Failace, 7:30 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday, June 1,2000. Upon individual roll calI vote, the following were noted present: Mayor James A. Failace Councilmember Patrick Crilley " James O'Brien Remy Quinones Janet Santoro Buddy Sohayda Councilmember Jack Fazekas was noted present at approximately 7:31 P.M. Also noted present was Borough Attorney Craig Coughlin. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor James A. Failace. The Clerk stated that on May 26, 2000, in full compliance with the Open Public Meeting Act, a notice of tonight's meeting was sent to the Home News Tribune, The Star Ledger and posted on the Bulletin Board. ORDINANCE #00-24 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held June15 , 2000, upon MMS&C, by Councilmembers Quinones and O'Brien. Upon individual roll call vote, Councilmembers Crilley, Fazekas, O'Brien, Quinones, Santoro and Sohayda voted in the affirmative. ORDINANCE #00-24 "AN ORDINANCE TO AMEND ORDINANCE #71-9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MA TIER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" 1. Councilmember Crilley stated that he initially voted against the contract because of the way it was offered and because of the reasons that he stated at the time. However, the Council approved the contract and that made it necessary (inaudible). Councilmember Crilley voted yes. ORDINANCE #00-25 "AN ORDINANCE AMENDING CHAPTER 160 "LAND DEVELOPMENT" OF THE CODE OF THE BOROUGH OF CARTERET" ORDINANCE #00-26 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held June 15,2000, upon MMS&C, by Councilmembers Quinones and O'Brien. Upon individual roll call vote, Councilmembers Crilley, Fazekas, O'Brien, Quinones, Santoro and Sohayda voted in the affirmative. ORDINANCE #00-26 "AN ORDINANCE AMENDING CHAPTER 109 "CONSTRUCTION CODES, UNIFORM" BY DELETING CERTAIN FEES" The Clerk stated that Ordinance #00-18 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough of Carteret held on May 18, 2000. It was duly published in the Home News Tribune on May 23, 2000 with notice that it will be considered for final passage after Public Hearing to be held June 1, 2000 at approximately 7:30 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Borough Attorney Craig Coughlin stated that he wanted everyone to understand there was one specific objection and he met with (inaudible) for about an hour this week and he is to meet with (inaudible) tomorrow. The Borough Attorney said he hoped that by next Thursday he would be able to get all the comments back to the Mayor and Council. Councilmember Crilley asked if they take action on this at the Agenda Meeting would we have to hold a Public Hearing. Borough Attorney Craig Coughlin said yes. We have never had a Public Input yet. We just carried the Hearing. 2. Upon MMS&C, by Councilmembers Quinones and Santoro, the Public Hearing on Ordinance #00-18 was carried to the next Council Meeting. The Clerk stated that Ordinance #00-19 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough of Carteret held on May 18, 2000. It was duly published in the Home News Tribune on May 23, 2000 with notice that it will be considered for final passage after Public Hearing to be held on June 1, 2000 at approximately 7:30 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS&C, by Councilmembers Crilley and O'Brien and unanimous affirmative vote of the full membership present, the Mayor declared the Public Hearing to be opened: There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Crilley and Quinones and unanimous affirmative vote of the full membership present. Mayor James A. Failace stated that the Director of the Carteret Office on Aging will oversee the Office on Aging. In order for us to do some of the things we'd like to do, such as grants and so forth, we need to create this position. It is something that has not been done in the past. Mr. Tozzi asked if the Borough had someone in that position. Mayor James A. Failace stated that this will be a full time position. Mr. Tozzi asked if they had to eliminate the other party. Mayor James A. Failace stated that it will not eliminate the other position but it will change the structure. There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Crilley and O'Brien and unanimous affirmative vote of the full membership present. Councilmember Crilley stated that what this Ordinance does is to allow us to improve and increase the programs for seniors Councilmember Santoro stated that one of the things that were discussed at the Agenda Meeting was her concern about the salary for this position and the best person qualified for the job. They did not budget for this person in this year's budget. She said that her concern was the salary, which was established at $40,000.00. Councilmember Santoro wanted to know where they were going to get this money. She asked Patrick DeBlasio if they had the money in their budget. She stated that until she is sure there is money in the budget for this position