A Regular Meeting of the Mayor and Council of the Borough of
Carteret was called to order by Mayor James A. Failace, 7:30 P.M.,
Municipal Court, Police Facility, 230 Roosevelt Avenue, Carteret,
New Jersey, on Thursday, June 15, 2000.
The following were noted present:

Also noted present was Borough Attorney Craig Coughlin and
Nick Goldsack the Business Administrator.
The meeting was opened with a minute of silent prayer and the
Pledge of Allegiance led by Mayor James A. Failace.
The Clerk stated that on June 9, 2000, in full compliance with the
Open Public Meetings Act, a notice of tonight's meeting was sent
to The Home News Tribune, The Star Ledger and posted on the
Bulletin Board.

Mayor Failace read this Distinguished Service Medal Award into
the record:
"The Governor of the State of New Jersey, Christine Todd
Whitman, under the authority of 38A:IS-2, New Jersey Revised
Statutes, awards the Distinguished Service Medal to Specialist
Four Gerald P. Harczuk for distinguished meritorious service in
ground combat during The Vietnam Conflict in the Southeast
Asiatic Theater of Operations. "
Mayor Failace then presented the award to Mr. Harczuk.

Mayor Failace read the following letter from Lisa Resko, Captain
of the First Aid Squad, into the record:
"On May 13, 2000 a call for First Aid was requested for an
unconscious, unresponsive male.
Upon arrival police Officer Donald Erp was administering CPR.
Also responding to the call was Colleen Jameson, Frank Kovach
and Wayne Carrico. The quick response of these individuals
successfully saved the gentleman's life.
The Mayor commended the following for a job well done:

May 23, 2000 - Motor Vehicle Accident
Mayor Failace read the following letter from Robert Magella
Captain of the Fire Department into the record:
"On May 23, 2000 this department received an alarm for assistance
at the scene of a motor vehicle accident on the New Jersey
Turnpike. We responded with Engine 2 and Truck S. The First Aid
Squad was also there.
A commuter van carrying 15 people had overturned, ejecting
numerous people. The nature of the injuries ranged from grave to
minor. Eventually all 15 people were packaged and transported to
area hospitals.
Career Firefighters, Volunteers and First Aid Squad responded to
this ordeal. .
Upon arrival they immediately began rendering care for numerous
victims. They were responsible for treating and packaging many
patients.
All these men and women should be commended for their actions
at the scene of this accident. Their professional behavior and
obedience is a credit to . Carteret and to themselves.
Mayor Failace went on to thank them again and said that
Councilman Fazekas, as head of Fire and First Aid will give out
the awards and he will read the names. They were read as follows:

Mayor Failace asked for a motion to made for a five (5) minute
recess.
Upon MMS&C by Councilmembers Crilley and Fazekas and
unanimous affirmative vote of the full Council present this meeting
recessed at approximately 7:42 p.m.
Upon MMS&C by Councilmembers Crilley and Fazekas and
individual roll call vote, Councilmembers Crilley Fazekas,
O'Brien, Quinones, Santoro and Sohayda voted in the affirmative
to re-open the meeting at approximately 7:50 p.m.
Before the First Reading Ordinances were read Mayor Failace said
he was just informed that Volunteer Firefighter Neil Zullo was
present and then they announced his name and gave him an award.
ORDINANCE #00-27 was introduced and before being adopted
Mayor Failace asked that we amend this ordinance to eliminate
number (3) in the body of the ordinance, in reference to receiving
only one (1) waiver in any consecutive twelve (12) month period.
Upon MMS&C by Councilmembers Crilley and O'Brien and
individual roll call vote Councilmembers Crilley, Fazekas,
O'Brien, Quinones, Santoro and Sohayda voted in the affirmative
to amend the proposed ordinance to eliminate number three (3).
ORDINANCE #00-27 was introduced and adopted as amended on
First Reading and the Clerk authorized and directed to advertise
same for Public Hearing to be held on July 27, 2000, Upon
MMS&C by Councilmember Crilley and O'Brien and individual
roll call vote Councilmembers Crilley, Fazekas, O'Brien,
Quinones, Santoro and Sohayda voted in the affirmative.

