HomeMy Public PortalAboutOrd. 1026 ORDINANCE N0. 102.6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ESTABLISHING SALARIES FOR CITY COUNCILMEN AND PROVIDING FOR THE RE- IMBURSEMENT OF COUNCILMEN'S EXPENDITURES WHEREAS, pursuant to Government Code Section 36516, the salary for Council members in the City of Lynwood has been fixed and determined to be the sum of $200.00 per month; and WHEREAS, pursuant to the provisions of Government Code Section 36516.2, said salary may, by ordinance, be increased by an amount equal to five percent (5%) there- of for each calendar year from the operative date of the last adjustment of the salary provided for Council members; and, WHEREAS, since the operative date of the last adjust- ment of the salary applicable to members of the City Council, increases in the cost of living have substantially reduced the value of the aforesaid $200.00 per month salary; and WHEREAS, Councilmen are frequently called upon to bear expenses in addition to those for which they are reim- bursed in accordance with Government Code Section 36514.5; and, WHEREAS, the City Council desires to adjust the salary applicable to its members and to provide for the payment of a fixed sum to reimburse said members for expenses, iJOW, THEREFORE, the City Council of the City of Lynwood hereby does ordain as follows: SECTION 1. In accordance with the provisions of Government Code Section 36516.2, the salary of members of the City Council of the City of Lynwood hereby is fixed and determined to be the sum of $250.00 which amount is less than an amount equal to a five percent (50) increase for each calendar year from the operative date of the last adjustment of such salary. SECTION 2. In addition to the salary established by Section 1 hereof, members of the City Council shall be re- imbursed for expenses incurred by them in connection with the performance of their official duties in the sum of $ 50.00_ SECTION 3. In addition to the salary established by Section 1 hereof, and the reimbursement for expenses established by Section 2 hereof, City Council members may be reimbursed for actual and necessary expenses incurred in the performance of their official duties to the extent that said actual and necessary expenses exceed the amount fixed pursuant to said Section 2. -1- .~ SECTION 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this Ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining por- tions of this Ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, sub- sections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional.