she would vote no. Upon MMS&C, by Councilmembers Crilley and O'Brien ORDINANCE #00-20 "AN ORDINANCE ESTABLISHING THE POSITION OF EXECUTIVE DIRECTOR CARTERET OFFICE ON AGING AND AMENDING CHAPTER 7 OF THE CODE OF THE BOROUGH OF CARTERET" was finally adopted. Upon individual roll call vote, Councilmembers Crilley, Fazekas, O'Brien, Quinones, and Sohayda voted in the affirmative for the adoption. Councilmember Santoro voted no. 4. Failace Advertised as finally adopted: June 9, 2000 Mayor James A. Failace stated that there was supposed to be an Ordinance at this meeting to eliminate fees for Senior Citizens. The Council will introduce this Ordinance at the next Agenda Meeting. He apologized and said it was something that he and the Council believe they have to do. Business is coming back into Carteret and this is a way, and the Council agrees, that Carteret can give back to its Senior Citizens. A copy of each resolution was placed upon the table for public review prior to the meeting in accordance with the Rules of Council and upon MMS&C, by Councilmembers Quinones and O'Brien and unanimous affirmative vote of the full membership, the meeting was opened for public input on all resolutions. There being no comments or objections to the Resolutions, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Quinones and O'Brien and unanimous affirmative vote of the full membership present. RESOLUTION #00-168 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Quinones and Crilley RESOLUTION #00-168 "DIRECTING THE ISSUANCE OF RAFFLE LICENSES TO St. Anthony's Holy Name Society" I. was adopted. Councilmember Santoro stated that she spoke with the Mayor and the Municipal Clerk about this. This is the air in the bottom of Borough Hall and we had started to remove it, reinstall it. She thought that they had voted on this last month. The Engineer faxed this over (inaudible). She also stated that they need to check on (inaudible) dates. RESOLUTION #00-173 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Quinones and Fazekas RESOLUTION #00-173 "RESOLUTION AUTHORIZING THE ISSUANCE OF $76,000 BONDS OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY IN ORDER TO RECEIVE A LOAN FROM THE NEW JERSEY ECONOMIC DEVELOPMENT AUTHORITY THROUGH THE PETROLEUM UST REMEDIATION, UPGRADE AND CLOSURE FUND, PUBLIC LOAN PROGRAM AND DETERMINING THE FORM OF SUCH BONDS AND OTHER DETAILS IN CONNECTION THEREWITH" was adopted. Councilmember Santoro stated that she spoke to (inaudible) today and it is her understanding that this position and the next part-time position, there are two (2) that don't have (inaudible). Councilmember Quinones stated that Councilmember Santoro was correct. She said that she spoke to Captain Hojecki and he advised her that the positions were advertised and opened to everyone, not just Carteret resident, the reason being is that this is not a Civil Service position, 10. RESOLUTION #00-178 was introduced by the Mayor and referred to the Council for action. Councilmember Quinones made a motion to Table the Resolution and then withdrew the motion. TRANSIT COMMUNICATIONS MARLBORO TOWNSHIP RESOLUTION #00-181 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Crilley and Quinones RESOLUTION #00-181 "A WARD OF PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES" was adopted. Upon individual roll call vote Councilmembers Crilley, Fazekas, O'Brien, Quinones and Sohayda voted in the affirmative. Councilmember Santoro voted no. RESOLUTION #00-182 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Crilley and Quinones RESOLUTION #00-182 "AWARD OF PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES" was adopted. The Clerk stated that she was in receipt of a Communication from Earth Tech, Inc. concerning a legal notification that an application will be submitted to the NJDEP for a General Permit for remedial investigation and cleanup of Phillips Petroleum Site, The Clerk stated that she was in receipt of a (a) Resolution from Monroe Township requesting the State to share a portion of the "Tobacco Money" with Municipalities that utilize the state medical insurance plan for their employees. (b) Resolution supporting the ban of MTBE fuel. The Clerk stated that she was in receipt of a Communication from NJ Transit-Public notice of final 1998 Federally-Funded Program under the Intermodel Surface Transportation Efficiency Act of 1991. 