The Clerk stated that Ordinance #00-18 was introduced and passed
upon First Reading at a Regular Meeting of the Borough Council
of the Borough of Carteret held on June I, 2000. It was duly
published in the Home News Tribune on June 6, 2000 with notice
that it will be considered for final passage after Public Hearing to
be held on June 15, 2000 at approximately 7:30 p.m. The
Ordinance was posted on the bulletin board and copies were made
available to the general public and according to law she read the
ordinance by title.
Upon MMS&C by Councilmembers Crilley and Quinones and
unanimous affirmative vote of the full Council present the Mayor
declared the Public Hearing to be opened.
There being no further comments or objections to the Ordinance
the Mlayor declared the Public Hearing to be closed upon MMS&C
by Councilmembers Crilley and Quinones and unanimous
affirmative vote of the five (5) Councilmembers present.
Attorney Coughlin said they need a motion to Table this ordinance
for consideration for later in this meeting because they will be
discussing amending this ordinance.

A copy of each Resolution was placed upon the table for review
prior to the meeting in accordance with the Rules of Council and
upon MMS&C by Councilmembers Crilley and Quinones and
unanimous affirmative vote of the full Council present the meeting
was opened for public input on all resolutions.
Mrs. Gazdos, Herman Street in West Carteret asked about
Resolution #00-192 and #00-194. She questioned how they could
give out bids on that if they did not get approval to do it yet.
Attorney Coughlin said #00-192 is the resolution paying Killam in
connection with work they have already done, so it was approved
so now they just need to move ahead and get the Deed from the
owner. He said in order to get the small piece of property they
needed they had to sub-divide a piece of property and we have now
accomplished that. She then mentioned that at the April 24th
meeting there was a resolution authorizing bids for Dorothy Street
Pump Station and it has not been bid yet.
Mayor Failace said it is our intention to do Dorothy Street now. He
said he would call Purchasing and find out what happened to the
bid.
A male citizen then asked out Resolution #00-187 and questioned
what type of system they were referring to.
Mayor Failace said he didn't know. He leaves all that up to the
Engineer and he told him if he comes to the next Agenda Meeting
the Engineer will discuss it with him.

unanimous affirmative vote of the full Council present, the public
portion on resolutions was closed,

Cœments factor. He said the budget was expanded for other various
improvements, which they anticipated, one of which being the
Fire House at that point in time, but then when they did it they
changed the allocation to the Bond Ordinance.

asked if that was a typing error.
Mayor Failace asked for a motion to Table this until next week's
Special Meeting to make sure of the correct bidder it was awarded
to.

Mayor Failace said Head Start is coming back to Carteret for
September of the new school year. They are finishing up the
negotiations with The Jewish Community Center on Noe Street .
We will also bring back some Nutritional Programs and a
possibility of the MCOC rehabilitating some homes in Carteret and
putting them back on the tax roles with no cost to Carteret citizens.
He thanked the Council for approving and executing the agreement
bringing back Headstart.

Upon MMS&C by Councilmembers Santoro and Fazekas, all bills
appearing on the prepaid list, properly audited and signed, were
ordered to be paid. Upon individual roll call vote, Councilmembers

