpose of the request is to facilitate the potential future expansion of the neighboring Garden Center use. The property is currently in the process of being divided via administrative parcel division. At the October 11, 2018 the applicant requested a continuance for the request to be heard at the November 8, 2018 Planning and Zoning Commission meeting. Modification of Request The property owner has submitted a request to amend the application for rezoning from 5.95 acres to 2.69 acres. Zoning History The property was annexed into the city on November 1, 2008 and was assigned an RU Rural zoning at the time of annexation. When annexations are processed the area being annexed is automatically designated as RU Rural unless a plan is submitted for its use with the annexation petition or with the annexation plan of intent. The Development Plan Map of the Comprehensive Plan currently designates this property for development as Low Density Residential. The proposed amendment to the Development Plan Map would re -designate the property as intended for commercial use. Properties adjacent to the North, South and East are currently designated by the Development Plan Map of the Comprehensive Plan as Commercial. Zoning and Surrounding Land Use Current Zoning: RU Requested Zoning: C-2 Current Use: Undeveloped Allowed Uses: Permitted uses within the C-2 General Commercial zoning district allows for a variety of land uses such as Indoor amusement center, dance or art schools, print or copy shops, restaurants, churches or laundry services. Please see the Land Use Matrix in the Zoning Code for a more detailed list of permitted uses. Staff Analysis Analysis for the Rezoning: Standard checklist for rezoning: Surrounding Zoning Surrounding Uses North C-2 Commercial South C-1/RU Residential / Vacant/Undeveloped East C-2 Commercial West N/A Unincorporated Cole County Allowed Uses: Permitted uses within the C-2 General Commercial zoning district allows for a variety of land uses such as Indoor amusement center, dance or art schools, print or copy shops, restaurants, churches or laundry services. Please see the Land Use Matrix in the Zoning Code for a more detailed list of permitted uses. Staff Analysis Analysis for the Rezoning: Standard checklist for rezoning: Yes No Notes: Complies with Comprehensive Plan X The property is undeveloped and vacant but is zoned RU- Rural. Adjacent uses are commercial and Residential. The proposed Comp Plan Amendment would support the requested commercial zoning. Has access to necessary utilities X The property does not currently have access to Sewer. Located outside flood zone X The property does not lie within the 100 year Standard checklist for rezoning Yes No Notes: Benefit to City is substantial when compared to adverse effects on adjacent property X The property is located at a major highway intersection and the city would benefit from the development of the property in a commercial manner. After rezoning, the allowed uses would be compatible with uses allowed in adjacent districts X The area located at the Rt C and Hwy 179 intersection could be considered a commercial node. The slight expansion of commercial zoning in the area would be appropriate. After rezoning, the allowed uses would be compatible with adjacent existing land uses X The allowed uses would be compatible with the adjacent commercial use. If not rezoned, the owner would be deprived of use advantages enjoyed by surrounding owners (reverse spot zoning) X Some of the adjacent property is currently zoned C-2 General Commercial The requested rezoning would be an expansion of an existing district X The rezoning would be an expansion of the adjacent commercial zoning. floodplain. Meets district size requirement X The rezoning would be an expansion of an existing C-2 Zoning District. Comprehensive Plan Amendment: While the intended use of the property is currently Low Density Residential on the Development Plan Map of the Comprehensive plan, the property is immediately adjacent to an intersection of state highways, Route CC, Route C and Highway 179. A re -designation of the property to commercial would be a logical expansion of the commercial designation in the area. The change would not be a major change in the intended use pattern for this area. Staff recommends approval of the request to amend the Development Plan Map of the Comprehensive Plan to show the property as Commercial. Rezoning Request: The requested commercial zoning would be a logical expansion of the adjacent property. The commercial rezoning would not appear to create any major land use conflicts. Staff recommends approval of the request to rezone the property from RU to C-2. Approve Deny Neutral Staff Recommendation X Form of Motion 1. Motion to approve the comprehensive plan amendment request to show the 2.69 acres of property as Commercial on the Development Plan Map of the Comprehensive Plan. 2. Motion to approve the request to rezone 2.69 acres of property from RU to C-2. We