12. The Clerk stated that she was in receipt of a Resolution from the Marlboro Township Council urging COAH to amend the formula for providing credits to Municipalities for on-site construction of affordable housing. Upon MMS&C, by Councilmembers Crilley and O'Brien and unanimous affirmative vote of the full membership present, all Communications were ordered to be received and placed on file. Upon MMS&C, by Councilmembers Quinones and Crilley, all bills appearing on the prepared list, properly audited and signed were ordered to be paid. BUILDINGS & GROUNDS: FireHouse Committee Chairman Santoro reported that at last weeks Agenda Meeting they received the structural engineering report for the FireHouse. The estimate was approximately twenty-two thousand dollars ($22,000.00). At the time it was the consensus that they were going to move forward. Councilmember Santoro stated that she thought that the Borough Administrator Nick Goldsack or the Borough Attorney Craig Coughlin were to get back to them in reference to how they were going to go through this process. Borough Attornev Craig Coughlin: stated that he had not had the chance to speak to the Borough Administrator because he has been out ill: Councilmember Santoro said the problems at the firehouse will be corrected. She further stated that for anyone who doesn't know, there is a problem with movement in a portion of the wall at the firehouse. Borough Hall: There is still no answer about Borough Hall from Trenton. The Librarv Community Center: They had a meeting on May 19th and the Attorney, Architect and Tony Neibert were there in reference to finishing this project. Councilmember Santoro stated they had this discussion last week, also with the engineer, which they intended to serve a three- (3) day notice. She said she asked the Borough Attorney if he was going to speak to the (inaudible) tomorrow. Borough Attornev Craig Coughlin: stated that he spoke to Tom Potter. Mr. Potter said that he has been there and working on the site. The Borough Attorney said that he has not been at the site himself and he also has not had a response to the letter from Serenity as of yet: 13. Councilmember Santoro asked the Borough Attorney when the ten- (10) days would be up. Borough Attorney Craig Cou*hlin: replied that he thinks that the Borough gave them until June 7 . The letter was drafted on Friday: She then asked if there was something before that date so they could send them another letter so that they can hold them to that date. Borough Attorney Craig Coughlin: replied that they will send them another letter as a reminder unless they move on the project. He said that he is scheduled to meet with Tom Potter on Tuesday, June JUNE 1, 2000 AMENDING BILL LIST REPORTS DEPARTMENT STANDING COMMITTEES JUNE 1, 2000 STANDING COMMITTEES (CONTINUED) 5th in regard to timeliness and completion: Councilmember Santoro wanted everyone to know our (inaudible) on that building has expired as of June 1, 2000. We will not be asking for an extension until all the work is completed. We had a discussion about the seniors moving and decisions have to be made. Hopefully this will come into (inaudible) in the next couple of weeks. She stated that on the 21st a few of them attended a Senior's Dinner at the Cameo. She wanted to thank them for a terrific dinner. With that, progress. FINANCE & ADMINISTRATION: Committee Chairman O'Brien reported that he finally heard from the State. We are going to be getting $300,000.00 on the first round of discretionary aid. Last year that was the amount that we got on the second round. Hopefully we'll get some more on the second part. The CENSUS is up to 73% returns which is below their target of 78%. The Census takers will be going door to door soon, and the people should be very accommodating to the Census takers. Progress. FIRE: Committee Chairman Fazekas stated that on May 23rd there was an accident on the Turnpike. He said he would like to commend the Fire Department and the First Aid Squad on a job well done. The free CPR class is rescheduled for June 7, 2000. If anyone wishes to attend one of these classes, CPR or First Aid, and if it's full, please put your name on the list. GA TX has been a great supporter of the Fire Department and they are sponsoring three (3) Fire Fighter workshops at the Middlesex Fire Academy. This class is for both Career and Volunteers with no cost to the Carteret Fire Department. Moving right along. PARKS & RECREATION: Committee Chairman Crilley reported that the equipment in Chrome Park has been installed. He stated that he was down there on Saturday, and at any given moment there were twenty to twenty-five children on the merry-go-round, the children are getting good use out of it. Mayor Failace and Councilmember Crilley are going to see if they can get another one installed. He assured them that this was only the beginning. The applications for the SUMMER YOUTH WORK PROGRM in the park must be in the Municipal Clerk's Office by June 12th. You have to be fourteen and everyone who applies works. The MEMORIAL DAY PARADE was last Sunday, May 28th. Councilmember Crilley stated that he was very happy to see so many people in the park. It is one of the things that the Mayor & Council do as a service for the community. Progress. 