The Clerk stated that she was in receipt of the following reports:
Inspection of Buildings - May 2000
BUILDINGS & GROUNDS - Committee Chairperson Santoro
reported that maybe they should go down to Trenton again for
another meeting about the Borough Hall Building because it does
not seem to be their top priority. She then went on to say that the
Community Center still does not have a Certificate of Occupancy
and she understood from the Agenda Meeting that a letter has
been sent to the contractor and the Bond Company and then she
questioned how much time would lapse in between before they
could do something.
Attorney Coughlin said what we have done is we have made
demand on the Bond Carrier Project. He said he didn't give them
any dead line in which to do that and that what we are doing is
basically calling down a Bond Sale with day to day sales. They are
unwilling or unable to complete this project whereas he has issued
a Bond for their performance on Monday and he commented that
he hadn't heard from the Bond Carrier. Typically the Bond
Company will talk to the contractor and the Borough.
Committee Chairperson Santoro asked if typically it would be
because we don't have a Certificate of Occupancy on that property
that (inaudible).
Attorney Coughlin said that certainly raises the bar and to a certain
height and area because inaudible.
Councilmember Crilley asked in order to force the Bond Company
to take action is their probably going to be litigation.
Attorney Coughlin said sometimes.
Committee Chairperson Santoro said another area they have talked
about is the meeting with Union County Freeholders on the waste
train that is going to be moving through Carteret that is coming
within thirty (30) days and that is going to be one of our chances to
speak up against this and as soon as this comes available to us she
hopes we can reach out to as many residents as possible, maybe
with a article in the paper, to make people aware. She reported

FINANCE & ADMINISTRATION: Committee Chairperson
O'Brien said next week we will have the final meeting on the
amendment to the budget. With that Progress.
FIRE: Committee Chairperson Fazekas said he did not have his
glasses with him so Mayor Failace commended the Fire
Department for the excellent job they did at the Amoco Facility.
He read the following into the record:
The Fire Department spent over twelve (12) hours at the facility
due to a leak in their storage tanks. The spill was contained in the
dyke area and the Fire Department maintained a foam blanket over
the spill to keep down any vapors.
Mayor Failace went on to commend a Columbus School First
Grader, for being the winner of the Fire Prevention Contest. She
won first prize for her Home Evacuation Plan, which was a ride
to school in the Fire Truck. Also, this past Tuesday the Fire
Department conducted a Confined Space Drill with the FMC
Corporation. The drill simulated the retrieval of an unconscious
man inside a tank. It provided training for both FMC and the Fire
Department.
PARKS & RECREATION: Committee Chairperson Crilley spoke
saying he would like to thank the Fire and First Aid people who
received the awards tonight. He then congratulated the Mayor for
bringing the Head Start Program in Carteret. He said the Summer
Work Program will be starting Wednesday, July 5, 2000. We are
accepting the applications until tomorrow and if any come in after
that we will put them aside and if there are holes to fill they will
use them for that. The list will be approved at the next Special
Meeting. Progress.
POLICE: Committee Chairperson Quinones said Officer
Terebetski just graduated from the Police Academy and from what
she understood he did very well and was given a Merit Award for
being the officer they would most want to work with. She said he
should be commended for that. She congratulated Carmine
Pannullo and Salvatore Renda for their appointments in the
Carteret Police Department and she offered her thanks and
appreciation to the officers in the Narcotics Unit for their
continued success in arrests. Progress.
PUBLIC WORKS: Committee Chairperson Sohayda spoke saying
pretty soon they will stop the tree cutting. They have a few more to
go. They will be stumping their way through the summer. He went
on to say the tanks have been removed and we had some serious
problems in the sewage area of contamination of a higher level.
They also have a problem on Varga Street, there is a fence leaning
toward Borough property and we need to fix it. He said he
informed Mr. Kately and also after speaking to a Code Official
they told him these fences belong concurrent to the property
owners on the other side of the street. He questioned if anyone
knows anything about that.