have owned and lived in our home at 2804 Route CC for 14 years. We have invested significant dollars and sweat equity in our home. With the exception of Green Horizons' landscaping/nursery operations, all of our neighbors are residential in nature, including the Cain property that the zoning map shows as being zoned C-1. Several families with very young children live in the 2700 & 2800 blocks of Route CC. We know our neighbors and our neighbors know us. We have no issues with the landscaping/nursery operation. They are protected by a slight knoll that prevents sound, light and dust from escaping from their property, and by a tree line that shelters their operations from view. Their business hours do not extend into nighttime hours. We are against the rezoning of the above described property from RU to C-2 because there is no guarantee that the landscaping/nursery operation would survive a future sale of the property. We are concerned that such a designation would pose a threat to all of us with adjoining properties. Our lifestyles as young families and retirees who enjoy a peace & quiet could be harmed. This feels like spot zoning to us. If the property sells, it should be at its current zoning level. The benefit of C-2 to the landscaping/ nursery operation may or may not happen. The applicant, Mr. Penno, has said that it could take a few years to expand the landscaping/nursery business, but there is no guarantee that the expansion will happen. If it does, then zoning level should then be reevaluated for change at that time. The C-2 designation would allow a future owner to put in a completely different business, such as a gas station or a convenience store. The development of such a business would adversely affect the neighborhood by having increased traffic, noise and lighting, potentially into the nighttime hours, destroying our neighborhood and affecting our property values. It appears that reversing such a change is nearly impossible. We ask Planning and Zoning Commission to carefully consider these issues and deny the request. It has been a very quiet neighborhood and I have invested a lot of time and money in keeping my property fixed up. The only business that is in our neighborhood is Green Horizon Landscaping And Nursery operation. I have no problem with them as they are protected by a knoll that prevents us hearing a lot of noise or seeing lights at all hours of the night. All the others are residential in nature. This includes the Cain property that your zoning map shows as being Zoned as C-1. We have several families that have small children. I know my neighbors and my neighbors know me. *I am against the rezoning of the above described property from RU to C-2 because there is no guarantee that the landscaping/nursery operation would survive a future sale of the property. I am concerned that such a designation would pose a threat to all of us with adjoining property. Our lifestyles are young families and retirees that enjoy a quiet and peaceful lifestyle would be harmed. This feels like "spot zoning" to me. *If the property later sells, it should be at its current zoning level. The benefit of the C-2 zoning to the landscaping/nursery operation may or may not ever happen. The applicant, Rick Penno, has said it may take several years to expand his nursery business. There is no guarantee that it will ever happen and that if given the opportunity to sell, who is to say that he won't and then we could have all kinds of businesses there that would bring our neighborhood down in value. We would have to contend with lots more traffic, noise and lighting, possibly in the late night hours. It would destroy our wonderful neighborhood. *I am asking that the Planning and Zoning Commission very carefully consider these issues and deny the request. Request filed by city staff for the rezoning of approximately 22 acres of land consisting of 96 properties from RA -2 Multi -Family Residential, C-2 General Commercial, and RD Residential Duplex to RS -4 Single Family Residential. The purpose of the request is to implement the recommendations of the Historic Southside / Old Munichburg District & Neighborhood Plan and rezone a predominately single family residential neighborhood from its existing multi -family zoning to single family zoning. The area is generally described as a portion of the area south of Dunklin Street, east of Madison Street, north of Hickory Street, and west of Lafayette Street in Jefferson City, Missouri. Nature of Request Planning Division staff are requesting to rezone the area from RA -2 Multi -Family Residential, C-2 General Commercial, and RD Residential Duplex to RS -4 Single Family Residential to bring the predominately single family neighborhood into a proper zoning district for its existing use. The rezoning is supporting a recommendation outlined in the Historic Southside / Old Munichburg District & Neighborhood Plan. Existing and Proposed Zoning Current Zoning: RA -2, C-2, and RD Requested