14. POLICE:Committee Chairman Quinones stated that she would like to thank the Fireman, both the paid and volunteer who marched in the Memorial Day Parade and who showed up in full uniform. They looked very professional. She said she would also like to thank the Police Officers who showed up for the Parade. Councilmember Quinones stated she would like to thank Senator Vitale whose office contacted her last week to discuss the possibility of obtaining some volunteers through a Catholic Heart Work Camp. She said what they would be doing is for three (3) days over this summer they will give us Twelve (12) young adults plus three (3) adult supervisors to do work around town. Councilmember Quinones said that she would ask the public to submit some suggestions to what they think would be appropriate for these individuals. The Police Director obtained another Grant for $18,000.00 for some technology, which Councilmember Quinones thinks is wonderful. She also said that they are thinking of hiring a lateral police officer. Councilmember Quinones said that she would like to ask the public if they know any residents in Carteret who are Police Officers in other towns but would like to make a lateral move. They can contact Councilmember Quinones, Pat Crilley, Jim O'Brien or the Police Director to discuss it. It must be done as soon as possible. There was a motorcycle pursuit on May 31" that resulted in an accident on Roosevelt and Fredrick Streets. Officer Earp was involved with some passengers in another vehicle and fortunately no one was injured although they were taken to the hospital. Unfortunately another police vehicle has been damaged. Progress. PUBLIC WORKS: Committee Chairman Sohayda reported that he would like to see some of the Volunteers mow the grass. It seems, in certain neighborhoods, that the grass has to be three (3) feet or more before it's mowed. We're painting road signs and more trees are being cut. Moving right along, progress BOARD OF HEALTH: Committee Chairman Santoro stated the girls Softball Team was in the State finals. Unfortunately, the girls lost one (1) to zero (0). They had a terrific year and they play the County finals on Saturday. They came along way and everyone should be proud of them. June 1 sl is the Senior dinner dance and Friday is the 8th Grade Dinner Dance in the Middle School. On June 13th there will be a discussion about a school sewer project. The school sewer project has to go before the Zoning Board. They set up an emergency meeting for June 13'h for the sewer project, the pump station and also for the storage building that they are going to build by the concession stand. The sewer connection needs to be done. A letter has been sent to the State advising them that there is a delay before the Zoning Board. Hopefully it will be done shortly after June 13th. 15. Councilmember Santoro stated that she set a meeting up for the first School Board Liaison Meeting and because it's Election Day they are going to move the meeting to June 13'h at 5:00 P.M.. Mr. Louis Mangieri, Carteret, New Jersey read a letter in reference the end of the Korean War. Mayor Failace stated that we will all remember that day. He would like to thank everyone for participating in the Memorial Day Ceremony. It is one of the things that Carteret does very well. He stated that he spoke to someone that said no one has the Veterans Cemetery as we have in Carteret. He wanted to thank those who marched in the parade. There was a meeting in New York in reference to the GARBAGE TRANSFER STATION. The Mayor said he was unable to attend but some residents from Carteret did attend. Resident of Metchen had five thousand signatures against this transfer station. The Mayor suggested we begin that immediately and we should all sign it. There were some Councilmen from New York that were against this transfer station too. The Mayor sent a letter saying that they can keep their garbage there. He stated that next time he would like to be there. Upon MMS&C, by Councilmembers Crilley and O'Brien and unanimous affirmative vote of the full Council present, the meeting was declared open for Public Discussion. Patricia Rodriguez, Resident. Ms. Rodriguez stated that she wrote a letter to the Home News Tribune in reference to some statements made by Robert Hedesh. His statements caused an invisible MasonlDixon line through our town and gave parents on the Softball league the idea that Chrome had more problems than there were. When the Home News Tribune published this letter they edited her letter and took out the name she was referring to and they made it look like she was going after Christopher Elg. When she went after Councilmember Sohayda they published his name. If the parents felt that Chrome Park wasn't safe the Commissioner's presence would have helped. She said she responded to the letter and when the girl called she took her to task and explained it to her and she responded that they reserve the right to edit. Ms. Rodriguez said that she always thanks the Police for everything they do. She spoke to Christopher Elg concerning this letter and he wasn't so shocked. Ms. Rodriguez said that she is about unity and if the drug dealers are out of Rodriguez Supermarket and out of her area of town, they are not welcome anywhere. Also we have to do something about these abandoned houses. There are seventeen (17) of them