Mayor Failace said we have always maintained that fence, but he
will check into that.
BOARD OF EDUCATION: Committee Chairperson Santoro said
the Board of Education had a Zoning Meeting on the 13th. Their
sewer work to correct the problems at the High School will be
worked on and completed. Also they were building a storage area
to replace the trailer where the Band Parents worked at the
stadium. She said she spoke to the Mayor last week and they look
forward to setting up a meeting with the new committee and him
and some Councilmembers over the summer, about the different
projects that will be coming up. Progress.
Mayor Failace again thanked the Fire and Police Departments and
the First Aid for all they have done and he thanked them for the
kind words on Head Start. He said he will be meeting an old friend
of his from Linden who will be heading up a committee for a
group in Union County to fight this trash train that will be going
through Carteret. He will report back to the Council on anything
that we can do to stop this terminal from coming into Linden. He
suggested that we as a Council should move forward with a
petition against this.
Upon MMS&C by Councilmembers Crilley and Sohayda and
unanimous affirmative vote of the full Council present the meeting
was declared open for public discussion.
John Schon questioned why the names were taken off he crosses
at the park for Memorial Day.
Mayor Failace said there was an effort to get the crosses spruced
up and the names will be put back on and they weren't all done in
time and he didn't want only some of the names back on.
James Mancuso said the property line at Varga Street is the city's
property not the homeowners. The fence there needs to be fixed.
Bobby Kately said he already fixed it.
A male citizen of Carteret said some time ago he told the Council
of his concern about parking at the eastern end of Carteret Avenue
and he wants to know what, if any, the Council's thoughts are.
Mayor Failace said they will be discussing this with the Board of
Education.
The man commented that the High School is the only school with
off the street parking and questioned when Nathan Hale School is
open where will the parking be.

Mayor Failace asked for a motion to be made to go into Closed
Session to discuss Personnel Matters.

Upon MMS&C by Councilmembers Crilley and Fazekas and
unanimous affirmative vote of the five (5) Councilmembers
present this meeting was opened to the public at approximately
9:04 p.m. Councilmember Sohayda was noted absent.
Attorney Coughlin spoke in reference to the Towing Ordinance,
#00-18. He said he had met with Scott Flowers who had some
concerns with the ordinance. He explained what they see in front
of them is a proposed amendment where he thought he made valid
points that really should have been taken into consideration. The
reason he has done the amendment is to prevent the need to
advertise the entire twenty-nine (29) page ordinance, but, again if
you make these changes the ordinance would have to be re-
advertised. It costs about $1000.00. He said there were other things
that he proposed that he really didn't include, that he asked that
there be a minimum of two (2) trucks per tow that there be a
minimum amount of ten (10) spaces which he thinks it increased in
size. The ordinance as drafted requires only one (1) inside and one
(1) outside. That there be a minimum amount of experience of
three (3) years in the industry in order to be eligible to tow and that
there be a business facility for the towing. He explained that none
of those were in there and that is because there is probably about
eleven (11) towers that are interested in towing and have been
towers for the Borough and many of them don't have those
requirements and then it would preclude them from towing for the
Borough. It was his sense that the Council wanted to maintain a
status quo for the in town towers and we would decline to

favorably consider the amendments to the ordinance which would
have an adverse affect on a number of the towers. He explained
that what is in front of them is what he thinks would not affect a
potential tower or the other and gives a little bit more in terms of
fees by virtue of number three (3), revising of class rate, which
would give us a higher towing fee to charge and it also reflects in
what we mean by a heavy duty car. Panel Trucks can actually be
treated like automobiles and Camper Type Vehicles can be used
for recreational purposes, they are pretty big and this will allow
more fee for activity. He then said they are looking for the
Governing Body's direction.
At approximately 9:1\~ p.m., Councilmember Sohayda was noted
present.
Mayor Failace asked Attorney Coughlin if we advised it with some

Attorney Coughlin said his guess would be five (5) or six (6).
Mayor Failace said that was too much.
Councilmember Santoro asked why this ordinance was being
changed.
Attorney Coughlin said our ordinance, as it existed, was not
enfo¡Çable.
Mayor Failace said it needed to be upgraded. He then asked
Attorney Coughlin if we leave the ordinance as is and put on the
amending ordinance four the four (4) things, then we would not
have to redo the whole ordinance.
Attorney Coughlin said they would have to redo only the change.
He would suggest to adopt the initial ordinance ...........
All present interrupted, speaking on this for a short while.
Councilmember Santoro said she felt the towers should have a
facility that they tow out of.
Mayor Failace questioned if we change the ordinance to say that,
what would it do to the towers we have noW.
Attorney Coughlin said he thought we would get eaten from a
number of towers. He then went on to say we are ready to adopt
the ordinance because we already had the Public Hearing on that.
We can Table the vote on that and introduce this tonight. He said
his recommendation would be to adopt the ordinance and introduce
the amendment.