Zoning: RS -4 Rezoning Staff recommends approval of the proposed rezoning. Downzoning the area would protect the single family character of the neighborhood and would prevent any further conversions of existing single family homes to multi -family dwellings. Certain structures originally built as multi -family buildings, as shown on the rezoning plan, would remain in a High Density Residential Zoning district to protect their existing use as conforming multi -family structures. The commercial property on Monroe St and Ashley St would also remain in a Commercial District to protect its existing use as a conforming commercial structure. This rezoning would not affect the continued use of the existing properties that have been converted into multi -family units. Those "grandfathered" structures could continue their existing use, but the rezoning would have conditions on their ability to rebuild. Approve Deny Neutral Staff Recommendation X Form of Motion 1. Case No. P18027 - Southside Neighborhood Rezoning, Rezoning from RA -2, C-2, and RD to RS -4. Information on this case is available on the Planning and Zoning Commission website at: www.jeffersoncitymo.gov and on file at the Department of Planning and Protective Services and available for review during regular business hours. City Staff are hosting an informational meeting on Tuesday, October 30, 2018 at 5:30 p.m. in the Council Chambers of the John G. Christy Municipal Building, 320 East McCarty Street. The purpose of the meeting is to answer any questions property owners may have prior to the Planning and Zoning Commission meeting. This case is tentatively scheduled for a public hearing in front of the City Council on Monday, December 17, 2018. The City Council meets at 6:00 p.m. in the Council Chambers of the John G. Christy Municipal Building, 320 East McCarty Street. Staff Initiated Rezoning Case No: P18027 - Southside Neighborhood, Rezoning Phase 2 Rezoning from RA -2 Multi -Family Residential, C-2 General Commercial, and RD Residential Duplex to RS -4 Single Family Residential The following describes an area of the Southside Neighborhood proposed by city staff to be rezoned from RA -2 Multi - Family Residential, C-2 General Commercial, and RD Residential Duplex to RS -4 Single Family Residential. This staff initiated rezoning is being pursued to implement a recommendation outlined in the recently adopted Historic Southside / Old Munichburg District & Neighborhood Plan. The proposed rezoning would bring the predominately single family neighborhood into a proper zoning district for its existing use and would prevent any further conversions of existing single family homes to multi -family dwellings. Certain structures originally built as multi -family or commercial buildings are proposed to remain in a RA -2 Multi -Family Residential or C-2 General Commercial zoning district to protect their existing use as conforming structures, as shown on the rezoning plan below. This rezoning would not affect the continued use of the existing properties that have been converted into multi -family units. Those "grandfathered" structures could continue their existing use, but the rezoning would have an effect on the ability of the structures to be rebuilt. City staff are hosting an informational session to answer questions about the proposal prior to formal presentation and public hearing before the Jefferson City Planning and Zoning Commission. Public Meetings: Tuesday October 3050, 2018 at 5:30 pm to 7:30 pm — Informational Session Thursday November 8th, 2018 at 5:15 pm — Planning and Zoning Commission Monday December 17th, 2018 at 6:00 pm — City Council All meetings will take place in the City Council Chambers of City Hall, 320 E. Case No. P18027 - Southside Neighborhood Rezoning, Rezoning from RA -2, C-2, and RD to RS -4. Request filed by city staff for the rezoning of approximately 22 acres of land consisting of 96 properties from RA -2 Multi -Family Residential, C-2 General Commercial, and RD Residential Duplex to RS -4 Single Family Residential. The purpose of the request is to implement the recommendations of the Historic Southside / Old Munichburg District & Neighborhood Ran and rezone a predominately single family residential neighborhood from its existing multi -family zoning to single family zoning. The area is generally described as a portion of the area south of Dunklin Street, east of Madison Street, north of Hickory Street, and west of Lafayette Street in Jefferson City, Missouri. Certain structures originally built as multi -family or commercial buildings, as shown on the rezoning plan, are proposed to remain in a Multi -Family Residential or General Commercial zoning district to protect their existing use as conforming multi -family or commercial structures. Written comments may be directed to the Planning and Zoning Commission in one of the following ways: e-mail: jcplanning@jeffcitymo.org mail: Dept. of Planning and Protective Services / Planning Division John G.