on Lower Roosevelt Avenue. The drug users were living in an abandoned house at 66 Edwin St. She wanted to know what it was going to take, the Police have enough to do. Ms. Rodriguez said that 17 . she wanted to know why is it that a neighbor sees a rat coming out of a house in Sewaren and it's on the front page of the Home News Tribune. She said she dealt with two (2)-abandoned houses and sold one. Ms. Rodriguez said she has a rat problem, you can ask the Board of Health she called them enough times. This is the kind treatment the town of Carteret gets from its newspaper. Ms. Rodriguez stated that it really threw her. When she saw the letter (inaudible). She stated that she did answer the letter and she has a copy. Rose Alice Capp, Resident. How about giving the houses that are boarded up to Habitat for Humanity? Mayor James A. Failace replied with the property that the Borough has, Head Start is looking for property to rehabilitate. The Tax Office sells to those who can afford to at a lower price. As a Council, we did discuss this with the construction official Mr. Neibert. They have a list of all the abandon homes. The Mayor stated that they are in the process of doing whatever they can to alleviative the problem. Rose Alice Capp also said that she noticed on the corner of McKinley and Larch, they are building a very large two (2) family house. Is that a public or private building? She advised the Mayor that he should knock down the houses on Roosevelt A venue and put something up like that. She also said that some of the homes around town have very high grass. Mayor James A. Failace replied they must make those streets commercial again. Hopefully we will get those businesses open again. It is an important part of what they want to do down there. The Mayor said as for the grass, we have already called some of the property owners. Rose Alice Capp asked the Mayor if the properties were abandoned. Mayor James A. Failace stated that some of the properties are abandoned. He said he asked that it be looked into. Samuel Lugo, Resident. He showed the Council pictures he took of the property that he is having a problem with. He stated that he pays almost $1,000.00 a month to live there. The newcomers that just bought the property, Santa Maria Construction Company from Bricktown New Jersey are working on the property day and night. They have nineteen (19) people living in a two (2) family house. He said that he is an early riser and they are out there at 4:00 A.M., 5:00 A.M. playing soccer and other things. The people who live on Fitch Street can not get to their own Street because they are blocking the area with their commercial vehicles. The man who bought the property wants to put a Construction Company on it. Fitch Street is a dead end. This man has eight (8) commercial vehicles and that is not counting their three- (3) personal vehicles. Mr. Lugo said that he is not on good terms with these people because he told them that they could not block up the street. He said he made a copy of Ordinance #93-53 and he gave it to the owner of the property. Mr. Lugo said he told the owner that he and his workers were making a nuisance of themselves. He 18. went to Mr. Neibert about this problem and Mr. Neibert told him it was a commercial zone. It was zoned for a Barber Shop not a construction company. These people are parking inside the yard. They broke down the fence, they don't have a driveway but they park their vehicles in the yard. He said he called the police and Officer Rivera came and gave them a warning and it was fine for a while but now they are starting again. Mayor Failace replied that he was not the only person to complain. This pass weekend they had three (3) or more complaints about the same thing. The Mayor said he spoke with Mr. Neibert and we intend to watch this very closely. Lets see if there is something we can do about this. The Mayor also stated that they would see about getting someone out there very early in the morning to see what is going on. Mr. Lugo said he spoke to these people many times. On the fourth (4) time he said they got nasty. Councilmember Quinones asked if there were any witnesses to this incident. She suggested that Mr. Lugo file a complaint. Mr. Lugo replied that he had his wife looking out of the window. Mr. Delgado was cursed at also because it is his property that Mr. Lugo is living on. The main concern he has is for the almost thirty (30) children living on the block. Mayor Failace stated that he understood and they are going to do what they can about this situation. Councilmember Santoro stated that she spoke Mr. Lugo. She called Mr. Neibert and he already advised them that they would have to go before Zoning, because of the change. That is when all the complaints and all the people can come forward and they will have to be heard. They have been advised that they will have to make an application to Zoning. Mayor Failace again reassured Mr. Lugo that they would do all they could to rectify this problem.
